HomeMy WebLinkAboutReso 1975-7980RESOLUTION 1`d0. 7980 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ESTABLISHING A PROCEDURE FOR TI3E APPOINTMENT OF A MEMBER OF THE SAN DIEGO METROPOLITAN TRANSIT DEVELOPMENT BOARD The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Legislature during the first half of its 1975-76 General Session enacted and the Governor has signed the Mills-Deddeh Transit Development Act, and ~~7HEREAS, said Act established the San Diego Metropolitan Transit Development Board, and WHEREAS, said Act provides that one of the members of said board shall be a councilman appointed jointly by the City Councils of the Cities of Chula Vista, Imperial Beach and National City from their membership, and WHEREAS, said Act provides that the City Councils of the Cities of Chula Vista, Imperial Beach and National City may jointly appoint a city officer, other than a city councilman, of their cities to serve as an alternate member of the transit development board, and WHEREAS, said Act does not provide for the term of office of the member of the transit board or the method for such member's appointment or removal, and WHEREAS, the City Councils of the Cities of Chula Vista, Imperial Beach and National City desire to establish a term of office for their joint board member and establish a means for such member's appointment and removal. T~dOG1, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista as follows: Section 1. That the term of office for each member of the transit development board appointed jointly by the City Councils of the Cities of Chula Vista, Imperial Beach and National City shall be two years unless earlier removed in accordance with the provi- sions of this resolution. Section 2. The board member who shall serve during the initial term shall be appointed by the City Council of the City of National City. Section 3. The board member who shall serve during the second term shall be appointed by the City Council of the City of Imperial Beach. Section 4. The board member who shall serve during the third term shall be appointed by the City Council of the City of Chula Vista. Section 5. After the initial six year period the board members shall continue to be appointed for two year terms in the order established by Sections 2, 3 and 4 of this resolution. - 1 - revised Section 6. The City Council having the power of appoint- ment shall nominate a councilmember from one of the City Councils to serve upon the transit development board and such councilperson shall commence serving upon receiving eight affirmative votes from the three City Councils confirming such appointment. In the event such nominee fails to obtain eight affirmative votes the City Council having the power of appointment shall nominate a second nominee whose appointment shall be confirmed by eight affirmative votes of the three City Councils. In the event the second nominee fails to obtain eight affirmative confirming votes the City Council having the power of appointment shall appoint a third member who shall serve at the pleasure of the appointing Council. Section 7. Any of the three City Councils may, upon a majority vote of its entire membership, move for the removal from the transit development board of the joint appointee. Such person may only be removed by ten affirmative votes of the three City Councils. In the event a board member is removed, the City Council having the power of appointment shall appoint a successor to serve during the unexpired portion of the removed member's term. Such successor member shall be appointed and confirmed as provided in Section 6 of this resolution. Section 8. The City Council having the power of appoint ment shall appoint one of its City officers other than a council- member as an alternate transit development board member who shall serve at the pleasure of the appointing City Council. Section 9. The councilmember and alternate shall at least once each quarter meet with the three City Councils to obtain their ideas, suggestions, comments and criticisms of the plans, policies and activities of the transit development board. Section 10. The two cities which do not have their appointee sitting on the development board shall select a member of their respective Councils who will meet monthly with the board appointee as a joint committee to discuss matters under considera- tion by the board. The time and place of the regular monthly meeting shall be determined by the committee. In addition, the board appointee shall call special meetings of the committee prior to casting a vote on any issue that is deemed substantive or critical. Section 11. This resolution shall become operative upon the passage of an identical resolution by the City Councils of the Cities of National City and Imperial Beach and shall remain in effect until the passage of an amendatory resolution by the three City Councils.
