RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA SETTING FORTH TERMS AND CONDITIONS REGARDING
THE MAILING OF CANDIDATES' STATEMENTS AND CAr'IPAIGN
MATERIALS
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the general municipal election for the City of
Chula Vista will be held on April 13, 1976, and
WHEREAS, any candidate for municipal office must file no
later than 12 o'clock noon on February 5, 1976, unless an incumbent
fails to file for reelection, and
WHEREAS, at such time as nomination papers are taken out
by various candidates, said candidates may prepare a candidate's
statement on an appropriate form as provided by the City Clerk in
accordance with Section 19 of Chapter 1158 of the 1975 statutes
amending the Elections Code, including the name, age, occupation
of said candidate and a brief description of no more than 200 words
of the candidate's education and qualifications, and
WHEREAS, said legislation additionally authorizes the City
of Chula Vista to bill each candidate availing him of the services
provided in the printing, handling and translating of said candidate's
statement if a candidate chooses to prepare said statement, and
WHEREAS, the City Council of the City of Chula Vista is
authorized to adopt regulations to permit each candidate for elective
office to prepare separately other materials to be sent to each voter
in addition to the sample ballot and voter's pamphlet.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that the following regulations are adopted as
the regulations of the City of Chula Vista pursuant to Section
10012.5 of the Elections Code, as amended by Section 19 of Chapter
1158 of the 1975 statute:
1. Each candidate shall be allowed to prepare a candidate's
statement on a form provided by the City Clerk of the City of Chula
Vista not to exceed 200 words in accordance with the Elections Code
provisions set forth above.
2. The City Clerk of the City of Chula Vista is hereby
authorized to bill each candidate wishing to submit a candidate's
statement for his actual pro rata cost of the printing, handling
and translating said candidate's statement.
3. Each candidate requesting a candidate's statement
shall pay for the cost of the translation of said statement into
the Spanish language to satisfy the requirements of the Federal
Voting Rights Act of 1965, as amended in 1975.
4. The charges billed by the City Clerk of the City of
Chula Vista shall only be levied upon those candidates wishing to
submit a candidate's statement.
5. Each candidate wishing to submit a candidate's state-
ment shall be charged the same amount as all other candidates
wishing to have a candidate's statement provided.

6. The City Clerk is authorized to bill each candidate
providing a candidate's statement for the services set forth above
on the fifteenth day following the date on which the City Clerk re-
ceives the actual cost breakdown of said printing; handling and
translating of a candidate's statement.
7. The City Clerk is hereby empowered to proceed in
Small Claims Court as necessary to secure payment of any sum owing
to the City of Chula Vista by virtue of the services provided herein
fifteen days following the mailing of the charges levied with respect
to the candidate's statement.
8. No other materials other than candidate's statements
and other information required by law shall be transmitted to the
voters with their sample ballot.
9. These regulations shall apply equally to all candidates
including incumbents.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Chula Vista is authorized and hereby directed to undertake all other
activities necessary to comply with the provisions set forth above.
