HomeMy WebLinkAboutReso 1987-13201 RESOLUTION NO. 13201 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA REVISING THE MASTER FEE SCHEDULE The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Master Fee Schedule has not had a complete revision since November, 1982, and WHEREAS, after conducting a public hearing on August 18, 1987 to consider revisions to the Master Fee Schedule, the Council wishes to adopt the updated Master Fee Schedule, as set forth in Exhibit "A", attached hereto and incorporated herein by reference as if set forth in full, and WHEREAS, Government Code Section 65962 prohibits an increase in fees applicable to filing, accepting, reviewing, approving, or issuing of an application, permit, or entitlement to use in connection with a residential development, prior to sixty (60) days following final approval of such an increase, and WHEREAS, the data indicating the amount of cost, or estimated cost, required to provide the services for which the fees or service charges are being increased and the revenue sources therefor have been made available to the public for at least ten (10) days, pursuant to Government Code Section 54992. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby adopt the Master Fee Schedule attached hereto, and thereby amend the fees therein as set forth. BE IT FURTHER RESOLVED that such fees shall be effective immediately, except those which Government Code Section 65962 prohibits being increased (residential construction fees) until sixty (60) days following approval; the latter fees are finally approved and shall be effective on October 19, 1987. In this schedule, when either the phrase "a deposit to cover the City's full cost, including overhead," or "the fee shall be the City's full cost including overhead" appears, it shall be understood that: A. The department shall determine the appropriate deposit for each application and shall attempt to limit that deposit to a reasonable amount. If, at any time, it appears that the deposit amount will be insufficient to cover accumulated City costs, the applicant shall deposit additional amounts as required by the Department Head. B. If the City Determines that consultants are required to assist in the processing of any permit, the City reserves the right to retain and pay such consultants from fees collected from the applicant. C. Replacement of Lost Library Card ............................ $1.00 -4- 3.20.020 Sewer Service Charges In addition to other fees, assessments or charges provided by the City code or otherwise, the owner or occupant of any parcel of real property which said parcel is connected to the sewer system of the City and to a water system maintained by the Sweetwater Authority or the Otay Municipal Water District shall pay a sewer service charge as follows, applicable to the first whole billing period subsequent to July l, y~ 1987: A. Domestic: The domestic sewer service charge for each single family dwelling unit serviced by a separate water meter shall be ~l~ $8.70 per month; B. Domestic: A monthly sewer service charge for other parcels of real property used for domestic purposes as herein defined, and serviced by a water meter shall be at the rate of ~l~ $.70 per each one hundred cubic feet of water usage by such parcel, but in no case less than ~/~ $8.70 per month, nor more than ~1~ $8.70 per dwelling unit per mon't'~T~, C. Commercial and industrial: A monthly sewer service charge for premises used for other than domestic purposes shall be at the rate of $.70 per each one hundred cubic feet of water usage by such premises, but in no case shall be less than ~/~ $8.70 per month. 3.20.030 Sewer Service Variance Fees C. The owner or occupant of any premises requesting a variance from the sewer service charges pursuant to the provisions of this section and the rules and regulations approved by resolution of the City Council shall pay a fee in the sum of $80,00 to cover the cost of investigation of said request; provided, however, that no fee shall be charged for a request for total exemption from the sewer service charge. In addition, a special handling charge to cover the cost of billing and inspections to be paid per building may be established in the resolution granting the variance, provided that the minimum such charge shall be in the sum of $2.00. 3.22.010 Parks and Recreation Department Fees A. Fees for various Parks and Recreation Department programs and classes shall be as follows: 1. Recreational swimming .................................... $.75/person 2. Fees for the activity/class listed below shall be set so that they collect 75% of the City's full cost including overhead. Arts and Crafts 3.45.010 Returned Check Fee Any check returned for non-payment shall cause the issuer of said check to be subject to a $10 returned check fee. 5.02.190 Solicitors Identification Cards The fee authorized in Section 5.02.190 of the Municipal Code shall be ~1~/~ $15.00. The renewal fee shall be ~l~J~ $15.00. 5.15.010 Automobile for Hire - License Fee The fee authorized in Section 5.15.010 of the Municipal Code shall be $25 per quarter for each automobile for hire. 5.15.090 Automobile for Hire - Drivers - Licenses The fee authorized in Section 5.15.090.C of the Municipal Code shall be $15.00. 5.20.040 Card Room License Fee The fee authorized in Section 5.20.040 of the Municipal Code shall be $500.00, no part of which is refundable. 