ITEM TITLE: Public Hearing/Resolution - Variance or Suspension of
Requirements for the Undergrounding of Utilities at 327-347 "J"
Street, Tree Haven Apartments

A condition of approving the final parcel map for Tree Haven Apartments is
that overhead utilities be undergrounded on "J" Street.
The owner, R. S. Snell, has applied for a suspension of this requirement
in accordance with the provisions of Ordinance 1128.. He has paid the
required $50 fee for covering the costs of conducting a public hearing.
Mr. Snell, in his letter addressed to the Honorable Mayor and City Council,
dated June 11, 1973, states that the requirement to underground overhead
utilities be suspended, based upon two reasons:
1. That the undergrounding as requested (by staff and imposed as
condition of approval of the final parcel map) would make an insignificant
impact upon the total problem of visual pollution.
2. That the requirement to underground overhead utilities is not in
accord with the purpose and intent set forth in Section 34.101 of the
Chula Vista City Code - "It is the purpose and intent of this Article to
require the undergrounding of all.....present distribution installations
within new subdivisions in the City of Chula Vista except where....sewer
and water utilities have been installed or in those circumstances where
such undergrounding would be infeasible or impractical as set forth herein.
Mr. Snell also in his letter points out that at the present time, the

the developer enter into an agreement with the City guarant~g the

overhead utilities are located on both the north and south sides of
"J" Street and a piecemeal undergrounding program would not seem at all
feasible. Also, the utility poles located at the east and west property
lines of the existing apartments would still remain after undergrounding
and the only change affected by undergrounding at the present time would
be the removal of a single line running between those poles.
NSr. Snell requests that a suspension or waiver of the requirement to
underground utilities be granted upon the condition that an agreement
be entered into between the developers and the City in which the
developers would support any program for undergrounding of utility lines
along "J" Street at the appropriate time in the future.
