HomeMy WebLinkAboutReso 1974-7555 RESOLUTION N0. 7555 r RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA EXTENDING THAT CERTAIN AGREEMENT BETltTEEN THE CITY OF CHULA VISTA AND THE CITY OF NATIONAL CITY PROVIDING FOR THE USE OF POUND FACILITIES AND SERVICES OF THE CITY OF CHULA VISTA The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Council, by Resolution No. 7123, adop ed on the 18th day of December, 1973, has heretofore approved that c r- tain amendment to the agreement between the City of Chula Vista a d the City of National City providing for the use of the Chula Vist pound facilities and services, and WHEREAS, it is now desired to further amend said agreem nt extending it under the same terms and conditions to and until December 31, 1975, except to provide for an increase in fees from $500 per month to $600 per month for the use of Chula Vista pound facilities and services. NOW, THEREFORE, BE IT RESOLVED by the City Council of t e City of Chula Vista that that certain agreement between the City f Chula Vista and the City of National City providing for the use o the pound facilities and services of the City of Chula Vista be, and the same is hereby extended to and until the 31st day of Dece ber, 1975, under the terms and conditions contained in said amendment. BE IT FURTHER RESOLVED that that certain amendment to t e agreement between the City of Chula Vista and the City of Nationa Clty, a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is her by approved. BE IT FURTHER RESOLVED that the Mayor of the City of Ch la Vista be, and he is hereby authorized and directed to execute sai agreement for and on behalf of said City. T omson, ity Manager George Lindberg, City A *„ AMENDED AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE CITY OF NATIONAL CITY, PROVIDING FOR THE USE OF CHULA VISTAS POUND FACILITIES AND SERVICES THI5 AGREEMENT, made and entered into this 10th day of December , 197 4 , by and between the CITY OF CHULA VISTA, a municipal corporation, hereinafter called "Chula Vista", and the CITY OF NATIONAL CITY, a municipal corporation, hereinaftE called "National City"; W I T T1 E S S E T H WHEREAS, the City of National City desires to use the pound facilities of the City of Chula Vista as a shelter for the impounding and disposing of dogs and small animals, and WHEREAS, the City of Chula Vista has pound facilities adequate to serve the needs of the City of National City in addit on to the present use by the City of Chula Vista, and WHEREAS, the City of National City desires to extend t existing agreement with the City of Chula Vista for the use of t pound facilities of the City of Chula Vista as a shelter for the impounding and disposing of dogs and small animals, and WHEREAS, the City of Chula Vista is willing to extend s< agreement amended in the manner set forth herein. NOW, THEREFORE, IT IS AGREED by and between Chula Vista and National City that the terms of this agreement shall be as follows: 1. Chula Vista agrees to permit the City of National C'ty to utilize pound facilities owned and operated by the City of Chu a Vista as shelters for the impounding and disposal of dogs and srna 1 animals subject to the provisions of Ordinance No. 828 of the Cit of National City, which dogs and small animals may be collected within the following described area of National City, to wit: All that portion of the incorporated territory of the City of National City. 2. Chula Vista agrees to perform all normal pound serv~ces, including among other things, the following: a. Confinement, feeding, destruction and disposal (oth~r than by sale) of dogs and small animals. b. Reservation of not more than ten (10) kennels and three (3) quarantine cages, for the use of the City of National City. c. Use of the carbon monoxide chamber and/or of the i cin- erator chamber for the disposal of animals. d. Reasonable use of the Animal Shelter office and facilities. 3. Chula Vista agrees to provide pound facilities and ser- vices at the Animal Shelter located at 875 "G" Street, during th hours of 8:00 a.m. to 4:00 p.m. for the purpose of receiving ani als from officials of the City of National City and for the redempti n by owners authorized by the City of National City, provided that I - 1 - ~~ owners present acceptable authorization for release. ~5aid~receipt~ and redemption of animals shall be limited to all weekdays from ! D~onday through Friday, except those days designated as legal holidays. 4. Chula Vista agrees to accept dogs or small animals from bona fide residents of National City without charge to such persons. The hours for acceptance of such animals shall be as follows: a. Dogs: Between the hours of 8:00 a.m. and 4:00 p.m. on the days set forth in Section 3. b. Cats: Between the hours of 8:00 a.m. and 2:00 p.m. on the days set forth in Section 3. 5. National City shall deliver all dogs and small anim is to the Chula Vista Pound, and the Chula Vista Pound personnel sha 1 accept said dogs and small animals and perform all pound services normally provided as set forth hereinabove pursuant to Ordinance o. 828 of the City of National City. 6. National City agrees to pay to the City of Chula Vi to the sum of SIX HUNDRED DOLLARS ($600.00) per month for the use of the aforementioned services and facilities, provided that said s of $600.00 shall be paid commencing from the first day of January, 1 75 to and until the 31st day of December, 1975. Said sum to be due nd payable on or before the first day of each month and payable in a vance for such services. 7. Chula Vista shall not be responsible to any residen of National City, or to the City of National City, because of the de - truction of any animal delivered to and accepted by the pound fac lities pursuant to this agreement, and the City of National City agrees o hold harmless the City of Chula Vista from any claims arising from dam ge or injury to animals belonging to residents of the City of National ity and delivered to the Chula Vista pound facilities. 8. It is understood and agreed that the City of Chula ista will hold all dogs delivered in accordance with the provisions he ein for a period of three (3) days. At his discretion, the National ity Poundmaster may request that dogs be kept for a total of five (5) days. When such a request is made, an additional charge of $1.65 per da will be levied for such dogs. IT I5 FURTHER AGREED that this amended agreement shall ake effect and be in full force on the 1st day of January, 1975, and hall terminate on the 31st day of December, 1975, provided, however, t at either party may terminate this agreement at any time by giving t the other party written notice of intention to terminate ninety ( 0) days following said notice.
