RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
AUTHORIZING THE ISSUANCE OF COASTAL DEVELOPMENT PERMIT NO.
026 FOR THE DEMOLITION OF STRUCTURES AT 350-368 BAY
BOULEVARD
The City Council of the City of Chula Vista does hereby resolve as
follows:
WHEREAS, the City of Chula Vista Local Coastal Program (LCP) has been
certified by the California Coastal Commission; and
WHEREAS, said LCP includes Coastal Development procedures
determined by the Commission to be legally adequate for the issuance of
Coastal Development Permits and the City of Chul a Vista has assumed permit
authority of the Chula Vista Coastal Zone; and
WHEREAS, a public hearing was duly noticed and held on September 8,
1987, in accordance with said procedures; and
WHEREAS, tile City Council of the City of Chula Vista, as "approving
authority" has reviewed and considered the information and amend IS-87-13 and
the demolition proposal.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Chula Vista as follows:
A. The City Council hereby adopts Negative Declaration IS-87-13
attached hereto as Exhibit A; and
B. The City Council hereby finds, based on the following findings,
that the proposed demolition project and removal of debris,
subject to conditions listed in Exhibit B attached hereto and
incorporated herein as though fully set forth, is found to be
consistent with the policies of the Chula Vista Bayfront Local
Coastal Program.
Findings
Based on the following findings that the proposed demolition
project and removal of associated debris, subject to conditions,
is found to be consistent with the policies of the Chula Vista
Bayfront Local Coastal Program.
1. The demolition of existing structures and debris located on
site will remove uses currently inconsistent with the
certified LCP and will facilitate the construction of
allowable land uses.
2. Grading following the demolition and debris removal shall
be conducted in accordance with grading regulations set
forth in the certified LCP and related documents intended
to minimize the potential for siltation. In addition,
testing for contaminated soils is required and, if found,
the site shall be cleaned of all hazardous substances.
This requirement will remove the potential for such
substances to move off-site with surface run-off.
3. The Statewide and Regional Interpretive Guidelines have
been reviewed and the proposed demolition and debris
removal has been found to be in conformance with the Public
Access and Public Recreational policies of Chapter 3 of the
Public Resources Code.
C. The City Council of the City of Chula Vista hereby authorizes
the issuance of Coastal Development Permit ~026.
