CALL TO ORDER Meeting called to order at 6:12 p.m. Council Chambers City Hall -Building 100 276 Fourth Avenue 1. Roll Call: Present: Chair Liken; Commissioners Caudillo, Cochrane, Gove, Moriarty, and Navarro Absent: Commissioner Fuentes Staff present: Sr. Civil Engineer Muna Cuthbert; Associate Engineer Ben Herrera; Officer Justin Zualet; and Florence Picardal, Recording Secretary 2. Pledge of Allegiance 3. Opening Statement Opening statement read by Chair Liken. 4. Approval of Minutes: January 5, 2011 MSC (Gove/Navarro) to approve the minutes of January 5, 2011 as submitted. (5-0-1-1, Moriarty abstain/Fuentes absent) 5. Oral Communications David Leaf, Chula Vista resident, requested lower speed limit eastbound on Anita Street between Third and Fourth. Chair Liken referred this item to staff. MEETING AGENDA ITEM 7 was taken out of order. 7. Resolution of the Safety Commission of the City of Chula Vista Recommending that the Chula Vista City Council prohibit on-street parking along the frontage of 1655 Broadway (Sommerset Plaza East} and 1660 Broadway (Sommerset Plaza West) On April 19, 2011, the Parkstone Property Management of 1655 Broadway (Sommerset Plaza East) and 1660 Broadway (Sommerset Plaza West) Commercial Centers, on behalf of their tenants requested the removal of on-street parking along the properties frontage. The existing parking is located on both sides of Broadway between Anita Street and Main Street. Sr. Civil Engineer gave a short presentation. Staff Recommendation: That the Safety Commission recommend that the City Council prohibit on-street parking along 1655 Broadway (Sommerset Plaza East) and 1660 Broadway (Sommerset Plaza West). Commission Discussion: Questions regarding the parking were asked by Chair Liken, Commissioners Gove and Navarro. The Property Manager for Sommerset Plaza, Reina, clarified this has been an ongoing problem. The commercial vehicles are there at various times, but the number one is the safety of pulling in and out of the commercial center. Safety Commission Minutes June 1.2011 Paae 2 Public hearing opened. The following person spoke in favor of staff recommendation. 1. David Leaf, Chula Vista resident Public hearing closed. Commissioner Moriarty agreed with the resident's comments about also looking at the problems on Silva Street. Commissioner Cochrane asked about the City ordinance of not living in vehicles. Officer Zualet responded that the Police Dept. targets these vehicles, but for the entire city, not just this area. Resolution of the Safety Commission of the City of Chula Vista recommending that the Chula Vista City Council establish a 50 mph speed limit on Hunte Parkway between Olympic Parkwav and Eastlake Parkwav, and that Schedule X of the register maintained in the Office of the City Engineer be revised to include this established speed limit Based on the provisions of California Vehicle Code (CVC) Section 22357 and 22358 and pursuant to authority under Chula Vista Municipal Code {CVMC) Section 10.48.020, the City Engineer has determined that a 50 mph speed limit be established on Hunte Parkway between Olympic Parkway and Eastlake Parkway. Staff Recommendation: That the Safety Commission concur with staff and recommend the Chula Vista City Council establish a 50 mph speed limit on Hunte Parkway between Olympic Parkway and Eastlake Parkway, and that Schedule X of the register maintained in the Office of the City Engineer be revised to include this established speed limit.. Commissioner Caudillo left dais and returned at 6:52 p.m. MSC (Liken/Cochrane) to recommend the Chula Vista City Council establish a 50 mph speed limit on Hunte Parkway between Olympic Parkway and Eastlake Parkway, and that Schedule X of the register maintained in the Office of the City Engineer be revised to include this established speed limit. Resolution of the Safety Commission supporting the submittal of federal grant applications for Safe Routes to School Fundina Cycle 3 to improve pedestrian and bicycle facilities at various eligible locations Section 1404 of Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), authorized the Federal Safe Routes to School (SRTS) Program in August 2005. The U.S. Congress authorized afive-year federal funding for the program. This Resolution supports the filing of grant applications for four projects under Cycle 3 of the Federal Safe Routes to School Program. City staff will schedule this matter to the City Council for their approval of the grant