The Chula Vista Police Department received a request from Chula Vista hotel and motel proprietors to consider foregoing the annual health inspection requirement if hotels and motels have not experienced health problems in previous years. City Code Enforcement staff, who review the health inspections submitted annually by hotels and motels, indicated that they would support such a request. No hotel or motel has failed its health inspection since the operators began contracting for these inspections in 2007. As a result, the Chula Vista Police Department recommends amending CVMC 5.39 to require hotel and motel health inspections every other yeaz, beginning in 2012. ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defined under Section 15378 of the state CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to the CEQA. Thus, no environmental review is necessary. ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHULA VISTA MUNICIPAL CODE SECTION 5.39.050(G) TO REQUIRE BIENNIAL HEALTH INSPECTIONS OF MOTELS WHEREAS, the Chula Vista Municipal Code requires hotels and motels to annually contract with an environmental health specialist to certify the facilities are in compliance with California Public Health requirements; and WHEREAS, Chula Vista hotel and motel proprietors have requested that the City forego the annual health inspection requirement if hotels and motels have not experienced health problems in previous years; and WHEREAS, no hotel or motel has failed its health inspection since the operators began contracting for these inspections in 2007; and WHEREAS, the Chula V ista Municipal Code needs to be amended to reflect this request; and WHEREAS, other than the amendment to Subsections G of Section 5.39.050, the remainder of Section 5.39.050 will remain the same. NOW, THEREFORE, the City Council of the City Of Chula Vista does, hereby, ordain as follows: SECTION I. That Chula Vista Municipal Code Section 5.39.050(G) be amended to read as follows: 5.39.050 -Permit to operate -Application required -Contents. G. Biennial~l inspection report (every other ti°ear. beainnin~ in 2012), on the form(s) provided by the City, by an environmental health specialist registered with the California Department of Health Services, certifying that the facility is in compliance with California public health requirements. SECTION II. EFFECTIVE DATE. This ordinance will take effect and be in force thirty days after final passage.
