Thomson, City Manager ~,,~ '`~, ,~' j'`? FROM: Craig K. Beam, Assistant City Attorney ~-- 5UBJECT: Unanimous Consent Item - Paxton's Garage Assignment I apologize for placing this particular item before you at this'llate date. I would not do so except I feel the item is extremely routine and Council's failure to act on the item could create hardship for the individuals involved. As can be seers from t;~e agreement, a person may not assign them contractual right with the City of Chula Vista to provide emergency police towing service without the City's consent. In this part~.cular case, the assignees of the contract came to the Attorney's Office in the latter part of this week to determine what steps were necessary for the City to accept an assignment. Our agreement to an assignment can be provided by a resolution to that effect. The purchasers and seller of the towing service are presently i°nn escrow. That escroe~ will close the 2nd of January, 1975. If the Council chooses not to act upon this item at the Council meeting of December 17, the sale and transfer of the properties involved vaill, most likely, have to be postponed. Inasmuch as the purchasers of the bacceetinara changetin legalnowner- I see no risk involved in the City P g ship.
