RESOLUTION NO. 8002 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING RULE IX, SECTION 3, OF THE CIVIL SERVICE RULES RELATING TO SICKNESS AND DEATH LEAVE The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Council has heretofore entered into a Memorandum of Understanding with the International Association of Fire Fighters, Local 2180, which Memorandum contained an agreement for the recommendation of certain changes in the use of sick leave in the event of a death in the family, and WFIEREAS, the Civil Service Commission has approved said modification to Rule IX, Section 3, of the Civil Service Rules of the City of Chula Vista relating to sickness and death leave. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that Rule IX, Section 3, of the Civil Service Rules of the City of Chula Vista be, and the same are hereby amended as shown in Exhibit "A", attached hereto and incorporated herein by reference as if set forth in full. City Clerk d _~ `~..3 ~ $GF~~yy .... .. ~,~y V December 11, 1975 T0: Civil Service Commission FROM: Richard D, Overley, Director of Personnel SUBJECT: Public Hearing Regarding Civil Service Rule Amendment Pur ose: In the Memorandum of Understanding between the City and the International Association of Fire Fighters, Local 2180, the City Manager agreed to recommend a change in the Civil Service Rules to the Civil Service Commission. The following recommendation is made pursuant to that agreement. Recommendation: Adopt a motion recommending that the City Council approve an amendment to Civil Service Rule IX which would allow the use of sick leave in the event of the death of a member of the immediate family of an employee's spouse or any other person who is a dependent as defined by the Internal Revenue ~ Service, and which would provide that Firefighters working a 60-hour week to be granted up to two shifts off with pay to be charged to sick leave for the same purpose (a proposed revision of Civil Service Rule IX, Section 3(c) (4) is attached). Discussion: The proposed change in the Civil Service Rules regarding use of sick leave in the event of a death in the family of an employee is a change which would broaden the scope of the Rule. Currently, regarding a family death, sick leave may be allowed only in the event of the death of a member of the immediate family of the employee. The revision which the City Manager agreed to recommend would authorize sick leave in the event of the death of a member of the immediate family of the employee's spouse. The Rule change would also permit an employee to use sick leave in the event of death of any other person who would be a dependent of the employee as defined by the Internal Revenue Service. Additionally, the revision would provide that Firefighters working a 60-hour week be allowed up to two shifts off with pay. Travel time, which currently is actual time used not to exceed five calendar days, remains un- ~ changed. ~' o o y Article XIII of the Memorandum of Understanding states: "The immediate _ family shall be defined as spouse and children of the member, mother, father, brother, sister of the member, and those of the member's spouse - as approved by the Civil Service Commission, or any other person as defined by the Internal Revenue Service as a dependent." Staff believes "...those of the member's spouse as approved by the Civil Service Commission..." should be the same family members as currently approved for the employee. The current definition of immediate family of the employee in Section 3(c)(1) of Rule IX should be used for defining the immediate family of the employee's spouse without change as the definition in the Memorandum of Understanding is compatible with it. Summary: The proposed Rule change broadens the current rule by: (1) allowing use of sick leave in the event of the death of a member of the immediate family of an employee's spouse or any person who is a dependent of the employee as defined by the Internal Revenue Service, and (2) specifies that employees of the Fire Department who are working 60 hours/week may be allowed up to two shifts off with pay rather than three days. RDO:jIs w Attachment ~~ ~ y Article XIII Memorandum of Understanding, International Association of Firefighters Local 2180 DEATH IN FAMILY LEAVE In the event of a death in the immediate family of an employee, the employee shall be granted up to two (2) shifts off with pay. The immediate family shall be defined as spouse and children of the member, mother, father, brotl~er, sister of the member, and those of the member's spouse as approved by the Civil Service Commission, or any other person as defined by the Internal Revenue Service as a dependent. Paid absence for family death shall be charged to accumulated sic!< leave. It is understood that the City Manager will recommend this change to the Civil Service Commission. ~oc~- Proposed Revision to Civil Service Rule IX, Section 3(c)(4) (4) When an employee with permanent status is compelled to be absent from work because of the death of an immediate family member, an immediate family member of the employee's spouse, or any other person defined by the Internal Revenue Service as a dependent, and after such employee makes written request and receives written department head approval, such employee may be allowed the privilege to be absent from work with full pay up to three (3) days, plus reasonable travel time. Em- ployees in the Fire Department working a 60-hour week shall be allowed to be absent from work with full pay for up to two shifts, plus reasonable travel time. Travel time for all employees will be actual time used not to exceed five (5) calendar days. Paid absence for family death shall be charged to sick leave. ~~o~-
