Report on Planning Commission's review of DLB Corporation's proposal to
amend the General Development Plan and Schedule of the 450 acre

A. BACKGROUND
At a special meeting on December 18, 1974 the Planning Commission considered the
attached Plannirg Department staff report on the DLB Corporation's proposal to amend
the General Development Plan and Schedule of the 450 acre Plaza del Rey component of
the E1 Rancho del Rey Planned Community District.
The Commission adopted a motion recommending approval of the proposed amendment subject
to the findings and conditions set forth in the attached Planning Commission Resolution
PCZ-74-J. The motion carried by a 5-1 vote with one Commissioner abstaining. (An
explanatory memo from Commissioner Pressutti, who cast the negative vote, is enclosed.)
B. APPLICANT'S CONCERN Oti'ER CONDITIONS
The applicant has expressed sorne concern over the degree of finality vs. flexibility
of several of the recommended conditions of approval and has expressed the desire to
postpone some of the decisions until the precise plan stage. Staff understands this
concern but, nevertheless, believes it is necessary to establish basic conditions of
approval at the General Development Plan stage. Because the conditions of approval
recommended by the Engineering Division are applicable to almost any conceivable kind
of precise plan the applicant might submit,. they are appropriately inflexible.
This is not so much the case with the conditions of approval recommended by the
Planning Department. Upon reviewing a precise plan for any portion of the project,
it might become clear that the matter addressed by one of the conditions of approval
is better resolved in a slightly different way. In such a case, there should be
room for interpretation of the conditions of approval to achieve the desired end.

amendment to the El Rancho del Rey General Development Plan and Schedule, by adapting
the Plaza del Rey Plan for 450 acres located on the east side of I-805 and the northerly

Department Mead Reconunendation:
Concur with the Planning Commission recommendation with the exception of the 600,000
sq. ft. limitation on the regional shopping center. It is my opinion that the regional
shopping center should be limited to 750,000 sq. ft. with approval of any additional
development subject to Council review measured against the adverse impact of traffic,
noise, pollution and other environmental factors caused by the 750,000 sq. ft. commer-
cial deve1opnrent previously approved.

This does not mean that the conditions of approval established by Council have
no importance. The applicant's obligation is to fulfill the conditions. However,
if the applicant, at the precise plan stage, is able to fulfill the intent of a
condition in a slightly different way than is contemplated at this General
Development Plan stage, staff would have no reluctance to recommend it to the
Council.

and southerly sides of H Street extended, subject to the conditions listed in
paragraph VII of the staff report, amended to limit the regional shopping
center to 600,000 square feet instead of 750,000 square feet, and also amending
condition D 1 by deleting the words "if practicable."
The Commission's action on the item, together with the pertinent background
information, is fully set out in Resolution PCZ-74-J (copy enclosed).
