[ 10 ] CHULA VISTA CITY COUNCIL MEETING OF: November 12, 1974 ITEM TITLE: Resolution - Releasing Uncontrolled Embankment Agreement with Glenn H. and Clara E. Miller at 446-448 Fourth Ave. INITIATED BY: RAC'K(;R(IIiNTI Director of Public Works/City Engineer ~~ On April 6, 1971, the City Council, by Resolution #6018 approved an agreement for land development involving uncontrollable embankment for the property at 446-448 Fourth Avenue. One of the conditions of the agreement is that prior to the issuance of a building permit the property owner must provide a special soils analysis and foundation design, recommending methods to reconstruct the embankment and fill in a manner subject to approval by the City Engineer. On April 13, 1973 the City Engineer issued grading permit #73-6G for the property referred to in the subject agreement for land development in conjunction with the issuance of a building permit for the Chula Vista Medical Center owned by Chula Vista Group Properties. Grading work on the site has been completed in accordance with the conditions of the agreement, approved grading plan, and conditions of the grading permit. The agreement for land development involving uncontrollable embankment, which was approved by Council Resolution #6018 on April 6, 1971, may now be released. The subject agreement was recorded on April 13, 1971 in the office of the County Recorder as Recorder's File #72511. A transparency is available .for Council viewing. Upon approval of this resolution by the City Council, the City Clerk shall record a copy of the resolution with the County Recorder.
