RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VI5TA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND AMERICAN HOUSING GUILD FOR CITY PARTICIPATION
IN THE PUBLIC IMPROVEMENT OF EAST ORANGE AVENUE IN LARK-
HAVEN CHULA VISTA SUBDIVISIONS, UNITS NO. 1, 2 AND 3
AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that that certain agreement
between THE CITY OF CHULA VISTA, a municipal corporation, and AMERICAN
HOUSING GUILD-SAN DIEGO, for City participation in the public improve-
ment of East Orange Avenue in Larkhaven Chula Vista Subdivisions,
Units No. 1, 2 and 3
dated the 27th day of March , 19 73, a copy of
which is attached hereto and incorporated herein, the same as though
fully set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the sum of $7,500.00 be, and the
same is hereby authorized to be expended from Gas Tax 2107 Funds for
the purpose set forth hereinabove.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
agreement for and on behalf of the City of Chula Vista.

VIS~1'A, a municipal corporation, hereinafter called "City", and AML'RICAN
MOUSING GUILD-SAN DIEGO,a California corporation,3247 Mission Village
Drive, San Diego, California 92123, hereinafter called "Subdivider";
W I T N E S S E T H
WHEREAS, Subdivider has or is about to enter into an agree-
ment with the City of Chula Vista providing for the development of
public improvements in certain streets located within that certain sub-
division to be knoty~n as Larkhaven Chula Vista Units 1 - 3, and

WHEREAS, Subdivider is required, pursuant to established
policy to pave a 28 foot width right-of-way adjacent to each curb on
said street, and City accepts the obligation to pave the remaining
8 feet to construct the median island, and to provide lighting in
median island, and ,
WHEREAS, Subdivider entered into an agreement with the City
of Chula Vista on September 5, 1972 per Council Resolution 6587 to
improve those portions of Orange Avenue within Larkhaven Chula Vista
IInits 1 and 2 for which the City accepted responsibility, and
WHEREAS, i_t is generally accepted that it is desirable to
construct the City's portion of said major street concurrent with the
installation of improvements by the Subdivider, and that, because of
the ready availability of construction equipment and elimination of
certain work which is caused by stage construction, the work can be
performed more economically than if it were, to be accomplished separately,
and
WHEP.EAS, the following advantages would apply if the City of
Chula Vista were to participate in the complete improvement of said
major street known as East Orange Avenue rather than subsequently
improving said street with a competitive bidding procedure:
1. Subdivider will be performing identical work immediately
adjacent~to the portion to be paved by City, and consequently will have
all necessary equipment and personnel available without additional move-
in cost.
2. Subdivider can dispose of excavated material conveniently
within the adjacent lots under construction, whereas if the work were
accomplished following completion of the subdivision, it would be
necessary to haul such material to more remote disposal sites, result-
ing in higher costs. _
3. If the total pavement width is constructed as a unit,
Subdivider will not be required to install headers or give other. special
treatment to the exposed edges of pavement such as would be created
with an unpaved island, thus permitting an overall reduction in costs.
4. The integrity, riding quality and aesthetic appearance of
a street is superior ~ti~hen all portions are constructed as a single
project.

the Subdivider is in position to per:•f_oY•m the work at the lesser rate
and to pass some of_ said s<~vin.g on to City.
W13EREAS, it is agreed that the cost of said .center strip
will be the same as the unit prices for the subdivision improvement
work being perf.ormE~d, plus five percent (5~) of said work f:or overhead.
WHEREAS, although a pr_ec.ise structural section has not been
determined at this time, and no Cost estimate which is .reasonably
accurate has been developed, it is anticipated that the total cost of
the City's participation will be approximately $22,600.

parties hereto as folloc,~s
1. Subdi.v~der agrees to install such improvements, i.e.,
the completion of. an 18 foot wide center strip along East Orange Avenue
bei:ween Loma Lane and Station 34+84.74, as shown on Drawing r1os. 72-149D,
72-1GOD, 72-161D, 72-1b3D, 73-152D and 73-153D, which improvements include
approximately 8,815 square feet of paving, 2,341 lineal feet of curb and
gutter, 470 cubic yards of grading, and the installation of 11 double arm
street lights.
2. City agrees to pay Subdivider for said improvements, and
to participate in the installation of the full public improvemer~.t of
East Orange Avenue, in an estimated amount of $22,600 based upon the
following unit costs:
6" Type "G" curb and gutter: 2,341 L.F. $ 3.00 L.F.
3" Asphalt concrete on approved base: 8,815 S.F. 0.38 S.F.
Grading: 470 cubic yards 0.50 C.Y.
20,000 lumen double arm street lights: 11 each 1000.00 Ea.
3. Said proportionate share of the cost of said improvements
will be paid to Subdivider, American Housing Guild-San Diego, upon
completion and acceptance of said improvements by the City of Chula Vista.
4. City further agrees to make partial payments of the full
costs of said participation upon submission and verification of requests
for payment, accompanied by paid vouchers, provided, however, than ten
percent (10~) of the proposed participation costs shall be held for a
period of one (1) month subsequent to the completion and acceptance of
said improvements in accordance with the Subdivision Improvement Agree-
ment executed by and between Subdivider and City.
IN~WITNESS WHEREOF, the parties hereto have caused this
agreement to be executed the day and year first hereinabove set forth,,
