RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING AGREED'IErdT AND GRANT OF EASEMENT
BETWEEN THE CITY OF CHULA VISTA AND THE STATE OF
CALIFORNIA FOR NORTH GLOVER AVENUE AND AUTHORIZING
THE MAYOR OF SAID CITY TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NO~ta, THEREFORE, BE IT RESOLVED that that certain agreement
and grant of easement between THE CITY OF CHULA VISTA, a municipal
corporation, and THE STATE OF CALIFORNIA, for North Glover Avenue,
dated the 23rd day of December 19 75 a copy of which is
attached hereto and incorporated herein, the same as though fully
set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
agreement and grant of easement for and on behalf of the City of
Chula Vista.
BE IT FURTHER RESOLVED that the City Council does hereby
authorize the expenditure in the amount of $14,000 from Account No.
28-6100-GT-32, payable to the State of California, Department of
General Services for Parcels 1, 2 and 3, as described in Exhibit "A".

AGREEMENT AND GRANT OF EASEMENT

THIS AGREEMENT AND GRAId'l' OF EASEMENT is made and entered into by and between
the STATE OF CALIFORNIA, acting by and through its DIRECTOR OF GENERAL SERVICES,
hereinafter called State, and City of Chula Vista, a municipal corporation,
hereinafter called Grantee.
The State does grant unto Grantee, its successors and assigns forever, an
easement for street purposes over and across the following: as shown on the
attached Exhibit "A" consisting of two (2) pages.
PROVIDED, this Grant of Easement is subject to the following terms and condi-
tions:
1. This Grant is subject to existing contracts, leases, licenses; easements,
encumbrances, and claims which may affect said property and the use of the
word "Grant'' herein shalt not be construed as a conversant against the
existence of any thereof.
2. Grantee waives all claims against the State, its officers, agents, and
employees, for loss or damage caused by, arising out of, or in any way
connected with the exercise of this Easement, and Grantee agrees to save
harmless, indemnify, and defend State, its officers, agents, and employees,
from any and all loss, damage or liability which may be suffered or incurred
by the State, its officers, agents, and employees caused by, arising out of,
or in any way connected with exercise by Grantee of the rights hereby
granted.

No. 166, filed in the Office of County P,ecorder of San Diego
County, State of California, described as follows:
Commencing at the southwest corner of said Quarter Section 135;
thence along the southerly line of said Quarter Section, also
being the south line of said Lot 4, North 70°57' East, 683.15
feet to the east line of the west one half of said Lot 4, being
the TRUE POINT OF BEGINNING; thence North 18°59'51" West, 377.00

feet to the beginning of a tangent curve concave northerly, having
a radius of 22.00 feet; thence southerly along said curve through