5.20.070, A Card Room Manager Work Permits The fee authorized in Section 5.20.070.A of the Municipal Code shall be $50.00. The renewal fee for the cardroom manager work permit shall be $20.00. -6- 5.20.070.B Card Room Employee Work Permit The fee authorized to be charged for cardroom employees in Section 5.20.70. B of the Municipal Code shall be ~l~ $30.00. The renewal fee for card room employee work permits as authorized i n Section 5.20.070B shall be $10.00. 5.38.030. A Pawnbroker License The application fee for a pawnbroker license as authorized in Section 5.38.030A of the Municipal Code shall be $80.00. 5.38.120 Pawnshop Employee ID Card The application fee for pawnshop employees as authorized in Section 5.38.120 of the Municipal Code shall be $20.00. 5.54.020 Taxicabs - Fee for Operating The fee authorized in Section 5.54.020 of the Municipal Code shall be ~l~l~ $125.00 per year for the operation of said business and an administr~ee of ~l~ $25,00 per year for each vehicle to be operated in Chula Vista. 6.12.040 Animal Impoundment - Fee and Charges The following fees and charges are hereby imposed for the impoundment and redemption, board, adoption and relinquishment of animals pursuant to Chapter 6.12 of the Municipal Code. A. For the picking up, transporting and impounding of any animal including a dog, by the use of equipment, personnel and regular facilities maintained by the City, the sum of ~l~l~ $20.00 for the first offense and ~ $30 for each subsequent offense shall be charged, and in addition, the sum ~'~"~ $__4per day for keeping such animal. B. For the sale of any dogs which are adopted as pets, the fee for such adoption shall be ~ll~ $5.00. C. For the relinquishmerit of dogs or cats by their owners, there shall be no charge provided the relinquishment is made at the animal shelter, if the owners are residents of the City; however, non-residents may use the services of the shelter by delivering the animal thereto and by paying a fee of ~}~ $10.00 for a dog ~A~//~/~/~b/r//~ or cat. Residents of the City who w~ relinquish an animal at their p"~ace of residence may do so by paying a fee of ~l~ ten dollars to have the animal picked up. All of the above fees shall be lawful charges against the owner or owners, or persons in charge of such animals, and the person or agency furnishing services or board to animals shall be entitled to a lien upon the animals for the payment thereof. -7- 6.20.030 Dog License Transfer Fee The license transfer fees authorized in Section 6.20.030. B, C, and E of the Municipal Code shall be ............................................. $2.00 6.20.040 Dog Licenses The dog license fees authorized by Section 6.20.040 of the Municipal Code shall be as follows: A. For license expiring three years from date of issue .................. $26.00 Any dog license issued pursuant to this section shall be issued for one-half the fees required hereinabove for any dog if the certificate or affidavit is presented from a licensed veterinarian that said dog has been spayed or neutered. 6.20.050 Penalty for Late Application or Payment The penalty authorized to be collected for late payment in Section 6.20.050 of the Municipal Code shall be ............................................... 51.50 6.20.060 Dog License Replacement Fee The dog license replacement fee authorized to be collected under Section 6.20.060.C of the Municipal Code shall be ................................ 51.00 10.60.020 Curb Loading Zone Permit Fee Applicants for a curb loading zone permit shall pay a fee of ~ $87 to cover the cost of investigation plus an initial installation fee of $61.00 for 75 lineal feet plus 51.00 for each additional lineal foot f~/~/~/~r~//~/N~/b/a~Xq/~/~ and an equivalent annual maintenance fee $~lL~. In addition, if it is necessary to remove an existing parking meter, the sum of 530 shall be charged to the applicant. 10.84.20 Front Yard Parking Permit Appeal Fee The cost of an appeal to the Plannin~ Commission and/or City Council under Section 10.84.20 shall be $25.00. 12.08.100 Street Overload/Transportation Permit The street overload/transportation permit fees as authorized in Section 12.08.100 of the Municipal Code are as follows: - 8 - 1. Single-move transportation permit ..................................... $5.00 2. Multiple load transportation permit for a period up to six months .... $25.00 3. Duplicate copies of continuing transportation permit, each ............ $1.00 4. Emergency move permit fees shall be double the single-move fee. 12.12.100 Temporary Encroachment Permit Fees A nonrefundable application of ~1~ $35 shall accompany each application for a temporary encroachment permit. If materials are placed in the street by the applicant prior to issuance of a temporary encroachment permit, the application fee shall be doubled. The payment of such double fee shall not relieve any person from fully conforming with the requirements of this chapter. Such double fee shall not be construed as a penalty, but shall be construed as an added fee required to defray the additional expense of investigation and enforcement by the City as a result of failure to comply with the provisions of this chapter. In the event that issuance of a temporary encroachment permit is refused, an previously deposited materials shall be removed as provided in Section 1 . 