RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA ADOPTING NEGATIVE DECLARATION IS-88-2
AND AUTHORIZING ISSUANCE OF COASTAL DEVELOPMENT
#015 TO SANTA FE LAND IMPROVEMENT COMPANY FOR
REMOVAL OF LIQUID WASTES FROM TWO CONCRETE VAULTS
ON GUNPOWDER POINT, DISPOSAL OF LIQUID WASTES,
AND DEMOLITION OF THE VAULTS
The City Council of the City of Chula Vista does hereby resolve as
follows:
WHEREAS, the Chula Vista Bayfront Local Coastal Program (LCP) was
certified by the California Coastal Commission; and,
WHEREAS, said LCP includes coastal development permitting procedures
determined by the Coastal Commission to be legally adequate for issuance of
Coastal Development Permits; and,
WHEREAS, the City of Chula Vista has assumed permit authority over
the Chula Vista Coastal Zone; and,
WHEREAS, a public hearing was held on August 4, 1987, in accordance
with said permitting procedures; and,
WHEREAS, the City Council of the City of Chula Vista as the approving
authority has reviewed the request for the removal of liquid wastes from two
concrete vaults on Gunpowder Point, disposal of liquid wastes, and demolition
of the vaults.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Chula Vista hereby adopts Negative Declaration IS~88-2.
BE IT FURTHER RESOLVED that the City Council of the City of Chula
Vista finds, based on the following findings, that the proposed removal of
liquid wastes from two concrete vaults on Gunpowder Point, disposal of liquid
wastes, and demolition of the vaults is consistent with the policies of the
Chula Vista Bayfront LCP,
1. Consistent with the grading and drainage requirements in Section
19.87.07 of the Specific Plan, siltation in wetland areas
resulting from site runoff will be minimized by conducting
demolition and backfilling activities between April 1 and
November 1. In addition, all areas disturbed by grading will be
planted within 60 days of initial disturbance and prior to
December 1. Finally, the planting shall be done under the
supervision of a licensed landscape architect and will provide
seeding, mulching, fertilization, and irrigation adequate to
provide 90 percent coverage within 90 days (planting will be
repeated if adequate coverage is not established).
2. Vault ~l is located on the portion of Gunpowder Point zoned for
hotel usage. Vault #2 is located north of Vault #1 in the area
designated for public open space. Removal of the liquid wastes
and the vaults in a safe manner is consistent with the planned
uses of the area.
3. The demolition of the vaults would improve the visual quality of
Gunpowder Point and thus is consistent with the LCP form and
appearance guideline which states "Improve the visual quality of
the shoreline by promoting public and private uses which provide
proper restoration, landscaping, and maintenance of shoreline
areas".
4. The demolition of the vaults would also remove a blighting
influence on the area consistent with the form and appearance
which states "Remove, or mitigate by landscaping, structures or
conditions which have a blighting influence on the area".
BE IT FURTHER RESOLVED that the City Council of the City of Chula
Vista hereby issues Coastal Development Permit #015 for removal of liquid
wastes from two concrete vaults on Gunpowder Point, disposal of liquid wastes
and demolition of the vaults.
