RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING WITHDRAWAL OF TERRITORY
IN THE CITY OF CHULA VISTA FROM COUNTY
LIGHTING MAINTENANCE DISTRICTS AND AUTHORIZING
PROPERTY TAX EXCHANGE
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, San Diego County Lighting Maintenance Districts
1 and 3 are proposed to be dissolved, and
WHEREAS, the dissolution of said districts is not
required to be reviewed and approved by the Local Agency
Formation Commission, and
WHEREAS, the following local agencies have service
responsibilities that would be altered by the proposed change:
Chula Vista, National City, San Diego, Del Mar, San Marcos,
Escondido and the County of San Diego, and
WHEREAS, the Revenue and Taxation Code 99(c) requires
the acceptance, by resolution, of the negotiated exchange of
property tax revenues by all affected agencies, and
WHEREAS, the Board of Supervisors has negotiated with
the affected special districts and cities to determine an
equitable exchange of property tax revenues applicable to such
jurisdictional exchange.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby approval withdrawal of
territory in the City of Chula Vista from County Lighting
Maintenance Districts and authorize the negotiated exchange of
property tax revenues as follows:
1. Within all incorporated territory all property tax
revenues (both base and annual tax increment) shall
be transferred to each affected city within its own
jurisdictional boundary.
2. Within all unincorporated territory all property tax
revenues (both base and annual tax increment) shall
be transferred to the successor agency, San Diego
County Street Lighting District.

3. Subsequent annexation of properties to an
incorporated city shall result in detachment from the San Diego
County Street Lighting District and a transfer of property taxes
to the affected city pursuant to the Master Property Tax
Agreement adopted by the Board of Supervisors on
November 20, 1984 (17).
BE IT FURTHER RESOLVED that the City Clerk shall, on
behalf of the adopting agencies, notify the County Auditor of
such negotiated exchange of property tax revenues by forwarding
to them a copy of this resolution.
