Resolution - Approving Agreement Rescinding Agreement Between
City of Chula Vista and County of San Diego

City Council Resolution No. 5645 approved an agreement between the City
and the County of San Diego for the joint construction of portions of
Palomar Street and Oleander Avenue in the vicinity of and generally
east of I-805.
Subsequent to the execution of the agreement, the total project site
has been annexed to the City and there has been no construction on the
portions of either Palomar Street or Oleander Avenue as covered by the
agreement. The Engineering Division recently received a letter from the
County Engineer requesting approval of an agreement to rescind the
City-County agreement to construct Palomar Street and Oleander Avenue,
since annexations appear to have precluded the necessity for'. construction
as a joint City-County project.
It might also be noted that major portions of the work contemplated under
the agreement either have been completed or are committed to be con-
structed by developers of adjacent properties. There is a distinct
prospect that the remainder of Palomar Street will be improved through th
subdivision process. Thus, the scope of the work to be done has been
very substantially reduced.
The once-apparent justification for County participation has for all
purposes been eliminated. The existing agreement should therefore be
rescinded.

SUBJECT: Cancellation of City-County Agreement to Construct Palomar Street
from 1500 Feet East of Melrose Avenue to Oleander Avenue
In 1970 the City and County agreed to construct the subject portion of Palomar
Street as a joint City-County project. Subsequent State construction, annexations
and subdivision activity appear to have precluded the necessity for construction
of this portion of Palomar Street as a joint City-County project.
The enclosed document will effectively rescind the original. agreement of .1970
and relieve the City and County of any further obligations thereunder. If
this is acceptable, please have two copies executed by your City and return them
to this Department, attention: F. A. Mulligan. The date wi11 be filled in by
the Clerk of the Board of Supervisors when executed by the County, and a fu11y
executed copy wi11 be returned for your files.
