FERREIRA FROM THE PLANNING COMMISSION bENIAL OF A CONDITIONAL USE PERMIT, PCC-75-21, TO INSTALL SELF SERVICE GASOLINE PUMPS AT WHISPERING TREES VILLAGE, 88 E. BONITA ROAD, IN THE C-r1 ZONE The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Council has heretofore, at their meeting of December 9, 1975, held a public hearing to consider the appeal of Frank E. Ferreira from the Planning Commission denial of a conditional use permit, PCC-75-21, for the installation of self service gasoline pumps at [W]hispering Trees Village at 88 E. Bonita Road in the C-N zone, and WHEREAS, based upon the testimony received at the hearing, the staff report from the Director of Planning dated December 9, 1975, the exhibits attached to said staff report and the resolution of the Planning Commission, PCC-75-21, the following findings were made, to-wit: 1. With an existing service station adjacent on the east side of Bonita Road and a valid conditional use permit out- standing for a second service station on the north side of Bonita Road, an additional service station in the proposed location is not necessary or desirable to serve the neighborhood or community and that the information supplied by the applicant has not sub- stantiated the need for such an additional station. 2. That the location of the pump island within the driveway of the existing center fails to provide sufficient stacking distance, so that traffic could back up into Bonita Road and further relocation of the pump island to the south would result in a disruption of the on-site parking and circulation system in the center; accordingly, either solution adversely affects the safety and welfare of persons working or residing in the vicinity. NOW, THEREFORE, BE IT RESOLVED that based upon the City Council's failure to affirmatively find the facts necessary to support the issuance of a conditional use permit in accord- ance with Chula Vista Municipal Code Sections 19.14.080A and B; based upon the findings set forth above and the testimony and evidence considered, the appeal of Frank E. Ferreira from the Planning Commission denial of a conditional use permit, PCC-75-21, to operate a self service three pump gasoline island in connect- ion with an existing convenience market located at 88 E. Bonita Road, is hereby denied.
