[ ] CHULA VISTA CITY COUNCIL MEETING OF: November 26, 1974 Public hearing - Consideration of revision in General Plan from Parks and Public Open Space to Low Density Residential (1-3 DU/Ac.) for ITEM TITLE: approximately 4.6 acres located south and west of Otay Lakes Road and Allen School Lane, adjacent to Ella B. Allen Elementary School Resolution - A mending the General Plan of the City of Chula Vista for approximately 4.6 acres located south and west of Otay Lakes Road INITIATED BY: and Allen School Lane, adjacent to Ella B. BACKGROUND Consideration was given by the City Council to acquisition of the subject property for a park site, but due to cost considerations it was not purchased. Subsequently, a tentative map for a 13 unit subdivision (Rancho Robinhood No. 2 Annex) was submitted and approved by the Planning Commission on June 26, 1974. B. ENVIRONMENTAL IMPACT The Environmental Review Committee reviewed the Initial Study application for this project on August 29, 1974 and issued a Negative Declaration of Environmental Impact for the following reasons: 1. There are no significant environmental features involved which would be adversely affected by the project. 2. The project conforms to the long term environmental goals of the City. 3. There are no growth inducing impacts generated by the project. 4. The project has no significant adverse effects on human beings, directly or indirectly. The Negative Declaration was not appealed and became final on September 13, 1974. ATTACHED: Resolution [X] Financial Statement: P~.A. (continued on supplemental page Ordinance [ ] Agreement L Plat [X] See EXHIBITS [X] No. 1~2-3 Commission-Board Recommendation: On October 30, 1974 the Planning Commission by a 6-0 vote adopted a resolution recommending that the City Council amend the General Plan to change the designation of the subject property from Parks and Public Open Space to Low Density Residential (1-3 DU/Ac.) Adjacent General Plan Deisgnations: North - Low Density Residential (1-3 DU/Ac.) South - Low Density Residential (1-3 DU/Ac.) East -School West -Low Density Residential (1-3 DU/Ac.) 2. Adjacent zoning and land use: North - E-1 (County) Single family residences South - R-E-P Single family residences East - R-E-D Allen Elementary School West - E-1 (County) Single family residences 3. As this property is currently being subdivided it is appropriate to change the General Plan designation to Low Density Residentil (1-3 DU/Ac.) to make it consistent with the designation on adjacent areas and with the existing R-E-P zoning. ~~5~ f RESOLUTION N0. PCM-7,4-22-D RESOLUTION OF THE CI'i if PLANNING COMMISSION RECOMMENDING TO THE EXHIBIT CITY COUNCIL AN AP-tENDMENT TO THE GENERAL PLAN FOR APFROXIPIATELY 4.6 ACRES LOCATED SOUTH AND WEST OF OTAY LAKES ROAD AND ALLEN _ SCHOOL LANE, ADJACENT TO ELLA B. ALLEN ELEMENTARY SCHOOL WHEREAS, the City of Chula Vista has an adopted General Plan, and WHEREAS, State law requires that zone designations of property conform to the General Plan, and WHEREAS, the General Plan designates approximately 4.6 acres located south and west of Allen School Land and Otay Lakes Road as Parks and Public Open Space, and WHEREAS, consideration was given by the City Council to acquisition of the subject property for a park site, but due to cost considerations it was not purchased, and WHEREAS, a tentative map fora 13 unit subdivision was submitted and approved in June, 1974, and WHEREAS, the City Planning Commission set the time and place for a hearing to consider a revision of the General Plan relating to the designation of this 4.6 acres, and notice of said hearing; together with its purpose, was given by the publication in a newspaper of general circulation in the City at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., October 30, 1974, in the Council Chamber, Civic Center, before the Planning Commission and said hearing was thereafter closed. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: i. From facts presented to the Commission, the Commission finds that public necessity, convenience and general welfare require the adoption of an amendment to the General Plan to change the designation of approximately 4.6 acres located south and west of Otay Lakes Road and Allen School Lane, adjacent to Ella B. Allen Elementary School (as shown on attached plat), from Parks and Public Open Space to Low Density Residential (1-3 DU/Acre). 2. Findings of fact in support of said determination are as follows: ' r . ., . a. The City of Chula Vista did not find it expedient to acquire this property as a park site at the time the adjacent, property, under the same ownership was approved for development. b. The developer could not be deprived of the right of making suitable use of his property. c'. As the property is currently being subdivided, it is appropriate to change the General Plan designation to make it consistent with the • designation of adjacent areas and- with the existing R-E-P zor~~ng. 3. The Planning Commission recommends to the City Council that said amendment to the General Plan be adopted. 4. That this resolution be transmitted to the City Council.
