RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND RALPH PAXTON, ASSIGNOR, DONALD RHODES AND
CHARLES C. LANE, ASSIGNEES FOR ASSIGNMENT OF POLICE
TOWING SERVICES
AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT

resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that that certain agre
between THE CITY OF CI-iULA VISTA, a municipal corporation, and
Ralph Paxton, Jr., Assignor, Donald Rhodes and Charles C. Lane,
for assignment of Police Towing Services

fully set forth herein be, and the same is hereby approved.

THIS AGREEMENT, made and entered into this 17th day f
December , 1974, by and between THE CITY F
CHULA VISTA, ereina ter re erred to as "CITY", RALPH PAXTON, J .,
hereinafter referred to as "ASSIGNOR", and DONALD RHODES and
CHARLES C. LANE, hereinafter referred to as "ASSIGNEES";
W I T N E S S E T H
WHEREAS, Assignor and Assignees have agreed between t en
selves to assign and convey the business known as Paxton's Towi g
Service and
WHEREAS, pursuant to an agreement entered into betwee
Ralph Paxton, Jr. and the City of Chula Vista, dated May 1, 197 ,
and approved by Resolution No. 6843, certains terms and conditi ns
are set forth whereby Paxton's Towing Service provides emergenc
towing services, and
WHEREAS, the above-entitled agreement requires the co~sent
of the City prior to an assignment of emergency towing service, and
WHEREAS, the Assignees are deemed acceptable to provi
the services required by the City.
NOW, THEREFORE, the parties mutually agree as follows
1. The City accepts the assignment of Paxton's towin
service to Donald Rhodes and Charles C. Lane, subject to the to s
set forth hereinbelow.
2. The assignees of this agreement hereby agree to a sume
all claims, losses, or damage, injury and liability of every ki d
as against the City which have previously arisen.
3. The Assignees agree to comply with all terms and
provisions set forth in the agreement between Ralph Paxton, Jr.
the City of Chula Vista, dated Play 1, 1973.
