ITEM TITLE: Resolution - Approving Agreement for the Deferral of the
Installation of Public Improvements for Property Located at 33 Third
Avenue

City Attorney
The Director of Planning is prepared to approve a tentative
parcel map for property located at 33 Third Avenue.
In order to exercise approval, it is necessary that all public
improvements either be installed or that there is adequate
security to insure the installation of said improvements.
The property owner has executed the attached agreement guaranteeing
the installation of the improvements and has posted a faithful
performance bond in the amount of $5,000 to secure their installa-
tion within six months.

NOTICE OF DEFAULT AND ELECTION TO SELL
UNDER DEED OF TRUST
NOTICE IS HEREBY GIVEN:
That SAFECO TITLE INSURANCE COMPANY, a corporation, is Trustee under a Deed of Trust
dated February 8, 1974
executed by SOUTH BAY COURT CLUB, a limited partpership
as Trustor, to secure obligations
in favor of see Exhibit "A" attached
as beneficiary
recorded June 20, 1974 as document no. 74-165140
in book 1974 Paget of Official Records in the office of the
Recorder of San Diego County, California, describing land therein as:
per Deed of Trust
including one note for the sum of $ 15,000.00
said obligations
That the beneficial interest under such deed and the obligations secured thereby are owned by the undersigned;
That a breach of, and default in, the obligations for which such deed is security has occurred in that payment has
not been made of:
The monthly installment of principal and interest due May 20, 1976 and subsequent
installments due thereafter; any and all sums advanced by Beneficiary under the terms
and provisions o>~ said Deed of Trust; any delinquent taxes, assessments or insurance
premiums; any delinquent payments accruing under a prior encumbrance.
That by reason thereof, the undersigned, present beneficiary under such deed, has executed and delivered to said
Trustee a written Declaration of Default and Demand for Sale, and has deposited with said Trustee such deed and
all documents evidencing obligations secured thereby, and has declared and does hereby declare all suns secured
thereby immediately due and payable and has elected and does hereby elect to cause the trust property to be sold
to satisfy the obligations secured thereby.
NOTICE
You may have the right to cure the default described herein and reinstate the mortgage or deed c}F trust.
Section 2924c of the Civil Code permits certain defaults to be cured upon the payment cf the amounts
required by ttrat section without requiring payment of that portion of principal anti interest which would not
be due had no default occurred. Where reinstatement is possible, if the default is not cured within three months
following the recording of this notice, the right of reinstatement wil! terminate and the property may be sold.
