SUMMARY
Caltrans is currently warlcing on the I-805 Direct Access Ramp project that will provide a new
access to/from I-805 to East Palomar Street. This project was not addressed within the original
Freeway Agreement for I-805, executed on July 1, 1968; therefore, it is necessary for the City
and CalTrans to execute an amendment, called a Superseding Freeway Agreement ("SFA"), to
the 1968 Freeway Agreement. This amendment will authorize the right-of--way and construction
phases.
ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed activity for compliance with the
California Environmental Quality Act (CEQA) and with the National Environmental Policy Act
(NEPA) since this is a federally funded prof ecf, and has determined that the activity, consisting
of approval a Superseding Freeway Agreement with Caltrans that will provide for a new Direct
Access Ramp (DAR) to and from I-805 at East Palomar Street is adequately covered in
previously certified Final Environmental Impact Report (FEIR)/Environmental Assessment (EA)
with Finding of No Significant Impact for the Interstate 805 Managed Lanes South Project. The
Final EIR/EA was prepared by the State of California Department of Transportation (Caltrans)
and certified on Jtu1e 22, 2011 pursuant to Division 13, California Public Resources Code and
Title 42, USC 4332(2)(C). The City of Chula Vista was a Responsible Agency in the EIR/EA
approval process. Thus, no fiu-ther CEQA or NEPA environmental review or determination is
necessary.

DISCUSSION
The California Department of Transportation (Caltrans) is currently in the design phase of the
Interstate - 805 Managed Lanes South Project that will provide for a new freeway access point, a
Direct Access Ramp, at the East Palomar Street bridge. The proposed improvements will
provide express lanes that will be free for high occupancy vehicles (two or more occupants),
buses and motorcycles. The express lanes will also be made available for single occupancy
vehicles using the electronic FasTralc transponder system. The project fact sheet is attached
(Attachment 1). The environmental documents have been approved (Attachments 2 & 3); and
the design work is nearing completion.
In a letter dated September 14, 2011 (Attachment 4), the California Department of
Transportation (Caltrans) stated that it is necessary to amend the existing Freeway Agreement
with an SFA (Attachment 5) due to a new freeway access point that will soon be provided at East
Palomar Street.
For the purposes of providing background, it should be noted that each freeway through the City
of Chula Vista has an existing Freeway Agreement. For Interstate-805, the Freeway Agreement
was. executed on July 1, 1968. It covers I-805 from the south City limits (Otay Valley Road) to
the City of San Diego (0.3 miles north of Imperial Ave.). The project mentioned above, however,
was not addressed within the original Freeway Agreement. In order for CalTrans to move
forward on the project right-of--way and constntction phases of the Project, an amendment to the
I-805 Freeway Agreement, which CalTrans calls a "Superseding Freeway Agreement," is
necessary. Caltrans cannot on this work unless and until the City executes the SFA. The SFA
will cover the south Chula Vista limits at post mile 3.4 to the East Naples Street undercrossing at
post mile 5.6.
The SFA addresses and amends only the portion between the south Chula Vista city limits and
the Naples Street Undercrossing (UC). Of note is that the East Naples Street bridges are shown
on Caltrans records as "Naples Street UC Br- No. 57-0634 L/R" and are called out on the SFA as
"Naples Street Undercrossing".
Next year, Caltrans and the City of Chula Vista will bring forward the, updated Freeway
Maintenance Agreement (FMA) that will clearly define the revised maintenance areas that each
agency is responsible to maintain. Both agencies are still working on those design elements and
will wrap up work on this in a few months time. Thus, tonight's Council action on the SFA will
not have any fiscal impact, since it is only updating the Caltrans Freeway Agreement as
mentioned above. It is the FMA that will be brought forward for Council approval about the
time that construction commences that will describe the changes to the-areas that today Caltrans
maintains, the City maintains and Chula Vista Open Space District 7 maintains.

