FOR MEETING OF: 1 13 75 ITEM TITLE: Resolution #8015 = Endorsing the Telegraph Canyon Creek Flood Control Program under Consideration by the U. S. Army; Corps of Engineers SUBMITTED BY~ Director of Public Works/City Engineer , 9 ITEM EXPLANATION On October 21, 1975 the Council, by minute action, approved the sttaff report and recommendations concerning the Corps of Engineers' Telegraph Canyon Creek Study. Both the Corps of Engineers and County staff were subsequently advised of the Council's action. The envisioned project traverses both City of Chula Vista and Cou~ty of San Diego jurisdictional areas, and so implementation of the plan wil~1 require the cooperation of both agencies. Corps of Engineers' policy requires that one local agency be designated as the sponsor of the project. Such sponsor provides a centralized contact for the Corps and Coordinates the activities of the various local agencies so as to facilitate the progress of the project. Plan "M", endorsed by the Council, involves construction of a lined channel from Fourth Avenue westerly. Approximately half of the total length will be in Chula Vista, and half in County of San Diego jurisdiction. Either agency could logically sponsor the project on the basis of purely physical involve- ment. However, the County staff has expertise in dealing with the Corps, which is lacking in the City staff. County experience was gained~in previous similar projects. An example is the County's sponsorship of the Sweetwater River Flood Control Project. They therefore have well established liaison channels with the Corps. Lastly, the County is properly staffed to accomplish the necessary right of way appraisals, negotiations and acquisitions which will be involved in this project. The City staff is not qualified to act in such .capacity. Requesting the County Board of Supervisors to give the assurances required by the Corps to provide the local cooperation necessary for the construction of the project. 3. Declaring it the Council's policy and intent to enter into negotiations with the County prior to actual construction to determine a mutually equitable apportionment of costs to each agency for those facilities for which the State or Federal agencies declare the cost beyond their responsibility. The Council has, by previous action, approved the concept of Plan.."M". That action did not constitute a commitment by this agency. Similarly, the action recommended herein does not constitute a commitment to support, build or finance the project. Instead, it advises the Board of Suupervisors of the alternative preferred by the City, and requests that the County act in the capacity of local sponsor and coordinator. These actipns are necessary in order to permit the Corps of Engineers to proceed with a more detailed investigation. Agency commitments will be requested only after that more detailed in- vestigation is completed and sufficient facts are made available to justify action by the agencies.
