HomeMy WebLinkAboutAgenda Statement 1975/01/28 Item 10AGEINDA ITEM N0, [ 10 ) CHULA VISTA CITY COUNCIL MEETING OF: TTFM 'T TTT F INITIATED BY BACKGROUND January 28, 1975 Resolution - Approving Temporary Extension of the American Legion Lease City Attorney The City Council in a Council Conference directed staff to prepare and forward a proposal to the City Council for the extension of a lease with the American Legion for the facility located at General Roca Park. The Council indicated that they would extend the .lease to the Legion for 10 years with a 10 year option if the American Legion would make improvements to the property as suggested by the staff . City staff came forward with a recommendation for the improve- ments to be made. These improvements would cost approximately $26,000 (see attached report from the Director of Parks and Recreation and Engineering). The American Legion, on the other hand, has only $10,000 in their building fund. Staff, therefore, is currently preparing the options which are available to the City Council regarding the subject property. These options nlay include, for the reasons stated above, a request that the City Council provide financial assistance in the form of the construc- tion of a portion of the improvements needed on the property.. Inasmuch as staff and the Legion are at an impasse currently,.... I would suggest the Council authorize the extension of the lease as provided for in the attached resolution. The current lease expires the 31st of this month. DATE: T0: FROM: SUBJECT: December 17, 1974 "~'~~ ~ ~: JoFrn Thomson, City Manager . ~ ~~ . ~~I~` 1 . +, .:_ , ~: Emerson Hall, Director of Parks and Recreation American Legion Building - Renewal of Lease </- Pursuant to Council request, the Building and Housing, Public t~Jorlks and Planning Departmerts have studied the facilities which have been under a lease agreement to the Chula Vista American Legion Post 434. The report from the Director of Building and Housing points out 7'1 vio- lations of the building code; his report notes that the building '.has been found to be dangerous, as defined in Section 302, Volume 4 of the 1970 Unified Building Code. In discussing this matter with the Director of Building and Housing, although the list is composed .of .items that need immediate attention, he indicated that the cost for these repairs could be accomplished within a $3,000 price range. The reports from the Public 4lorks and Planning Departments deal basic- ally with improvements to the surrounding grounds which are necessary in order to accommodate the American Legion and other groups using this facility. It is estimated by the Assistant Director of Public IJpr°ks that these improvements would cost X23,608; this estimate includes pav- ing, curbing and landscaping of the parking lot, ~vhich eras of major con- cern to the Director of Planning. Using the estimated cost of these repairs (26,608), and proratid~g this under a ten-year lease agreement, the American Legion vrould be receiving the use of this meeting hall for less than $2,700 per year. After exam- ining the existing facility, I feel it is very important. that the Legion not only upgrade to meet minimum requirements, but also renovate. the inside and outside of this facility in order to make it presentable to the community. In addition, the Legion and the City should have a clear undersiaanding as to the term of this lease and that this should be a phaseout tinne period in which the American Legion is made aware that: it should begin to make tentative plans for the purchase of land and construction of a facility which ~vould meet its needs so that this transition could be made during this ten-year use without disrupting their community service. Exhibit "A" shows the proposed improvements listed below: 1. Paving of a parking lot with 2" of asphalt concrete on 4" of aggregate base. 2. Installation of concrete curbing around the parking lot and planter islands. 3. Landscaping and irrigation of the planter islands (1325 S.F.) and some of the surrounding grounds (4500 S.F.). 4. Construct curb outlet and lined drainage ditch to drain parking lot. 5. Provide parking lot lighting (2 standards). 6. Paint parking stalls in the parking lot. 7. Remove and/or demolish abandoned rest rooms. 8. Representatives of the timeriean Legion have indicated they plan to remove or demolish the existing storage build:~ng just east of the main hall. The estimated cost to do this.. work is included in the cost estimate below. Thomson, City Manager Subject: Status Report - American Legion Lease The City Attorney is providing for your action on January 28, 1975, a resolution allowing a short-term extension (month-to-month) of the lease between the City and the American Legion Post pertaining to use of City property located at Fifth Avenue and C Street, north. of ~--lenzel Field. As Council directed, staff and the City Attorney have been meeting with repre- sentatives of the American Legion Post to try to work out an acceptable arrange- ment for a new lease to provide for a 10-year period, with an option for 10 additional years, subject to a 180-day cancellation clause. Also, a plan fvr necessary capital improvements to the building and site were to be developed as a lease condition. The plan is to include the elements of, project scope, City participation (if appropriate), costs, and schedule. We have encountered problems. in terms of the Post being able to finance the current staff-proposed scope of improvements. We are exploring alternative. financing approaches. The crux of the problem is that the Post has only $10,000 to approach about $26,000 estimated cost of improvements. City parti- cipation on the parking lot in relation to h1enzel Field appears justified and would reduce the funding gap.