application submittals. Staff Recommendation: That the Safety Commission accept staff's report and recommend that Council support the submittal of federal grant applications for Safe Routes to School Funding Cycle 3 to improve pedestrian and bicycle facilities at various eligible locations. (6-0-1, Fuentes absent) Safety Commission Minutes June 1, 2011 Page 3 9. Bikeways Program -Update Associate Engineer Herrera gave a short presentation. He stated as part of the Bikeway Master Plan, an important gap will be constructed on East H Street between Buena Vista and Otay Lakes Road. There are missing bike lanes between Bonita High School and Auburn Avenue. Once these two corridors are completed, you will be able to ride a bike on East H Street from I-805 to the eastern city limits. Ultimately, the street would be widened and would create a better path for pedestrians and cyclists to navigate through this part of town. Commissioner Cochrane asked what will be done about the trash cans on the sidewalk on East H Street. Sr. Civil Engineer Cuthbert stated it will be brought to the attention of the collection service. 10. Pedestrian Safety Program and CIP -Update Sr. Civil Engineer Cuthbert presented the updates. 11. Traffic Accident Summary for February, March, and April of 2011 Traffic accident summaries were accepted into record. OTHER BUSINESS 12. Election of Chair and Vice Chair Commissioner Liken was nominated by Cochrane and seconded by Moriarty. Commissioner Liken regretfully did not accept the nomination. Commissioner Liken stated we would go down the dais and ask if each member has a nomination. If there is more than one, we will go to a ballot system. Commissioner Cochrane nominated Commissioner Moriarty. She did not accept the nomination. Commissioner Navarro nominated Commissioner Cochrane. He did not accept the nomination. Commissioner Liken nominated Commissioner Caudillo and seconded by Gove. He did not accept the nomination. Commissioner Liken stated we will table this item for the next meeting. There is one member absent tonight and that member may accept a nomination. Commissioner Caudillo nominated Commissioner Navarro. He did not accept the nomination. 13. Commissioner Comments Commissioner Moriarty stated the reason nominations were not being accepted was that the Commission does not feel valued by City Council and feels that important issues that are safety and traffic related are not coming to the Commission. She felt the Commission was rubber stamping items. She stated she was not speaking for everyone, but for herself. She felt what the Commission is doing now is not purposeful. Commissioner Navarro stated he would like to see the Commission deal with general public safety matters in addition to traffic safety matters. Commissioner Cochrane agreed with Commissioner Moriarty's comments. He felt the Commission is more of a rubber stamp. He felt that issues that are brought up by the Commission are not given any importance. He has been very disappointed and feels that the Commission doesn't seem to hold the same weight as far as safety importance. He has given some serious consideration to resigning from the Commission. He feels the Commission is not doing the job they used to do. Safety Commission Minutes June 1 2011 Page 4 Commissioner Gove stated the City has a Public Safety Subcommittee and thought that they have taken over a lot of what the Safety Commission has done in the past. She agreed with the statements of the other Commissioners. Commissioner Caudillo's comments were inaudible (microphone off). Commissioner Navarro stated the Commissioners have a lot of expertise in public safety matters. This needs to be brought to the attention of the Mayor/City Council. If other safety issues were addressed with this Commission with the support of Police and Fire there would be more public interest. Sr. Civil Engineer Cuthbert stated the Commissioners were valued and she would. bring these concerns to the City Clerk and management. She stated this Commission was very important to the City. She mentioned the Boards/Commission recognition event was on June 6'h and it may be a good avenue for the Commissioners to voice their concerns. Commissioner Gove stated that with some Commissioners expressing their desire to resign, maybe all the Commissioners should resign and perhaps someone would listen. She agreed with Ms. Cuthbert about attendance at the recognition event. Chair Liken wanted to give some background