STL-376)" PROJECT TO CMT ENGINEERING, INC. IN THE AMOUNT OF $116,702, AWARDING AN ADDITIVE ALTERNATE BID IN THE AMOUNT OF $5,440 AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO APPROVE CHANGE ORDERS UP THE CONTINGENCY AMOUNT OF $11,858 SUBMITTED BY: DIRECTOR OF PUBLIC WORKS ASSISTANT DIlZE T R OF ENGINEE REVIEWED BY: CITY MANAGE ASSISTANT CITY ANAGER ~j~ 4/STHS VOTE: YES ^ NO SUMMARY On October 5, 2011, the Director of Public Worlcs received sealed bids for the "Eucalyptus Parl< Right-of-Way and Parl< Access Improvement Along "C" Street from Fourth Avenue to North Fifth Avenue in the. City of Chula Vista, CA (CIP No.: STL-376)" project. The project will provide a continuous paved accessible route along the "C" Street frontage of Eucalyptus Park between Fourth Avenue-and Fifth Avenue. The proposed resolution would award a contract for this work to CMT Engineering, Inc. and authorize the Director of Public Works to expend all available funds in the project. ENVIRONMENTAL REVIEW The Development Services Director has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 1 categorical exemption pursuant to Section 15301 (Existing Facilities) of the State CEQA Guidelines because the proposed park right-of--way and access reconstniction and improvements involve negligible or no expansion of an existing use. Thus, no further CEQA environmental review is necessary. Additionally, because the proposed project will be utilizing federal Community Development Bloclc Grant (CDBG) funds, the Development Services Director has also reviewed the project proposal for compliance with the National Environmental Policy Act (NEPA) as implemented by the U.S. Department of Housing and Urban Development (HUD) 5-1 11/15/11, Item '~,.~' Page 2 of 4 Environmental Guidelines. The Development Services Director has determined that the project proposal qualifies for a previously certified Categorical Exclusion (subject to 58.5) pursuant to Code of Federal Regulations (CFR) Title 24, Section 58.35(a}. Thus, no further NEPA environmental review or determination is necessary. RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not applicable. DISCUSSION Eucalyptus Parlc, on the south side of "C" Street, between Fourth and Fifth Avenues, is regularly used by a large number of the City's residents and visitors. However, this park is only accessible to pedestrians with disabilities between Fourth Avenue and the first driveway west of Fourth Avenue. From that driveway to Fifth Avenue, the existing graded dirt path does not meet Americans with Disabilities Act (ADA} requirements for accessible Pedestrian Access Routes (PAR}. This project will provide ADA-compliant sidewalk improvements between Fourth and Fifth Avenues along the park's frontage and provide compliant access from the sidewalk to the park property. In order to fully meet current ADA requirements for accessible PAR, staff included an additive alternative bid for the replacement of pedestrian signal push buttons at the intersection of "C" Street and Fifth Avenue. On October 5, 201 1, the Director of Public Works received sealed bids for the "Eucalyptus Park Right-of--Way and Park Access Improvement along "C" Street from Fourth Avenue to North Fifth Avenue in the City of Chula Vista, CA (CIP No.: STL-376)" project. Six (6) bids were received as follows: CONTRACTOR BID AMOUNT CMT Engineering, Inc. -Chula Vista, CA $116,702.00 MJC Construction, Inc. -Bonita, CA $123,265.00 PAL Engineering, Inc. -San Diego, CA $156,387.25 Koch -Armstrong General Engineering, Inc - El Cajon, CA $168,379.00 Heffler Contracting Group, Inc. - El Cajon, CA $184,700.00 Curto Construction Company (CCC), Inc - La Mesa, CA $187,355.00 The lowest responsive bid by CMT Engineering, Inc. (CMT) of Chula Vista, CA is above the Engineer's estimate of $110,000 by $6,702, or approximately 6%; staff verified that CNIT's bid proposal met all requirements; CMT's bid for the additive alternative work for pedestrian pushbuttons is $5,440. CMT has completed several CIP projects for the San Diego School Unified District and has over 12 years of construction experience in works similar in nature to the work to be performed under this contract. Upon request by staff, CMT provided several 5-2 11/15/11, Item Page 3 of 4 references. Staff checked these references and determined that CMT's work has been satisfactory. Further, CMT's Contractor's License No. 723636 is current and active. Therefore, staff recommends that the City Council award a contract to CMT Engineering, Inc. of Chula Vista, CA. The proposed resolution would also authorize the Director of Public Worlcs to approve change orders over and above existing policy limits. Under City Council Policy No. 574-01, if an individual change order causes the cumulative increase in change orders to exceed the Director's authority ("Maximum Aggregate Increase in Change Orders"), then City Council approval is required. The corresponding maximum aggregate contract increase that may be approved by the Director of Public Worlcs under Policy No. 574-01 is $11,550. Approval of the resolution would increase the Director of Public Works' authority to approve change orders, as necessary, up to the contingency amount of $11,858, an increase of $308 over Policy No. 574-01. Increasing the contingency funds will allow staff to continue the project without delay should unforeseen circumstances resulting in increased project costs arise during the course of construction, as well as make adjustments to bid item quantities. Unforeseen conditions include such items as utility conflicts, hazardous materials, unexpected underground conflicts, etc. If the contingency funds are not used, then they will be returned to the project fund balance. Disadvantaged Business Enterprise Goal The bid documents set forth participation requirements under federal regulations for meeting disadvantaged minority and women-owned business goals. Staff has reviewed and certified CMT as a MBE (Minority Business Enterprise), and no further review is needed. Further, CMT Engineering, Inc. is not listed as excluded from Federal Procurement Programs (list of parties excluded from Federal procurement or non-procurement programs as of October 6, 2011). Disclosure Statement Attachment "B" is a copy of the contractor's Disclosure Statement. Wage Statement This project is covered by the Davis-Bacon. and Related Acts and the State of California Division of Labor Statistics & Research. The Davis-Bacon Act requires the payment of prevailing wage rates to all laborers and mechanics employed for the work under this project. Prevailing wage rates are those determined by the U.S. Department of Labor or the U.S. Department of Housing and Urban Development. However, due to the State of California Division of Labor Hiles, the Contractor is to pay the higher of the two wage rates. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the properties, which are the subject of this action. 5-3 11/15/11, Item 17 Page 4 of 4 CURRENT YEAR FISCAL IMPACT The following summarizes project costs: FUNDS REQUIRED FOR CONSTRUCTION A. Contract Amount $116,702 B. Additive Alternate (Pedestrian Pushbuttons at C St. & 5`~' Ave.) $ 5,440 C. Contingencies $ 11,858 TOTAL FUNDS REQUIRED FOR CONSTRUCTION $134,000 Sufficient funds are available in the project account to complete the work. The source of fiinding for this project is Community Development Bloclc Grant Recovery Act Funds Program (CDBG-R). ONGOING FISCAL IMPACT Upon completion of the project, the improvements will require only routine City street maintenance.
