ITEM TITLE: Resolution - Appropriating Additional Funds for the Constructi
of Sewer Facilities at the Intersection of East "H" Street and
I-805 Freeway - Utilities Agreement No. 15179-B

BACKGROUND:
The City Council, by Resolution 6439 on May 23, 1973, approved Utilities
Agreement No. 15179-B with the State of California. This agreement
provides for the installation of a sewer main and the method of payment
in conjunction with the construction of I-805 Freeway. This ,sewer main
includes a portion of the Rice Canyon Trunk Sewer which willserve future
development east of the freeway.
The contractor for the Department of Transportation, State of California,
has completed the construction of the sewer beneath the East "'H" Street/
I-805 Freeway interchange. The Department of Transportation has billed
the City for the cost of constructing the sewer.
The cost is $57,452.38. $48,000 was budgeted in account 61-7001-PW-3-72.
An additional appropriation in the amount of $9,452.38 from the un-
appropriated balance of the Sewer Income Fund is needed to ply the bill.
Since the City has advanced the funds to construct the sewer which will
benefit future development lying east of the freeway, I will'be sub-
mitting to the City Council for their approval at some time in the future
a repayment diagram to reimburse the City for the cost of constructing the
portion of the Rice Canyon Trunk Sewer.

Insessence, San Diego Transit claims that a series of interdependent
events has prevented compliance by the bus company with their agree-
ment with the City. Though this state of affairs is unsatisfactory,
it does not appear alterable. Decisions were made by SDTC based
upon circumstances and information existing at the time.
The City has been assured that resolution of the critical South Bay
Transit situation remains of top priority in the SDTC Action Plan.
The issue will again be addressed in contract negotiations far the
coming fiscal year.