information. He commented that at one of the Council budget meetings, he approached Councilmember Ramirez and asked about the Public Safety Subcommittee. He commented he would like to meet with them to find out what the Public Safety Subcommittee does. Chair Liken thought that the Subcommittee started up due to the need to talk about meet and confer items. At the Mayor's breakfast, he asked the City Clerk about the recommendation to change the Safety Commission charter. The recommended change is "Traffic Safety Commission". The City Clerk stated that the change has gone through and it was waiting for ratification from the Council. He stated he adamantly opposed the change. He once again asked if he could meet with the Public Safety Subcommittee. He remembers when the Commissioners felt that they were doing something for the community and that is lacking now. He doesn't feel he has the will, energy, or desire to put his time and efforts into what he feels this position requires. He thanked Commissioner Moriarty for being the first to bring up the Commission's dissatisfaction. He commented that more items used to be brought to the Commission and was unsure what has changed over the years. Sr. Civil Engineer Cuthbert stated there have not been as many requests as in year's past. She has worked for the City for over 25 years and she sees the difference. Chair Liken stated he served on the Growth Management Oversight Commission (GMOC), but resigned because he felt it was not for him. Commissioner Caudillo's comments were inaudible. Commissioner Cochrane stated the Commission should be looking at all safety issues. He has brought up various safety issues: bike lanes that are not kept clear, pedestrian safety on sidewalks, and no enforcement on illegal signs. Sr. Civil Engineer Cuthbert stated any issues that are brought to staff's attention are forwarded and followed up with the appropriate departments. Safety Commission Minutes June 1, 2011 Page 5 14. Oral Communications Alex Napoles, Chula Vista resident, requested assistance with intersection of Olympic Parkway/East Palomar. He stated recently there was a major accident and was concerned with safety. This item was referred to staff. MEETING AGENDA 6. Resolution of the Safety Commission of the City of Chula Vista recommending that the Chula Vista City Council establish a 40 mph speed limit on Mount Miguel Road between Proctor Valley RoadlEast `H' Street and SR-125 and that Schedule X of the register maintained in the Office of the City Engineer be revised to include this established speed limit Based on the provisions of California Vehicle Code (CVC) Section 22357 and 22358 and pursuant to authority under Chula Vista Municipal Code (CVMC) Section 10.48.020, the City Engineer has determined that a 40 mph speed limit be established on Mount Miguel Road between Proctor Valley Road/East 'H' Street and SR-125. Resolution of the Safety Commission of the City of Chula Vista recommending the City Council increase the existing speed limit on Heritage Road between Telegraph Canyon Road and Olympic Parkway from 40 mph to 45 mph, and that Schedule X of the register maintained in the Office of the City Engineer be revised to include this revised speed limit Staff completed an Engineering and Traffic survey for a segment of Heritage Road in accordance with the California Vehicle Code which mandates that a speed survey be completed and updated every seven years for each street with a posted speed limit within the City. Based on the results of this speed survey, staff has determined that the speed limit on Heritage Road between Telegraph Canyon Road and Olympic Parkway should be increased from 40 mph to 45 mph. Sr. Civil Engineer Cuthbert gave a short presentation. Resolution of the Safetv Commission of the City of Chula Vista recommending that the Chula Vista City Council establish a 45 mph speed limit on La Media Road between Olympic Parkway and Birch Road/State Street and that Schedule X of the register maintained in the Office of the City Engineer be revised to include this established speed limit Based on the provisions of California Vehicle Code (CVC) Section 22357 and 22358 and pursuant to authority under Chula Vista Municipal Code (CVMC) Section 10.48.020, the City Engineer has determined that a 45 mph speed limit be established on La Media Road between Olympic Parkway and Birch Road/State Street. Sr. Civil Engineer Cuthbert gave a short presentation. Due to lack of staffing resources, this