RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING THE TENTATIVE MAP OF A SUBDIVISION TO
BE KNOWN AS SOUTH BAY VILLAS, PCS-74-5
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Planning Commission of the City of Chula Vista
has heretofore approved that certain tentative map of a subdivision to
be known as SOUTH BAY VILLAS and has recommended that the City Council
approve said tentative map subject to the conditions as recommended in
their letter dated the 28th day of October, 1974, a copy of which is
attached hereto and by this reference made a part hereof, the same as
though fully set forth herein.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that said Council does hereby approve said tenta-
tive subdivision map in accordance with the recommendations of the
Planning Commission of the City of Chula Vista; provided, however,
that the recommendations of the Planning Commission to the City Coun-
cil are hereby amended to include a provision that Lots C through I
are being reserved for future development and the disposition of said
lots shall be settled equitably prior to the recordation of the final
map .
BE IT FURTHER RESOLVED that Condition No. 8 of the Planning
Commission's recommendations be, and the same is hereby deleted from
this resolution.

Subject: Tentative Subdivision Map of South Bay Villas, PCS-74-5
On October 23, 1974 the City Planning Commission considered the tentative
subdivision map for South Bay Villas containing approximately 40 acres
located at the terminus of East J Street. The property is zoned R-1-H-P
and the proposed development includes 113 residential lots and 2 open space
lots totaling approximately 12.2 acres.
An Environmental Impact Report, EIR-74-9, for the proposed development of
the property was adopted by the Planning Commission on October 23, 1974.
The Planning Commission recommends approval of the tentative map subject to
the following conditions:
1. The developer shall acquire 80 feet of right of way for East "J" Street
from the easterly subdivision boundary of San Simeon Units 1 and 2 to the
northerly subdivision boundary of South Bay Villas. Right of way shall be
acquired through the City's eminent domain authority, at the request of the
subdivider who shall be responsible for all costs and fees associated with
such acquisition. The eminent domain proceeding shall include all of the
property lying south of East "J" Street abutting the subdivision boundary
and, at option of the developer, may include the "future development" area so
marked north of East "J" Street. Future development on either side of East
"J" Street lying outside the present city limit boundaries will require the
filing of a new tentative map, at which time all necessary conditions for
public improvements, landscaping, etc. will be required.
2. Improvements.
a. The developer shall fully improve East "J" Street within the limits
- of the subdivision boundary. Improvements shall include but not be
limited to pavement, curb, gutter and sidewalk, street lights and sewer.

b. The developer shall construct within the "J" Street offsite right of Nray,
a minimum of 28 feet of pavement with an 8 foot graded shoulder on each side
of the street. The developer may request an agreement between himself and
the City to provide reimbursement for a portion of the right of way cost,
said reimbursement to be paid by the owners of adjacent development. The
developer shall submit improvement plans for the offsite portion of East "J"
Street which lies within the County to the County Engineer for approval.
After the construction of the offsite improvements they shall be accepted by
the County into their maintained road system.
c. Within the permanent right of dvay of "F" Street the developer shall con-
struct a minimum of 28 feet of pavement, curb, gutter, sidewalk and street
lights on the Nest side of the street. For the temporary portion of "F"
Street the developer shall construct 28 feet of pavement, AC berm and a
5 foot wide AC sidewalk. The developer shall post a bond and enter into an
agreement to provide for the removal of the temporary improvements and
relocation of the sewer in "F" Street. Developer shall also post a bond and
enter into an agreement urith the City to guarantee the construction of his
proportionate share for the permanent improvements in the future extension
of "F" Street and East "J" Street. The City! Attorney's office shall exr~lore
the feasibility of accepting a portion of land in lieu of bonding for the
removal of the improvements.
d. The developer shall construct a pedestrian path (8 ft, wide) consisting
of decomposed granite surface or asphalt concrete in the location shown on
the tentative map. Stairs at each access point shall be provided to dis-
courage motor vehicles. Ho~vever, the entire path between lots 18 and 19 and
south of lot 13 shall be graded level for a distance of 100 feet to provide
emergency access. The path shall be posted at each access point, "No
Motorized Vehicles." The path and access between lots 1 and 2 shall be
eliminated.
e. A design for decorative fences shall be submitted with the improvement
plans for the following lots (as shown on the October 9, 1974 revision):
Corner lots 8*, 11*, 29*, 44, 57, 63, G4, 79, 108, 109*; such
decorative fencing shall be installed by the subdivider. The
fencing shall be located at the top of slope or the subdivider
shall design and construct the vaall as a retaining wall and the
lot shall be graded adjacent to such wall so that it corresponds
in grade to the pad.
*For lots 8, 11, 29 and 109, portions of fencing closer than h0 feet
to "J" Street shall be changed to masonry wralls for noise attenuation.
f. UJood fencing shall he provided boi the subdivider on the following lots
where sideyards are next to the path system:
Lots 10, 13, 18, 40. Access to the path shall be eliminated between