2.~10. 21 12.20.100 Construction Permits An administrative fee of ~ $65 shall be collected with each application for a permit to construct pu~'~'fc improvements. Additional fees shown in Section 12.28.060 of the Master Fee Schedule shall be collected as appropriate. 12.20.240 Driveways; Excessive Width, Fee for Installation and Fee for Appeal A. The fee to be collected under provisions of the Municipal Code Section 12.20.240.C shall be ~10~ $46.00. B. The fee to be collected under provisions of the Municipal Code Section 12.20.240.D shall be ~7~1~ $200.00. 12.24.060 Waiver of Public Improvements The fee for an application for a waiver of public improvements as referred to in Section 12.24.060 of the Municipal Code shall be l~l~ $284.00. 12.24,070 Deferral of Public Improvements The fee for a deferral of public improvements as referred to in Section 12.24,070 of the Municipal Code shall be ~l~ $234. 12.28,050 Encroachment Permit, Application Fee The application fee referred to in Section 12.28.050 of the Municipal Code shall be ~ $81 for those permits approved by the City Engineer and ~Y~ $220 for those approved by the City Council. -9- 12.20.100D Encroachment Permit and Construction Permit Fees and 12.28.060 The fees authorized to be collected under Sections 12.20.100D and 12.28.060 of the Municipal Code shall be as follows: (All figures shown are in dollars unless otherwise noted.) Regulatory signs, without pole, fee per sign ............................ $50 13.14.020 Sewerage Facility Participation Fee A. The owner or person makin9 application for a petit to develop or modify use of any residential, co~ercial, industrial or other property which is projected by the City Engineer to increase the volume of flow in the City sewer system by at least one-half of one e uivalent dwelling unit of flow shall pay, a 'sewerage facility particip~a~ion fee. The base charge is hereby established as $60b per equivalent dwelling unit of flow. B. One equivalent dwelling unit of flow is defined to be 265 gallons per day of sewa e generation. The fee fo'r property involving a modification in use shaV1 reflect only the increase in sewage generation projected from that property. Th'e flow rate for property involving a modification in land use shall reflect only the increase in sewage generation project from that property wh"ich exceeds .50 equivalent dwelling units of flow. 13.16.020 Sewer Connection Charges The sewer connection charges as authorized in Section 13.16.020 of the Municipal Code are as follows: A. An Administrative fee of $~1}~ $17.00; B. For construction of a four-inch diameter lateral in a street or alley containing a single sewer main intended to serve abutting properties on both sides, $~7}~ $884.00 plus ~7~ $24.00 per foot of chargeable length in excess o"f"~ 35 feet. Charge"~'~Te length in this case shall be one-half of the ultimatTdedicated street or alley width in feet except as noted in subsection D; C. For construction of a four-inch diameter lateral in the street or alley containing two sewer mains, each intended to serve abutting properties on only one side, ~7}~ $884.00 plus $~}7~ $24.00 per foot of chargeable length in excess~ 35 feet. Char~ length in this case shall be the recorded distance from the serving sewer to the ultimate street or alley right-of-way line except as noted in subsection D; -12- D. In those cases where the sewer lateral is to be installed at an angle of more than fifteen degrees from perpendicular to the roadway centerline, the chargeable length determined per subsections B and C shall be increased by the actual extra length required because of such skew; E. For six-inch diameter laterals, $3.00 per foot of chargeable lateral length as determined per subsections B, C and D shall be charged in addition to the fee for installation of a four-inch diameter lateral; F. For the connection of laterals of any size to a trunk sewer ten inches or more in diameter an additional amount of $36.00 for extra work required to make such a connection shall be added to the charges listed in subsections B, C and E. G. For the placement of a tap in a sewer located in an easement, the fee shall be ~l~ $180.00. 13.16.170 Sewer Connection Charges The fee authorized to be charged by Section 13.16.170.A of the Municipal Code shall be as follows: A. Minimum front footage charge: The payment of $16.00 per front foot of the lot or parcel sought to be connected shall be required, but such front foot charge shall not be imposed upon a person who constructed or paid for the construction of the sewer line into which he seeks to connect; or B. (Refer to Municipal Code.) 13.20.100 Cesspool or Septic Tank Discharge Fee For a permit to discharge the contents of a cesspool or septic tank into a City sewer, the fee shall be $10.00. 13.20.110 Sewer disconnection Fee For a permit to disconnect a building from a house sewer, the fee shall be $10.00. 13.20.120 Additional Inspection Fee The fees required by Chapter 13.20 of the Municipal Code shall include the fee for one inspection of the work for which the permit was issued. For every additional inspection of such work that may be necessary, whether specifically asked for by the holder of the permit or not, a fee of ~7~1~ $20.00 shall be charged. 