item was brought forward because a pavement overlay project will be starting in the near future. It was not brought forward because of a citizen request/complaint. Staff Recommendation: Safety Commission concurwith staff and recommend the City Council establish a 45 mph speed limit on La Media Road between Olympic Parkway and Birch Road/State Street, and that Schedule X of the register maintained in the Office of the City Engineer be revised to include this established speed limit. Commissioner Comments Chair Liken stated that he, Commissioner Gove, and Principal Civil Engineer Rivera met with the Mayor to discuss the Traffic Safety Commission. Chair Liken was concerned about the Commission not seeing as many items as in year's past. The Mayor responded that the state of the economy and the slowdown of construction are contributing factors to the decrease in Commission items. Chair Liken was not in agreement. Back in 2006, the Commission voted to change the name to Traffic Safety Commission. He stated that in his meeting with the City Clerk approx. a year ago, the City Clerk stated there was a future item going to Council that would formalize the name change. Copies of the July 13, 2006 minutes, Ordinance 3111 and Council Policy 110-09 were placed on the dais for the Commissioners. Discussion ensued amongst staff and Commissioners on the Commission name and scope of duties. Secretary Picardal clarified that the marked up copy of Chapter 2.44 Safety Commission was ONLY a working copy that was used during discussion of the item at the July 13, 2006 meeting. This was NOT the language that was going forward to Council at this time. The members in attendance at the July 13 meeting were: Mark Perrett (Chair}, Majed AI-Ghafry (Vice Chair}, Carol Gove, Jose Lopez, Angel Rosario, Bob White and John Willett. On July 13, 2006, the Safety Commission voted 6-0-1 (White against) to change the name from Safety Commission to Traffic Safety Commission. Ordinance 3111 (includes Traffic Safety Commission language} was approved by Council on April 1, 2008. Ms. Picardal stated the City Clerk has tentatively scheduled the Ordinance to be docketed for September 27, 2011. Commissioner Moriarty asked that a copy of the proposed ordinance be forwarded to them for review. Commissioner Fuentes asked that staff maintain communications with City Council/City Clerk to ensure that the current Commissioners have the opportunity to comment on the proposed ordinance. Sr. Civil Engineer Cuthbert pulled up the current Section 2.44 from the Municipal Code and the revisions thatwere on the marked up copyfrom July 13, 2006 were NOT included in the current language. Commissioner Caudillo asked if staff heard back from the City Attorney's office on a question he asked at the March 2, 2011 meeting regarding City's liability on raising speed limits on H Street and Orange Avenue. Staff responded they have not heard back from the City Attorney's office, but would follow up on the request. Commissioner Fuentes stated he watched the video of the City Council meeting which docketed the items for H Street and Orange Avenue. He stated the Commissioner's comments were considered, but Council Safety Commission Minutes September 7, 2011 Page 4 made a final decision and asked staff to come back to Council with afollow-up. He asked staff to also bring that follow up to the Safety Commission. Commissioner Moriarty stated that there were several important issues brought up and asked that a meeting be scheduled for next month. 14. Staff Comments Principal Civil Engineer Rivera stated on East H Street by Blue Falls just west of the signal, staff marked out where the lane lines will shift. He suggested Commissioners drive by that location to get a sense of what is proposed for the street widening. ADJOURNMENT AT 7:26 P.M. to the next scheduled meeting of October 5, 2011. C. ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CULA VISTA MUNICIPAL CODE CHAPTER 2.25, GENERAL RULES FOR BOARDS ND COMMISSIONS (FIRST READING) Suggested staff referrals: 1. Report by Feb. 2012 on feasibility and cost of establishing Community Planning Committees as provided for by chapter 2.48 of the Municipal code. 2. Report on the pros and cons of reactivating the dormant Economic Development Commission. 3. Report on the pros and cons of combining/consolidating duties of some of the Boards and Commissions (e.g., possibly RCC and HPC; possibly Youth Action Council and Commission on Aging). 4.