h. Fencing requirements for lots in "future development" shall be determined
at the time of submission of tentative maps.
3. Landscaping.
a. The usable open space areas south of lots 13, 19 and 40 shall be planted
in turf and irrigated tfaith a permanent automatic system.
b. Slope planting in lots A and B shall be done in accordance with the
Grading Ordinance #1455 and the City Landscape Polic;,~. Such planting shall
be served by a fulls automatic irrigation system. Plant materials used on
these slopes shall be "native" materials insofar as feasible, so that when
mature the ne~v plants shall blend with existing vegetation and minimize the
level of maintenance.
c. Existing viable stands of vegetation shall be preserved insofar as pos-
sible. In particular, the Snake Cholla Cactus plants shall be preserved b;;~
utilizing 12:1 slopes in lot B and, if necessar;>~~, transplanting the cactus
to lot A.
d. The subdivider shall be responsible for a period of one year from the
date of acceptance for the maintenance of all landscaping and irrigation.
At the end of the year the job will be reinspected, and if found to be
satisfactory, shall be turned over to the Open Space Paintenance District.
If not satisfactory, the one year responsibility of the subdivider may be
extended by approval of the Planning Commission.
4. Fire Protection.
a. Fireflow requirement shall be a minimum of 1000 GPM for two hours
duration based upon a minimum of 20 PSI residual operating pressure in the
street main from which the flow is measured at the time of measurement.
Note: Tn the event wood shingles are used as roof covering, the fireflow
requirement shall be increased an additional 500 GPCi to a total fireflow
of 1500 GPM.
b. Nine fire hydrants are required and shall be installed in accordance
with standard specifications of the City of Chula Vista and located as
follows:
(1) On East J Street at or near westerly property line of lot 113.
(2) On Street "D" at Street "C" on lot 108.
(3) On Street "A" at Street "C" on lot 63.
(4) On Street "A" at Crest Drive on lot 88.

(5) On Street "D" at Street "A" on lot 79.
(6) On Street "D" at or near southerly property line of lot 50.
(7) On East J at Street "D" on lot 29.
(8) On East J at temporary Street "F" at or near westerly property
line of lot 19.
(9) On Street "F" at or near southerly property line of lot 16.
(a) Access to, and protection of, fire hydrants shall be pro-
vided and maintained at all times in a manner subiect to
approval of Fire Department.
(b) Hydrants shall not be obstructed at any time.
(c) Type of hydrant shall have one 4" outlet and one 2%z"
outlet.
c. Water supplies for fire protection shall be installed in an operable
condition prior to any combustible construction material being placed on
the site.
d. All water systems shall be designed to permit circulating water flows
except where impractical because of cul-de-sacs and like conditions or the
incomplete development of the grid system.
e. Adequate access for fire apparatus shall be provided and maintained
to within 150 feet of any combustible construction material prior to and
after placement on the site.
f. Particular note is made concerning the indicated temporary paved
turnarounds, cul-de--sac with 35' radius and narro4v width of Street "F"
(28'). No parking should be permitted in the turnarounds, cul-de~sac
or Street "F".
g. Any other requirement as may be determined by need.
5. Prior to the approval of a final map the subdivider shall petition the
City to form an Open Space Maintenance District on lots A and B, consisting
of 12.2± acres. Preparation of the open space district map and assessment
diagram are the responsibility of the developer.
6. Letters from the school districts indicating that facilities will be avail-
able shall be submitted to the Planning Department prior to City Council con-
sideration of the tentative man.
7. The subdivider shall guarantee that access to the property owner to the east
(Bennett property) is kept open during grading and construction operations.
8. P~aximum lot coverage shall be increased from 40% to 50% for those lots less
-" than 7000 sq, ft. in size. All lots less than 7000 sq. ft. are identified on
the tentative map.
9. The disposition of lots "C" through "I" shall result in an equitable solution
for all parties concerned, settled to the City's satisfaction prior to recorda-
tion of the final map.

10. The subdivision boundary shall be tied to the Lambert Projection for Cali-
fornia Coordinate System, Zone 6, with a minimum of tvao points. A listing of
horizontal control monuments is on file in the office of the City Engineer.
11. The developer shall comply with all sections of the Chula Vista City Code
which apply and are in effect on the date the Cit~< Council approves the tenta-
tive map. Preparation of maps and plans shall be in accordance with the pro-
visions of the Subdivision Planual.
12. Required bonds, fees and charges:
Subdivision Bonds - Ordinance 1369 and amendments thereto.
Grading Bonds and Fees - Ordinance 1455.
Street Tree Deposits - Ordinance 1369.
Street Name Fees -Ordinance 1205.
Park Fees - Ordinance 1492.
School Fees -- Resolution 6140.
Telegraph Canyon Sewer Charges - Resolution 6157.
In recommending approval the Planning Commission discussed and agreed that the
City Council should give consideration to a reduction of the park fees based
upon the landscaping and irrigation system being placed on lots 13, 19 and 40,
together with the improvement of pedestrian access routes into the canyon. In
order for the staff to make a specific recommendation to the Council it will be
necessary for the developer to submit..cost.,~figures covering these improvements
to the Planning Dep t for evaluation prior to Council approval of the final