13.20.130 Penalty for Commencement of Work Without Permit Any person who shall commence any sewer construction or any work in connection with any sewer or cesspool or septic tank for which a permit is required without first obtaining a permit therefor, shall, if subsequently allowed to take out such permit, pay double the fee provided therefor. -13- 13.56.050 Watercourse Permit The fee for a Watercourse Permit as authorized in Section 13.56.050 of the Municipal Code shall be the same as that authorized for the Grading Permit under Sections 15.04,290 and 15.04.295 of the Municipal Code. 15.04.295 Grading Permit Fee Schedule The fees authorized to be collected under Chapter 15.04 of the Municipal code and specifically under Sections 15.04.290 and 15.04.295 shall be a deposit to cover the City's full cost including overhead. Prior to release of bonds the deposit shall be adjusted to cover the full cost to the City including overhead for processing, plan check, inspection and any soils or geologic reports by City In addition, in situations similar to those listed under the subsection titled "Other Inspection and Fees" of Section 15.08.070, the fee shall be the same. 15.20.040 Housing Permit Fees The fee for a housing permit as authorized by Section 15.20.040 of the Municipal Code shall be as follows: A. For each apartment house, lodging house, boarding house, group residence, hotel and motel containing not more than six (6) units, ~/7~ $62.60. B. For each apartment house, lodging house, boarding house, group residence, hotel and motel containing not less than seven {7) units but not more than ten (10) units, $~ll)~ $85.30. C. For failure to pay a housing permit fee on or before the delinquency date, the penalty shall be computed on the same basis as the penalty to be paid for failure to pay a business license fee on or before the delinquency date as outlined in Section 5.04.080 of the Municipal Code. 15.24.160 Electrical Permit Fees Fees for processing and inspecting electrical permits shall be as follows: A. For installation, alteration or repair of water piping and/or water treating equipment ~1~ 3.50 L. For repair or alteration of drainage or vent piping M. For each lawn sprinkler system on any one meter, including backflow protection devices therefor )/2~ 3.50 N. For vacuum breakers of backflow protective devices on tanks, vats, etc. or for installation on unprotected plumbin fixtures including necessary water piping - one ~1) to four (4) )/~ 3.50 O. Five (5) or more, each P. In addition, in situations similar to those listed under the subsection titled "Other Inspection and Fees" of Section 15.08.070, the fee shall be the same. 15.32.040 Deferral of Undergrounding Utilities 14.32.070 The fee for Deferral of Undergrounding of Utilities as referred to in Sections 15.32.040 and 15.32.070 of the Municipal Code shall be ~7/~0 $556.00. 15.51.020 Traffic Signal Participation Fee The fee authorized to be collected under Section 15.51,020 of the Municipal Code and contained in the policy adopted by the City Council by Resolution 9221 and amended by Council action on February 17, 1981 is $8.00 per one way trip per day. - 21 - 17.02.010 Environmental Review Processes The City Council, by Resolution No. 10175 has outlined procedures to be followed to ensure compliance with State and local environmental processes. By Resolution 10176 and as may be amended by subsequent resolutions, the City Council has added the following fees for environmental review of projects: 1. A request to initiate the preparation of an EIR and candidate CEQA findings shall be accompanied by a deposit to cover the City's full cost including overhead. 2. Prior to the signing of an agreement for the preparation of an EIR and CEQA finding, the project proponent shall deposit with the Department of Finance the amount necessary to reimburse the City hired consultant. Mobile homes ....................................................... $75/unit 18.24.050 Adjustment Plat Examination Fee The adjustment plat examination fee as authorized in Section 18.24.050 of the Municipal Code shall be ~1~ $231 per plat resulting in adjustment of property lines and; ~7~ $148 per plat resulting in consolidation of two or more parcels. 18.28.010 Deposits for Street Trees - Required - Amounts - Deposition - Labor Costs The deposit for street trees as authorized by Section 18.28.010.A of the Municipal Code shall be as follows: 1. For all interior lots having less than 75 feet of street frontage, $110 per lot; 2. For all other interior lots, $216 per lot; 3. For all corner lots whose street frontage is less than 175 feet, $216 per lot; 4. For all corner lots whose street frontage is 175 feet or more, $430 per lot. - 23 - 18.28.020 Preliminary Parcel Map Fee Prior to the submission of a preliminary parcel map to the City Engineer for processing, the property owner shall submit a deposit to cover the City's full cost including overheads. Should the map be withdrawn at any time the deposit shall be adjusted to cover the City's actual costs including overhead up to that time. Said deposit shall not include checking ~f any requi red improvement plans or inspection of improvements. Fee for plan review and inspection of public improvements for parcel maps shall be computed pursuant to Section 12.28.060 contained in the master fee schedule. 