HomeMy WebLinkAboutReso 1973-6798Form No. 342 Rev. 9-71 RESOLUTION NO. 6798 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND AMERICAN HOUSING GUILD FOR PARTICIPATION IN THE PUBLIC IMPROVEMENTS OF EAST ORANGE AVENUE WITHIN AND ADJACENT TO LARKHAVEN CHULA VISTA UNIT 1 AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and AMERICAN HOUSING GUILD-SAN DIEGO, for participation in the public improvements of East Orange Avenue within and adjacent to Larkhaven Chula Vista Unit 1 dated the 27th day of March 19 73 , a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the sum of $5,800.00 be ,. and the same is hereby authorized to be expended from reserve Gas Tax 2107 Funds for the purpose set forth hereinabove. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. Buford, 143 'rL" Street, Chula Vista, California 92011, wherein Mr. Buford deposited sufficient monies far the future improvements in the north half of Orange Avenue lying ;•~ithi:: the subdivision boundary of Vista.Loma Verde Subdi- visian, accorciiilg to 1~,ap thereof I~7o. G7U5, recorded in the Office of tl~~e County Recorder of San Diego County. In addition, Mr. Buford deposited sufficient monies to pay for one-fourth of the cost of drainage facilities under East Orange Avenue in the vicinity of Station 9+20 as shown on Chula Vista Drawing No. 69-173D, and WHEREAS, the City is therefore obligated to pay for all paving on the north side of East Orar_ge Avenue from Loma Lane to Station 9+72-94 as shown on Chula Vista Drawing No. 72-149D, and WIiEREAS, it is generally accepted that it is desirable to construct the City's portion of improvements concurrent with the install- ation of improvements by the Subdivider, and that, because of the ready availability of construction equipment and elimination of certain work which is .caused by stage construction, the work can be performed more economically than if it were to be accomplished separately, and WHEREAS, the following advantages ~•~ould apply if the City of Chula Vista were to participate in the complete improv~mcnt of said major Street knOLJn as i:;as ~ Ur ar'it~ie Avenue rather than subsequently liitpraVi_ng said street with a competitive bidding procedure: 1. Subdivider will be performing identical work immediately adjacent to the portion to be paved by City, and consequently caill have all necessary equipment and personnel available without additional move- in cost. - 2. Subdivider can dispose of excavated materiel conveniently witlii.n the ad jaceni: lots under construction, whereas if the wor}: were accomplished folla~~~ing coml~lction of: tl:e subdivision, it would be necessary to haul such material to more remote disposal sites, resulting in Higher COStS. _1_ ~~~~~' 3. If the total pavement width is constructed as a unit, Subdivider will. not be required t.o instal~_ headers or give other special treatment to the exposed edges of pavement. such as 4aould be created with an unpaved island, thus permitting an ovei.•all r_educta_on in costs. 4. The integrity, ridin quality and aesthetic appearance of a street is superior when all portions are constructed as a sa.ngle project. 5. Unit prices applicable to la.r.cre projects are generally lower than those for smaller projects, therefore, in combining the drain- age facilities and paving with the improvements _n the remainder of the subdivision, the Subdivider is in position to perform the work at the lesser rate anti to pass sorle of said saving on to City. WHEREAS, it is agreed that the cost of said improvements will be the same as the unit prices for the subdivision improvement work. being performed, plus five percent (5°) of said work for overhead, and WHEREAS, although a precise pavement structural section has not been determined at this time, azid ne cosh estin~atc which is rcasonab7_y accurate has been developed, it is anticipated. that the total cost of the City's participation will be approximately $14,900. NOW, THEP.EFOF.E, IT IS MUTUALLY AGREED by and between the parties hereto as follows: 1. Subdivider agrees to install those street improvements between Loma Lane and Station 9+72.94 on the north half of East Orange Avenue as shown on Chula Vista Drawing ATo. 72-149D and those drainage improvements as shown on Chula Vista Drawing No. 72-147D. 2. City agrees to pay Subdivider fo.r said street improvements and for the following drainage improvements, based upon the following unit costs. Said proportionate share of the cost of said improvements will be paid to Subdivider, American Housing Guild-San Diego, upon completion and acceptance of said improvements by the City of Chula Vista. a. Street Improvements: 4" P.C.C. sidewalk: 468 square feet at 0.60/SF $ 281 6" Type " G" curb and gutter: 93.6 lineal feet at 3.00/LF 281 3" Thick AC paving, 2,860 square feet at 0.183/SF 523 6" Thick Class 2 aggregate base, 2,860 square feet at 0.16/SF 458 Sub-Total $ 1,543 b.
