TO NOON AND APPROVING AN AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND PULSE ENDURANCE SPORTS FOR THE EVENT SUBMITTED BY: COMMUNICATION OORDINATOR REVIEWED BY: CITY MANAGER ,-- ASSISTANT CIT ANAGER ~l 4/STHS VOTE: YES ~ NO ^X SUMMARY Pulse Endurance Sports is requesting permission for the temporary one lane street closures of a multitude of streets as listed in Exhibit "A" on Sunday, October 16, 2011 to conduct the Chula Vista Challenge Olympic Distance Triathlon in Chula Vista ending at Salt Creek Recreation Center. ENVIRONMENTAL REVIEW The City's Environmental Review Coordinator has reviewed the proposed projects for compliance with the California Environmental Quality Act and has determined that the projects qualify for a Class 4 categorical exemption pursuant to Section 15304(e) of the State of CEQA Guidelines. Thus, no further environmental review is necessary. RECOMMENDATION That the City Council adopts the resolution. BOARDS/COMMISSION RECOMMENDATION Not Applicable 10-1 DISCUSSION Pulse Endurance Sports (sponsor) plans to conduct the Chula Vista Challenge Olympic Distance Triathlon in Chula Vista on Sunday, October 16, 2011. In order to safely conduct this triathlon, event sponsors are requesting temporary one lane street closures of a multitude of streets as listed in Exhibit "A". One lane of the streets listed would be closed to traffic from 12 a.m. to noon on Sunday, October 16 in order to stage the event. Diagram of road closure is attached. The Chula Vista Challenge Olympic Distance Triathlon is a timed qualifying race consisting of three races in swimming, biking and running. The sponsor anticipates approximately 400 adults from around San Diego County and Mexico participating in the event and with an additiona1200 spectators. The triathlon will begin with a 1.5k swim in San Diego Bay off Bayside Park. Then the race will continue with a 40k bike course through Chula Vista, down Main Street continuing through the Eastlake area. The running portion starts at Salt Creek Recreation Center through the local trails of the Wueste Road area through the Olympic Training Center and ends back at the Salt Creek Recreation Center. This is the first year for this event in the city. The Chula Vista Police, Fire and Traffic Engineering departments have reviewed and approved the traffic control plan and road closure. The sponsor has secured a private parking control company for the event to supply street equipment, directional signage, assist with traffic control and parking enforcement. However, the Chula Vista Police Department will be overseeing traffic control and be on-site for the duration of the event. The City's transit system will be affected and re-routes and potential delays will be posted. The sponsor is required to provide adequate insurance as requested by Risk Management as outlined in Attachment "A." Also, the approval of the request will be subject to the conditions listed on the above-mentioned attachment. The closure of the requested streets will affect the flow of traffic in the mentioned area. Event sponsors have been required to provide written communication at least three weeks in advance to all businesses and residents along the road closures. The triathlon starts at off Bayside Park at 6:45 a.m. for the swim portion and then will continue on to the biking and running portions. Chula Vista Police Department will open streets for traffic behind the last race participant. The Port of San Diego has permitted the use of Bayside Park since this event takes place on their property. The Port permit is responsible for all park and marina logistics including all activities in the park and off shore, park maintenance, parking lots, trash services, portable toilets, etc. Additional duties of the event sponsor are listed in the agreement between the City and Pulse Endurance Sports. 10-2 DECISION MAI~R CONFLICT Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the property,- which is subject of this action. CURRENT YEAR FISCAL IMPACT The event sponsor will be responsible for all event costs. Any services provided by the City before, during or after the event will be fully reimbursed by the sponsor. ONGOING FISCAL IMPACT None. Pulse Endurance Sports will conduct the Chula Vista Challenge Olympic Distance Triathlon on Sunday, October 16, 2011. B. Pulse Endurance Sports requests to close a one lane of a multitude of streets listed in Exhibit "A" from 12 a.m. to noon on Sunday, October 16, 2011 in order to stage the event. Agreement 1. Pulse Endurance Sports Duties Pulse Endurance Sports shall perform each of the duties described in Attachment A, attached to this Agreement and incorporated into this Agreement by this reference. 2. Term This Agreement is effective upon the execution of the Mayor and expires on October 17, 2011. 3. Termination of Agreement If Pulse Endurance Sports fails to fulfill, in a timely and proper manner, any of Pulse Endurance Sports obligations or duties under this Agreement, or if Pulse Endurance Sports violates any of the covenants, agreements or stipulations of this Agreement, City has the right to terminate this Agreement by giving at least one (1) day written notice to Pulse Endurance Sports of the termination before the effective date of the termination. 