.~ RESOLUTION NO. 7032 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING THE COUNCIL POLICY MANUAL - 1973 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Clerk has heretofore consolidated all pertinent policy statements made by the present and past City Councils either by minute action or by resolution to and including the date of August, 1973, and WHEREAS, the City Clerk in preparing the Council Policy Manual has consulted with the City Manager, City Attorney and department heads to insure that all relevant policies have been included in the updated Council Policy Manual. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby adopt the Council Policy Manual - 1973. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby charged with the responsibility of maintaining and up- dating said Manual. BE IT FURTHER RESOLVED that the procedure for the main- tenance of said Policy Manual is as contained in Exhibit "A", attached hereto and incorporated herein by reference as if set forth in full. Regulatory policies established by the City Council are adopted by ordinance and included in the Municipal Code. Other policies are also established which by their nature do not require adoption by ordinance. " POLICY 1. There is hereby established a "Council Policy Manual" which shall contain all City policy statements adopted by resolution or minute action of the City Council. 2. Generally, policy statements in this "Council Policy Manual" • will include only such municipal matters for which the responsibility of decision is placed in the City Council by virtue of the City Charter, the Municipal Code, or specific ordinances and resolutions.- Forts C0-001 (4-73) ~~~- ~ ~ . All policy statements of the City Council shall be prepared in writin g and approved by resolution. Once approved, statements of policy will be reproduced, distributed, and included in the °'Council Policy Manual" accompanied by the resolution number and date of adoption. 4. Each policy statement shall include: a) a brief background description of the problem, b) the purpose of the policy, c) the policy statements, and d) other criteria or procedural sections, as required. 5. The City Clerk shall be responsible for the preparation, continuing maintenance, and distribution of the "Council Policy i~~an ual," and additions or deletions thereto. 6. Copies of the ''Council T?011c~' Nai~ual" Shall be dlstr~bu-;ed . to the City A4anager, City Attorney, and to each department head and to such of their representatives as they may direct. 7. The City Clerk shall be responsible for the assignment of tentative and final policy numbers and titles to a proposed policy draft. For these purposes, she shall be consulted prior to the submission of the draft policy to the City Council. 3. Drafts of proposed Council policies and proposed amendments to existing policies shall be submitted to tiie City P~Ianager for a scheduling of a Council Conference on tine proposed policy to permit full presentation to and discussion by the City Council. PURPOSE Establishing a policy relating to the display of the flag of the United States of America at half-mast as a mark of respect. Pf1T.T ('V The City Manager is directed ar_d authorized to display the flag of the United States of America at half--mast in accordance with the rules set forth below and at such .times as the President of the United States, the Governor of the State of California, or the Mayor of the City of Chula Vista may; by proclamation, prescribe such action.. Rules for displaying the Stars and Stripes at half-mast are as follows: 1. In case of the death of a governor of a state, territory or possession, the flag shall be at half-staff on all ships and sta-L-ions in such state, territory or possession from day of death until interment. 2. Any rule or custom pertaining to the display of the flag of the United States as set forth in Public Law 829, may • be altered, modified or repealed, or additional rules with respect thereto may be prescribed, by the Conu-nander in Chief of the Army and Navy of the United States, whenever he deems it to be appropriate or desirable, and any such alteration or additional rule shall be set forth in a proclamation. Diseased, Dying Trees The City will remove or replace dead trees. The City will remove and replace diseased trees only when reasonably applied pest control or other remedial measures will not save the tree. Special Request for Removal The following conditions must be met to permit tree removal when for reasons of inconvenience a property owner requests a particular street tree. to be removed: 1. The replacement tree will eventually improve the area's appearance. 2. It is determined after consultation with the Land- scape Planner that the tree removal will not aestheti- cally impair the character of the area. 3, The tree must be of the wrong species for its loca- tion. 4. Tuition Refund. Any probationary or permanent status officer or employee of the City of Chula .Vista may be reimbursed, from the General Fund of the City, for tuition for professional and technical courses provided that enrollment by the officer or employee in such courses has received the prior approval of 'his department head and of the Training Advisory Committee. Tuition actually paid will be refunded for such courses taken in accredited educational institutions.. 