HomeMy WebLinkAboutReso 1975-7969RESOLUTION NO. 7969 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING PRECISE PLAN FOR BONITA VISTA APART- MENTS, MEDICAL OFFICES AND RETAIL CENTER IN THE 700 BLOCK OF OTAY LAKES ROAD The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commission has considered the Precise Plan for the Bonita Vista Apartments, medical offices and retail center in the 700 block of Otay Lakes Road on November 24, 1975 and has recommended that the City Council approve such plan and architect- ural theme in accordance with Planning Commission Resolution No. PCM- 75-27 attached hereto and incorporated herein by reference as if set forth in full. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the Precise Plan and architectural theme for Bonita Vista Apartments, medical offices and retail center in the 700 block of Otay Lakes Road be, and the same is hereby approved in accordance with Planning Commission Resolution No. PCM-75-27, attached hereto. BE IT FURTHER RESOLVED that Planning Commission Resolution No. PCM-75-27 be and the same is hereby modified to require the use of a pitched wood shingle roof in the total design of the building except for areas used for architectural accent, more effective use of wood trim and continuity in use of accent paneling and more subdued stairway and balcony screening treatment, as approved by the Planning staff . RE`tJLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING 'i0 THE CITY COUNCIL THE APPP,OVAL OF THE PP,ECISE PLAN FOR DEVELOPMENT OF BOPJITA VISTA APAR1-MENTS, MEDICAL AND RETAIL CENTER IN THE 700 BLOCK OF OTAY LAKES ROAD WHEREAS, C-O-P and C-C-P zoning was adopted on October 29, 1974 by Ordinance No. 1574 fora 10 acre parcel located west of Otay Lakes Road in the 700 block, and WHEREAS, a Precise Plan was submitted by Corky McMillin and Company for development of a 90 unit apartment complex, medical offices, and retail commercial facilities, and s~ '~~~r~~ ~; WHEREAS, the City Planning Commission held a public hearing at 7:00 p.m. Monday, November 24, 1975, in the Council Chamber, City Hall, 276 Fourth Avenue, to consider the Precise Plan for development as submitted. NOW THEREFORE BE IT RESOLVED THAT THE CITY PLANNING COtdMISSION finds as follows: a. That such plan will not, under the circumstances of the particular case, be detrimental to the health, safety or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the vicinity. The Precise Plan has been evaluated to function well as a unit and to provide efficient access and safety requirements in accordance with City standards. The grading and construction techniques required will ensure that the project will have a minimal adverse impact. The combined impact of a new type of housing in the area, a medical facility, and a limited retail commercial development is expected to have a positive and balancing impact in the College Estates area. b. That such plan satisfies the principle for the application of the "P" Modifying District as set forth in Section 19.56.041 of the Municipal Code. The Precise Plan has been determined to comply with the conditions of the precise plan zoning, PCZ-74-H, and therefore fulfills the purposes for which the "P" zoning was applied to the property. c. That any exceptions granted which deviate from the underlying zoning require- merits shall be warranted only when necessary to meet the purpose and application of the "P" Precise Plan Modifying District. There are no exceptions to the zoning ordinance requirements contemplated. d. That approval of this plan will conform to the General Plan and the adopted .policies of the City of Chula Vista. The Precise Plan conforms to the Chula Vista General Plan designation of 7~W~ °Retdll Comrnercial," Slnce medical officers and rPtai~ cnarn ~~e .,~~..,;++,,,; ~sE~; therESin, and the apartments were approved as an acceptable conditional use by Resolution PCC-75-15(B). The introduction of apartments into this area expands the housing choice significantly and provides for student and faculty housing for nearby Southwestern College. The proposed rental prices of $175 (1 bedroom) - $265 (3 bedroom) are considered to be reasonable rates in today's market, which should attract a range of income groups. In this manner, the apart- ments fulfill the policies and action program of the Housing Element. In addition, the developer has agreed in writing to explore methods of providing moderate and low income housing in a portion of the apartment project. _ Subsequent actions by the developer regarding public improvements, in lieu park fees, soil treatment and noise mitigating construction techniques will ensure that the central policies of the other General Plan Elements will be met. BE IT FURTHER RESOLVED that the City Planning Commission recommends to the City Council the approval of the Precise Plan for Bonita Vista apartments, medical offices ar.d retail commercial facility, subject to tie following condi- tions: 1. Development of the apartments shall comply with the conditions_of approval of Resolution PCC-75-15(B). 2. Development of the 10 acre property shall be undertaken only after a parcel map has been approved. 3. The architecture of the medical office building is approved; all of the elevations shall continue the theme submitted as the front and right elevations. Reasonable architectural control, as provided by the precise plan designation, shall be applied to the apartment development. No building permit for the apartments shall be issued until such time as their architectural treatment has been approved by the Planning Commission and City Council. 4. Landscaping plans for slopes shall be submitted concurrent with the grading plan. Site landscaping plans shall be submitted at the time of appli- cation for building permits. 5. The landscaping concept, as amended by the City Landscape Planner, is approved. rl 9~ 9 ' 6. The retail commercial portion of the Precise Plan is approved as a skeletal plan only. At the time the developer is ready to proceed with the retail commercial area, he shall apply for an amendment to Precise Plan for PCZ-74-H and present all documents and information required in Section 19.56.042 of the Chula Vista Municipal Code. 7. Freestanding signs shall be allowed as follows: a. Apartments - one ground monument sign, 5' high and 30 sq. ft. in area, at the main entrance, plus directional signs as provided for in the ordin- ance. b. Medical Office Center - one ground monument sign, 8' high, 32 sq. ft. in area, each on Otay Lakes Road and "A" Street, plus directional signs as provided in the ordinance. c. Retail Commercial - all freestanding signs shall be designed as ground monument signs. Other signs shall be governed by the C-C zone regulations of the Chula Vista Municipal Code (Sec. 19.36.040). The developer is encouraged to undertake a planned signing program for the retail center in accordance with Sections 19.60.490-.520 of the Chula Vista Municipal Code. 8. The developer shall install public improvements and fire fighting improve- ments as required. These requirements will be set forth in detail as condi- tions of approval of the parcel map.