4. Assignability Pulse Endurance Sports shall not assign or transfer any interest in this Agreement without prior written consent of City. 10-6 5. Independent Contractor Pulse Endurance Sports and any of the Pulse Endurance Sports's agents, employees or representatives are, for all purposes under this Agreement, independent contractors and shall not be deemed to be employees of City, and none of them shall be entitled to any benefits to which City employees are entitled including but not limited to, overtime, retirement benefits, worker's compensation benefits, injury leave or other leave benefits. 6. Insurance Pulse Endurance Sports represents that it and its staff and agents employed by it in connection with the Special Event are protected against the risk of loss by the insurance coverage outlined in Attachment A, Duties of Pulse Endurance Sports including naming the City, it officials, officers, agents, employees and volunteers as additional insured. 7. Hold Harmless Pulse Endurance Sports agrees to defend, indemnify and hold harmless the City, its elected and appointed officials, officers, agents and employees pursuant to the Group/Organization Waiver and Release of Liability executed by Pulse Endurance Sports. 8. Notices All notices to be given pursuant to this Agreement must be in writing. All notices to be sent to any party shall be deemed to have been properly given or served if personally served or deposited in the United States mail, addressed to such parry, postage prepaid, registered or certified, with return receipt requested, at the addresses identified in this Agreement as the places of business for each of the parties. 9. Entire Agreement/Amendments This Agreement, the Group/Organization Waiver and Release of Liability, and any other written document referred to or contemplated in this Agreement embody the entire Agreement and understanding between the parties. Neither this Agreement nor any attachment or provision may be amended or modified except in writing executed by each parry to the Agreement. 10. Full Cost Recovery Pulse Endurance Sports shall reimburse the City for all costs incurred by the City before, during, and after the Special Event. 10-7 11. Submit proof of insurance in the form of a Certificate of Insurance for $1 million per occurrence, or equivalent form, with a policy endorsement naming the City as additional insured, making their insurance primary with respect to the City's insurance and providing notification of cancellation. 2. Provide, at its own expense, all necessary supplies and services required to safely conduct the event, including trash receptacles, trash control, crowd control, traffic control and traffic control equipment, signs and security, including any overnight security. 3. Post applicable street closure signs and directional signs at least 48 hours in advance of the event. 4. Ensure that all participants, or their legal guardians, sign liability waivers approved by the City Attorney as to form. These waivers must indicate that the Pulse Endurance Sports will indemnity and hold the City of Chula Vista harmless for any injury or loss of any kind in connection with the event. 5. Provide adequate supervision of event spectators and participants to prevent damage to City property and landscaping. 6. Provide adequate and sufficient street barricades and supervision to insure that no vehicles are permitted into the event area throughout the duration of the event. 7. TO NOON AND APPROVING AN AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND PULSE ENDURANCE SPORTS FOR THE EVENT WHEREAS, the Pulse Endurance Sports has requested the temporary one lane closures of a multitude of streets as described in Exhibit "A" for the Chula Vista Challenge Olympic Distance Triathlon on Sunday, October 16, 2011 from 12 a.m. to noon; and WHEREAS, the Council finds that the Pulse Endurance Sports encourages and promotes community spirit and positive publicity for the City throughout the region which will generate commercial revenue; and WHEREAS, the City's Environmental Review Coordinator has reviewed the proposed project for compliance with the California Environmental Quality Act and has determined that the project qualifies for a Class 4 categorical exemption pursuant to Section 15304(e) of the State CEQA Guidelines. Thus, no further environmental review is necessary. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the temporary one lane closures of a multitude of streets as described in Exhibit "A" for the Chula Vista Challenge Olympic Distance Triathlon on Sunday, October 16, 2011 from 12 a.m. to noon; BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista approves the Agreement between the City of Chula Vista and the Pulse Endurance Sports a copy of which shall be kept on file in the office of the City Clerk, and authorizes the Mayor to sign the Agreement for and on behalf of the City of Chula Vista.