3. Application for tuition refund must be approved by the depart- ment head prior to the enrollment by the officer or employee in the course. The application must also be approved by the Training Advisory Committee in advance of said enrollment. The cost of such medical services and hospital care and treatment shall be paid from the appropriate general fund and in such cases where the prisoner is financially able to pay for his care, special agreement for payment may be arranged. It has been the general policy of the Chula Vista Police Department that the City would pay from the general fund for hospital care or medi- cal services required for injuries or illness arising subsequent to arrest, and that said costs for injuries and illness occurring prior to or at the time of arrest, if such injuries are not the result of the arrest, would be assumed by the prisoner. PURPOSE Establishing a policy for the payment of costs incurred for medi- cal and hospital treatment of prisoners. Selection of Ambulance Service. There shall be one {1) ambulance company selected to provide emergency service for the Police Department. Service shall be awarded to the bid- der providing the highest qualifications for a one-year period to be recommended by the CP.O. 2. Eligibility. Any firm shall be eligible if it has been in operation within the City for six {6) months and conforms to all rules and regulations. 3. The successful bidder shall-enter into a contract with the City stating operations and fees. Fee schedule may be revised ,at any time by mutual agreement of the parties. 4. If no bids are received, the CAO may negotiate an agreement to be approved by the City Council. 5. Eligibility shall be established in accordance with Article II, Chapter .31 of the Chula vista City Code. 6. PURPOSE Establishing a policy regarding the installation of temporary cul- de~sacs in-new subdivisions. POLICY The City Council adopts the following policy with respect to tem- porary cul-de-sacs: 1. All dead end streets, or streets terminating at the boundaries of a subdivision. or unit of a subdivision shall terminate in a properly constructed cul-de-sac. It shall be the responsi- bility of the subdivider to acquire necessary slope rights from adjacent property owners to install said cul-de-sac immediately adjacent to said boundary or upon the property of the adjacent owner, provided, however, if said adjacent owner refuses to grant the necessary slope rights and City has been assured that appropriate requests have been made for the ac- ,quisition of said slope rights but that it was impossible to acquire them, the cul-de-sac may be constructed at a reasonable distance from the boundary of the subdivision. 2. The modified policies read as fol- lows: A. Any marshlands determined to be of high ecological value should be preserved in their natural state and all new Bevel- - opment, whether roadways, buildings, or other structures, should be carefully located and designed to promote this end. Where it can be determined that some filling and dredging is required to accommodate a viable plan, it will be considered. Fs. Public pedestrian access should be pro- vided along the Bay shoreline and along the edges of the Sweetwater River Marsh, with the understanding that an occa- sional use requiring waterfront access may not tolerate inter- ruption by pedestrians or bicyclists. C. Good pedestrian and vehicular access should be created between the Bayfront and those areas of the City east of the freeway. D. Primary uses to be considered for the-study area should be limited to public recreation, commercial activities such as hotels, motels and restaurants, and compatible water-related industrial activities when determined to be of substantial public benefit. E. Retail development which would be directly competitive with existing or proposed sub-regional and regional shopping center facilities elsewhere in Chula Vista should not be permitted within the area. F. Where not disallowed by State Tideland Grant provisions, li- mited residential developments, based on sound market analy- sis, may be considered to assist in providing a,wider selec- tion of housing types and environments in the San Diego area. GENERAL RESPONSIBILITY FOR CONSTRUCTION OF DRAINAGE FACILITIES: Construction Responsibility; Generally As stated herein, the basic responsibility for the maintenance and improvement of drainage facilities is that of the property owner through whose property the natural drainage channel runs and who requires the improvement of said facilities for the protection of his property 'interest. However, the City does have a general responsibility to insure the proper construction, maintenarce~ •and improvement of drainage facilities to protect the public health, safety and general welfare of the City as a whole. Major Channels. The responsibility for the cost of the design and construction of the most economical design of . major channels and structures shall rest with the City. In the event•that the property owners desire a system in- volving greater expense than that which is approved by the .Director of Public Works, they shall be required to con- tribute the difference in the cost as estimated by the Director of Public Works. Subdivision Projects. ~~hen a property is subdivided, the subdivider is required to .accept the surrounding drainage as it enters his property and .convey it in appropriate facilities across his property to a suitable discharge, which may necessitate the acquisition of easements and con- struction of off-site drainage facilities. The cost of these projects will be paid by the subdivider. 3. C'a ip tal Improvement Proj acts. These are drainage facili- ties which will benefit ei-r.her the entire City or a very large community. Projects of this nature will be financed by the City, either from the Capital Outlay Fund or from Gas Tax funds . 4. Assessment Projects. A cooperative drainage pro- ject is one in which the City shares the total cost of the installation with the property owner. The percentage of participation shall be based upon an estimate of the re- spective benefits derived by the City and the property .owner prepared by the Director of Public Works, and the City`s participation shall be limited to 50$ of the total cost of the most economical design.