18.28.030 Tentative Map Fee Prior to the submission of a tentative map to the Planning Department for processing, the property owner or subdivider shall deposit with the City the amount to cover the City's full cost including overhead, incurred in conjunction with review and processing of said map. Any required adjustment shall be made prior to City Council consideration of the Tentative Map. 18.28.040 Final Map and Improvement Plan Fee Prior to the submission of a final map and improvement plans or any portion thereof to the Planning Department and/or the City Engineer for processing, the property owner or subdivider shall submit a deposit to cover the City's full cost including overhead incurred in conjunction with review and processing of said map and plans. Any required adjustment shall be made prior to City Council consideration of the Final Map. 18.28.050 Public Works Inspection - Computation of Fee Following Council approval of the final map but prior to the recordation of said map, the property owner or subdivider shall submit a deposit to cover the City's full cost of inspection, and administration during the construction phase of the project, including plan revisions and any special investigations including soils and geology reviews and City consultants. The deposit shall be adjusted to cover the City's full cost, including overhead prior to acceptance of improvements and/or release of bonds. 18.28.060 Subdivisions - Schedule of Fees - Exemptions and Additions A. On-site improvements within the public right-of-way, as well as off-site improvements within the public rights-of-way immediately adjacent to the subdivision boundary shall be considered as included within the fee schedule. However, review of plans and inspections required of extensive offsite improvements shall be paid as a separate and additional fee. Such fee shall be in accordance with the schedule set forth in Section 12.28.060 as contained in the Master Fee Schedule. B. Where grading and/or slope planting is to be accomplished under the subdivision agreement, a separate and additional fee for such items only shall be collected in accordance with Sections 15.04.290 and 15.04.295 of the Chula Vista Municipal Code. - 24 - 18.28.080 Recordation Fee Upon the filing of the final map with the City Council, the property owner or subdivider shall deposit with the City Clerk a sum sufficient to cover the cost of recording the map. Upon recordation of the final map, the property owner or subdivider shall submit to the City Engineer one duplicate mylar print of the recorded final map together with eight blue-line prints of the recorded final map. 18.28.090 Public Works Inspection - Additional Payments Required In addition to other fees contained in the Master Fee Schedule relative to Public Works inspections, subdivider or contractor shall pay to the City, prior to the acceptance of public improvements in any subdivision or street right-of-way or easement for public purposes, the sum of 2.5 times the inspector's hourly rate of pay (not includin9 frin9e benefits) per hour for those Public Works inspections undertaken outside of regular working hours on Saturdays, Sundays and legal holidays during the course of construction of any public improvements. 19.06.010 General Plan Amendment - Fee for The fee for processing General Plan amendment applications shall be a deposit to cover the City's full cost including overhead. 19.07.010 Specific Plan Development Proposal A. The fee for modification to an adopted specific plan development proposal shall be ~Y~l a deposit to cover the City's full cost includin.~ overhead. 19.07.010 Specific Plan Amendment The fee for processing specific plan amendments shall be a deposit to cover the City's full cost including overhead. 19.08.030 Violations (subsequent applications) The fee required for violations (subsequent applications) of this title shall be double the amount that would normally be required. Such double fee shall not be construed as a penalty, but shall be construed as an added fee required to defray the additional expense of investigation and enforcement by the City as a result of failure to comply with the provisions of this title. - 25 - 19.12.030 Rezoning - Application Required - Filing Fee Applications for any change in zone boundaries, classification or reclassification of zones made by one or more owners or parties of interest in the property within the area to be affected by the proposed action shall be filed with the Director of Planning, accompanied by such data and information which would insure a full presentation of the facts and circumstances to justify the reasonableness of the proposed action. Said application shall be in a form as approved by the Planning Commission and shall be affirmed by the applicant. Each application shall be accompanied by a deposit to cover the City's full cost including overhead. 19.14.030 Variance or Conditional Use Permit - Zoning Administrator; Fee for F. The application shall be accompanied by a deposit to cover the City's full cost including overhead. The Director of Planning shall cause the matter to be set for hearing in the same manner as required for setting zoning matters for hearing. The Director of Planning or the Planning Commission shall have the discretion to include in the notice of the hearing on such application notice that the Planning Commission will consider classification of other than that for which application is made and/or additional properties and/or uses.
