Home My WebLink AboutReso 1975-7598RESOLtTION NO. 7598 RESOLUTION OF THE CITY COUPICIL OF THE CITY OF CHULA VISTA REVISING THE CHULA VISTA SANITARY SERVICE COLLECTION RATES AND ESTABLISHING A NEW SCHEDULE The City Council of the City of Chula Vista does here resolve as follows: WHEREAS, pursuant to Section 2(b) of that certain amen agreement with the Chula Vista Sanitary Service, dated April 6, approved by Resolution No. 6015, adopted by the City Council of City of Chula Vista on April 6, 1971, it is mutually agreed tha~ City Council of the City of Chula Vista shall have the authority duty from time to time during the term of this amended contract review, act, establish and modify the rates and charges the Con may charge or collect from either single family residential, mu family residential, commercial or industrial users. The City C~ shall have the authority to fix just, reasonable and sufficient and charges when the Council, after a public hearing upon consi~ tion of all testimony submitted, finds from the evidence submit that the rates existing at the time of said public hearing are insufficient, excessive, unjust, unreasonable, discriminatory, ferential, or substantially at variance from those rates for sa services being performed in other communities in San Diego Coun and 1971, the the and to ractor tiple uncil rates era- ither re- DJHEF.EAS, in accordance with Resolution No. 7571, the ity Council Yias heretofore held a public hearing on Tuesday, Januar 14, 1975, at the hour of 7:30 p.m. in the Council Chambers of the C ty Hall of the City of Chula Vista to hear testimony regarding the rate schedule charged by said Contractor for the collection and disp sal of garbage, trash, rubbish and disposable material, and ~ WHEREAS, after hearing all such testimony and conside ing said testimony, the City Council finds from the evidence submit ed that the rates existing at the time of the public hearing are i - sufficient and substantially at variance from those rates for s id services being performed in other communities in San Diego Coun y, and ~~ L~7HEREAS, based upon said evidence, the City Council h s determined that said rate schedule should be increased as set f rth in Exhibit "A", attached hereto and incorporated herein by refe ence as if set forth in full. NOW, THEREFORE, BE IT RESOLVED that the City Council f the City of Chula Vista does hereby establish the rate schedule as et forth in Exhibit "A". BE IT FURTHER RESOLVED that said rate schedule shall ~e in effect from and after February 1, 1975. BE IT FURTHER RESOLVED that the Chula Vista Sanitary er- vice is directed to prepare for City review an audited statement of the business operations of said company based upon the newly ad pted rate schedule on or before December 15 of each year.