In the future, as Caltrans works north of East Naples Street on a subsequent I-805 phase, we will
receive a similar request to amend the current freeway agreement. The impending work on I-805
will be limited to the area from East Naples Street to just south of East Palomar. Street. Thus, the
SFA addresses and amends that portion of the Freeway Agreement within the limits from East
Naples Street to the south city limits at Otay Valley Road.
Constriction for the I-805 DAR project is anticipated to begin in the summer of 2012 and be
completed by late 2014. The Otay Water District will be relocating a water line in early 2012 in
order for the Caltrans work to begin on East Palomar Street.
DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is not site
specific and consequently the .500 foot Wile found in California Code of Regulations section
18704.2(x){1) is not applicable to this decision.
CURRENT YEAR FISCAL IMPACT
None with tonight's action.
ONGOING FISCAL IMPACT
Future Council action will approve a revised FMA. New traffic signal maintenance will require
only routine, normal maintenance of the surrounding city street and traffic signals. Funding
sources include Transnet and Gas Tax and these costs shall be shared with the State. Drainage
maintenance and landscaping costs shall be borne by the original and previously established
Landscape Maintenance District # 7. Minimal landscaping costs by City for areas west of I-805.
Costs will be provided with FMA report and resolution due to Council by July 2012.

THE PROJECT AT A GLANCE
The Interstate 805 South Project is part of the larger I-805 Corridor
Projects. The I-805 South Project area is 11 miles between Palo-
mar Street and the I-805/SR-15 interchange. The project includes
the addition of express lanes within the I-805 median. The project
will cost an estimated $1.3 billion to complete. Funding is expected
to be a combination of federal, state and local programs, including
TransNet dollars.
THE IMPROVEMENTS
Proposed improvements include express lanes that will be free for
high occupancy vehicles (HOV), buses and motorcycles; and avail-
able to single occupant vehicles for a fee. A bus rapid transit
system will also operate on the express lanes. The project will
include features that will conveniently connect members of the
community to the express lanes, including a Direct Access Ramp,
intermediate access points, HOV direct connectors, in-line transit
stations and park-and-ride locations. Sound walls and retaining
walls will be constructed and bridge improvements will be made at
various locations along the freeway to help maintain the quality of
life for neighboring communities.
MILESTONES
Public outreach efforts are underway with public meetings sched-
uled in September 2010 and the environmental studies expected to
be complete in mid 2011. Construction is expected to begin in
2012.

Chapter 7.0 Proposed Project
This alternative would require a wider development footprint, resulting in additional ramp
realignments and increased R/VV acquisition along the length of Project limits. Because of the
anticipated amount of R/1N acquisition required, the cost to construct this alternative would have
been major, and the adjacent neighborhoods would have been severely impacted. This
alternative was rejected for these reasons.
1.6.3 Transit-only Lanes Alternative
This alternative would have consisted of building one transit-only lane in each direction within
the freeway median from just south of the East Palomar Street overcrossing 4o the Landis Street
overcrossing. The transit-only lane would have been separated from the general purpose lanes
by a painted median. This option would have included constructing many of the features that
are required for Alternatives 1 and 2 including transit stations, a DAR at East Palomar Street,
and direct connector ramp to SR 15. This alternative would not meet the vision of the 2030
RTP, which consists of a flexible highway system in which transit vehicles share lanes with
carpools, vanpools, and toll-paying SOVs. In addition, the 2030 RTP recommends development
of more than 200 miles of managed laneIRON network along lnterstate 5, 15, and 805; thus a
transit-only option would not be consistent with the planned regional network. This alternative
would have constructed many of the same features as the build alternatives yet reduces the
flexibility to manage HOV and SOV users on the system.
Given the infrastructure required and the inability to manage the system, this alternative would
not be considered a prudent expenditure of funds. Due to inconsistencies with 2030 RTP and
reduced flexibility, this alternative has been withdrawn from further consideration.

