[11 ~ CHULA VISTA CITY COUNCIL MEETING OF: July 3, 197 3 7TT:M TTTT.1= INITIATED BY: RA('KC;RniiNTl Resolution - Accepting Easement for General Utility Purposes in E1 Rancho del Rey Unit No. 1 Subdivision Director of Public Works/City Engineer The City Council on August 8, 1972 by Resolution No. 6542 approved the final map for E1 Rancho del Rey Unit No. 1 Subdivision. This map was recorded in the office of the County Recorder as Map No. 7396 on August 9, 1972. Public streets and easements were offered for dedication and accepted by the City. One of the easements is a 7-1/2 foot tree planting and maintenance easement which is located adjacent to the right of way line of the dedicated streets. The contractor for the developer con- structed the foundations for the street lighting standards prior to the installation of curb, gutter and sidewalk. The contractor, upon exca- vation for the foundations discovered that underground utilities con- sisting of electrical, telephone, etc. were in conflict, and on his own volition relocated the foundation for the standards in a way to avoid these utilities. As a result, some of these light standards were placed upon private property outside of the street right of way. Encroachment onto private property varies from 3 to 21 inches. Because the City will be maintaining the street lights and standards, an easement had to be obtained from the present owner, Larwin - San Diego, Inc. The owner has executed a grant deed granting to the City of Chula Vista an easement for general utility purposes within the present 7-1/2 foot tree planting and maintenance easement affecting those lots where the street light standards and foundations are presently encroaching upon private property. The attached grant deed grants a 7-1/2 foot easement for general utility purposes across 56 of the lots in E1 Rancho del Rey Unit No. 1 Subdivision. A plat showing the lots upon which an easement for general utility purposes has been granted is attached.
