FOR MEETING OF: 11/25/75 ITEM TITLE: Resolution 7958 Granting Extension of Time for Subdivision Improvement Agreement, Southwestern College Estates Unit #9 ~~ ITEM EXPLANATION SUBMITTED BY~ Director of Public Works/City Engineer The City Council, on September 4, 1973, approved the subdivision improvement agreement for Southwestern College Estates Unit #8 and Unit #9 by Resolution Nos. 7003 and 7005 respectively. Paragraph 3 of the agreement states that the subdivider will cause all necessary materials to be furnished and all improvements required under the provision of the agreement to be done on or before the first anniversary date of the recordation of the map. The public improvements within Unit #8 have been completed and the developer has requested a final inspection for acceptance by the City Council. The subdivider has only performed the grading for Unit #9 and has not to date installed any of the public improvements. The final map for Southwestern College Estates Unit #9 was recorded on September 12, 1973. Therefore, in accordance with the subdivision improve- ment agreement, the developer, Allied Contractors, was obligated to install the improvements in Unit #9 prior to September 12, 1974. The developer, on October 16, 1975, requested an extension of the subdivision improvement agreement for Unit #9 for a period of two years. The reason for the developer's request is that under the present economic conditions the rate which they have been selling new homes within Unit #8 has declined considerably. They want to defer the installation of improvements in Unit #9 EXHIBITS ATTACHED (continued on page 2) Agreement Resolution x Ordinance Plat X Other Environmental Document: Attached Submitted on STAFF RECOMMENDATION: City Council adopt resolution extending subdivision improvement agreement for a period of 2 years on the condition that the subdivider takes proper erosion control measures as directed by the City's Landscape Planner within 30 days after adoption of this resolution by the City Council. The developer has estimated that if their current rate of,buil~ling in Unit #8 continues, .that the maximum time needed to complete the public improvements within Unit #9 is two years. Extending the subdivision improvement agreement for Unit #9 will make September 12, 1976 as the date that all improvements will have to be completed. The developer will keep all bonds which he has posted in full force and effect. As mentioned above, the developer has completed the grading for Unit #9; however, he has not installed the landscaping and irrigation system upon the slopes as required by the Chula Vista Municipal Code and in accordance with the terms of the grading permit. The developer's reasons for a delay in landscaping the slopes until building is completed are: 1. Landscaping and irrigation systems would be targets of vandalism. 2. Landscaping and irrigation systems would be damaged or destroyed by building activity. 3. The permanent irrigation systems are designed to be served individually from each residential lot. The permanent irrigation systems cannot function until building is completed unless temporary services and meters are installed prior to completion of homes and occupancy. The staff met with the developer on November 7, 1975 to discuss temporary measures which he can take to control erosion upon the site of Southwestern College Estates Unit #9. Staff is concerned that upon the acceptance of the public improvements in Unit #8 that erosion will result in a deposition of silt and mud upon the streets, which City forces would be required to maintain. The developer has agreed to take temporary measures to control erosion, as specified by the City's Landscape Planner. Therefore, I am recommending that the subdivision improvement agreement for Unit #9 be extended on the condition that the developer takes proper erosion control measures within 30 days after approval of this resolution by the City Council.