Dear Mr. Hopkins:
The existing Freeway Agreement for Interstate 805 dated July l Si, 1968 between the south City
limits and the north City limits needs to be amended per California Streets and Highways Code
sections 100.2 and 100.22 to reflect a new direct access ramp to the freeway. The East Palomar
Direct Access Ramp (DAR) project will construct a direct connection between Interstate 805
Express Lanes to the City of Chula Vista East Palomar Street. This new connection will serve
Bus Rapid Transit, high occupancy vehicles, and single occupancy vehicles using FasTrak. The
attached agreement supersedes a portion of the existing agreement between the south City limits
and Naples Street undercrossing.
An environmental document was approved on June 2011 for the construction of the Express
Lanes on Interstate 805 Freeway from just south of East Palomar Street in the City of Chula
Vista to Landis Street overcrossing in the City of San Diego. This document includes the DAR at
East Palomar Street.
Enclosed are three copies of the Freeway Agreement for execution by the City of Chula Vista.
Please note that Caltrans needs three original executed agreements and three original resolutions.
The resolution should include a statement which (a) authorizes an official to sign the Agreement
and (b) indicates that the provisions of Section 100.22 have been complied with.

SUPERSEDING FREEWAY AGREEMENT
THIS AGREEMENT, made and entered into on this day of
2011 , by and between the STATE OF CALIFORNIA acting by and through
the Department of Transportation (herein referred to as "STATE"), and the City of Chula Vista
(herein referred to as "CITY"),
WITNESSETH:
WHEREAS, the highway described above has been declared to be a freeway by Resolution of
the California Transportation Commission September 27, 1960; and
WHEREAS, STATE and CITY have entered into a Freeway Agreement dated July 1, 1968,
relating to that portion of State Highway Route 805 between the south CITY limits and the north
CITY limits of Chula Vista ;and
WHEREAS, a revised plan map for such freeway has been prepared showing the proposed
plan of the STATE as it affects streets of the CITY; and
WHEREAS, it is the mutual desire of the parties hereto to enter into a new Freeway
Agreement in accordance with the revised plan of said freeway; '
NOW, THEREFORE, IT IS AGREED:
1. This Agreement supersedes that portion of said Freeway Agreement dated July l~`
1968 from the south CITY limits to the Naples Street Undercrossing.
2. CITY agrees and consents to the closing of CITY Streets, construction of frontage
roads and other local roads, and other construction affecting CITY streets, all as
shown on said plan map attached hereto marked Exhibit A and made a part hereof by
this reference.
3. STATE shall, in the construction of the freeway at the STATE' S expense, make such..
changes affecting CITY streets in accordance with plan map attached hereto marked
Exhibit A.

4. STATE agrees to acquire all necessary rights of way as may be required for
construction, reconstruction or alteration of CITY streets, frontage roads and other
local streets. The CITY hereby authorizes the STATE to acquire in its behalf all such
necessary rights of way;
5. It is understood between the parties that the right of way maybe acquired in sections
or units, and that both as to the acquisition of right of way and the construction of the
freeway projects, the obligations of STATE hereunder shall be carried out at such
time and for such unit or units of the projects as funds are budgeted and made
lawfully available for such expenditures.
CITY will accept control and maintenance over each of the relocated or reconstructed
CITY streets, and the frontage roads, and other STATE constructed local streets on
receipt of written notice to CITY from STATE that the work thereon has been
completed, except for any portion which is adopted by STATE as a part of the
freeway proper. CITY will accept title to the portions of such streets lying outside
the freeway limits upon relinquishment by STATE.
7. This agreement may be modified at any time by the mutual consent of the parties
hereto, as may become necessary for the best accomplishment through STATE and
CITY cooperation of the whole freeway project for the benefit of the people of the
STATE and the CITY.

first written.

WHEREAS, each freeway within the City Of Chula Vista is the subject of a Freeway
Agreement between Chula Vista and the State; and
WHEREAS, a Freeway Agreement grants the State authority to make adjustments to the
City street system in order to develop the portions of the associated freeway that are within the
City; and
WHEREAS, the Freeway Agreement for Interstate-805, FMA 11-8061, was executed on
July 1, 1968, and covers I-805 from the south City limits (Otay Valley Road} to the City of San
Diego (0.3 miles north of Imperial Ave.); and
WHEREAS, Caltrans is currently working on the I-805 Direct Access Ramp project that
will provide a new access to/from I-805 to East Palomar Street; and
WHEREAS, the proposed improvements will provide express lanes that will be free for

WHEREAS, the noticing and meeting for this action are in compliance with California
Streets and Highways Code § 100.22.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby approve the Superceding Freeway Agreement between the City of Chula Vista
