ITEM TITLE: Resolution - Approving Report, Resolution of I tention, and
Setting Public Hearing for the Fo mation of Chula
Vista Open Space District No. 1

BACKGROUND
On October 24, 1972, E1 Rancho del Rey submitted a petiti n for the
formation of an open space district in accordance with Se tion 35.211 of
the City Code.
A preliminary report was submitted by the Director of Par s & Recreation
and Director of Public Works. It was the recommendation f the Planning
Commission to the City Clerk on December 19, 1972 that th preliminaryy
report, supplemented with their comments, be forwarded to the City Council
for their consideration.
The preliminary report along with the comments and recomm ndations of the
Planning Commission were presented to the City Council on February 14,
1973.
After discussion, the City Council concurred that the sta~f should bring
back an alternate recommendation:
1. Including the entire P-C zone
2. Have it assessed in increments as it is being dev loped
3. Neighborhood parks to be included initially
In a memo dated June 19, 1973 addressed to the Mayor and ouncil, the
Planning Director, Director of Public Works, Director of arks and
Recreation and the City Attorney made recommendations reg rding the

The Engineering Division has prepared a diagram showing th boundaries
of Open Space Maintenance District No. 1. The proposed di trict includes
all property bounded by East "H" Street on the north, Otay Lakes Road
on the east, Telegraph Canyon Road on the south and the pr posed future
alignment of Paseo Ranchero on the west, excluding therefr~m Southwestern
College and other school sites.
The Engineering Division is proceeding with the formation ~f Open Space
District No. 1 for the purpose of maintaining natural open space, green
belt and slopes along major and collector roads.
The Engineering Division proposes to spread the assessment on a per
dwelling unit and acreage equivalent dwelling unit basis. Each acre
of undeveloped land within the boundaries of Open Space Di trict No. 1
will be equivalent to one dwelling unit and will pay the s me assessment
as one dwelling unit. As undeveloped property within the istrict is
subdivided and improved, the assessment for the entire dis rict will be
adjusted to reflect the change in actual number of dwellin units and
additional maintenance costs. ~,
The maximum tax levy necessary to finance the maintenance ~s estimated
is $ 110 000.00•
No assessment will be levied pursuant to Article 2 of Chap er 35 of the
Chula Vista City Code to pay the costs of acquisition and evelopment.
The initial assessment for Phase 1 of Chula Vista Open Spa e District
No. 1 will be $ 2.50 per unit per unit per month for he maintenance
of slopes and natural open space within E1 Rancho del Rey nits No. 1
and 2 and Candlewood Subdivisons.
The assessment per dwelling unit will be adjusted every ye r to reflect
the changes in actual number of dwelling units and additio al
maintenance costs. ~,
