RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA REVISING THE CHULA VI5TA GENERAL PLAN IN
ACCORDANCE WITH RECOMMENDATIONS OF THE PLANNING
COMMISSION OF THE CITY OF CHULA VISTA ADOPTED BY
RESOLUTION NO. PCM-73-1, ADOPTED ON THE 22nd DAY
OF JANUARY, 1973 CONCERNING APPROXIMATELY 4.57
ACRES NORTH OF ORANGE AVENUE, EAST OF MAX AVENUE
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Planning Commission has heretofore on
January 22, 1973 held a public hearing to consider revisions of
the Chula Vista General Plan in order to conform to the require-
ments of state law which make it mandatory that zoning ordinances
and General Plan designations become consistent, and
WHEREAS, said revisions are contained in Resolution No.
PCM-73-1, adopted by the Planning Commission on the 22nd day of
January, 1973, a copy of which is attached hereto and incorporated
herein by reference as if set forth in full and marked as Exhibit

NOW, THEREFORE, BE

WHEREAS, the City of Chula Vista has an adopted General Plan, anu
LJHEREAS, State law requires that zone designations of property conform
to the General Plan, and
WHEREAS, American Housing Guild has requested consideration of a change
in the General Plan to accornr,~odate a rezoning for those areas tentatively known
as Ueerpark Garden Apartments, and
WHEREAS, the Planning Commission set the tir~~e and place for a hearing to
consider revision of the General Plan, and notice of said hearing, together wlth
its purpose, was given by the publication in a newspaper of general circulation
in the City at least 10 days prior to the date of said hearing, and
4JHEREAS, a hearing was held at said time and place, namely 7:U0 p.m.,
January 22, 1973, in the Council Cisamber, Civic Center, before tine .Planning
Commission and said hearing was thereafter closed.
NOW TfiEREFORE BE IT RESULVEU AS FOLLOWS:
1. From facts presented to the Commission, the Commission finds that
public necessity, convenience and general welfare require the adoption of an
amendment to the General Plan to change from medium density residential (4-12
da~elling units per acre) to high density residential (13-26 dwelling units
per acre) for approxir~~ately 4.57 acres located nortf~ of Orange Avenue and
east of the proposed extension of Max Avenue, as shown on the attached .plat.
2. Fi r~d~i rrgs of fact i n support of sai d determi nati orr are as follows
a. The proposed change is in conformance witf~ General Plarl goals
which state that Nigher densities should be located at the more
ir~portant outlying commercial areas and the proposea change will
provide for appropriate mixing of housing types within the area.
b. Tire proposed change vrill not have significant impact on the
overall density for the area and ttre requirement for a precise
plan on tf~e rezoning application will insure development at tl~e
lower errd of the 13-26 density range.
c. Tf~e physical location of the property leaves it well buffered
from otf~er nearby residential land uses (250' wide SUG&E ease-
ment, major road, and shopping center).
3. The Planning Commission recommends to the City Council that said
amendment to the General Plan be adopted.
