RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA RESCINDING COUNCIL RESOLUTION NO.
13291 AND GRANTING EASEMENTS TO LINCOLN
HILLTOP BUSINESS CENTER
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, On October 20, 1987, the Council adopted
Resolution No. 13291, granting easements to Hilltop-Main to
maintain portions of a retaining wall within the Palm Road
right-of-way in the Woodlawn Park area, and
WHEREAS, escrow closed just prior to the City finalizing
the grant deed resulting in the easements being granted to the
wrong party, and
WHEREAS, it is now necessary to rescind the previous
resolution and grant the easements again to the new owner,
Lincoln Hilltop Business Center.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby rescind Council Resolution
No. 13291 adopted on October 20, 1987.
BE IT FURTHER RESOLVED that the City Council of the City
of Chula Vista does hereby grant easements to Lincoln Hilltop
Business Center, owners of the property at the northeast corner
of Hilltop and Main Street for a retaining wall, a copy of which
is attached hereto and by this reference made a part hereof, the
same as though fully set forth herein.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized to execute said
easements for and on behalf of the City of Chula Vista.

LINCOLN HILLTOP BUSINESS CENTER
EASEMENT
THE CITY OF CHULA VISTA, a municipal corporation (Grantor), for valuable
consideration, grants to LINCOLN HILLTOP BUSINESS CENTER, a corporation
(Grantee), easement and right-of-way in, upon, over, under and across the
lands hereinafter described, to maintain and use facilities consisting of
retaining walls.
The above facilities will be installed at such locations and elevations
upon, along, over and under the hereinafter described easement as Grantee may
now or hereafter deem convenient or necessary. Grantee also has the right of
ingress and egress, to, from and along this easement in, upon, over and across
the hereinafter described lands. Grantee further has the right, but not the
duty, to clear and keep this easement clear from explosives, buildings,
structures and materials.
The property in which this easement and right-of-way is hereby granted is
situated in the County of San Diego, State of California, described as follows:
Those portions of Palm Road, a private way, in the County
of San Diego, State of California, a per Woodlawn Park Map
No. 1271 recorded June 30, 1910 in the Office of the County
Recorder of San Diego County, and further described as
follows:
Commencing at the Southwesterly corner of Holiday Estates
Unit No. 3, according to Map thereof No. 5896, recorded in
the Office of said County Recorder june 12, i967; thence
Easterly along the Southerly boundary of said Map No. 5896
North 89°59'30'' East 677.70 feet to the Southeasterly
corner thereof, said Southeasterly corner being a point on
the Westerly boundary of said Map No. 1271; thence South
0°06'28" East along the Westerly boundary of said Map No.
1271, 127.27 feet to the True Point of Beginning; thence
North 89°53'32" East 0.50 feet; thence South 0°06'28'' East
35.00'; thence South 89053'32'' West 0.50 feet to said
Westerly boundary; thence North 0°06'28" West 35.00 feet to
the True Point of Beginning.
Also, beginning at said True Point of Beginning; thence
South 0°06'28'' East, along said Westerly boundary, 170.00
feet; thence North 89°53'23'' East 2.00 feet; thence South
0°06'28" East 52.00 feet; thence South 89°53'32'' West 2.00
feet to said Westerly boundary; thence North 0°06'28'' West
52.00 feet to the True Point of Beginning.
Grantor shall not erect, place or construct, nor permit to be erected,
placed or constructed, any building or other structure within this easement.
This easement shall be binding upon and inure to the benefit of
successors, heirs, executors, administrators, permittees, licensees, agents or
assigns of Grantor and Grantee.
IN WITNESS WHEREOF, Grantor executed this instrument this lOth day of
November, 1987.

VISTA APPROVING AND GRANTING EASEMENT TO HILLTOP-MAIN
AT THE NORTHEAST CORNER OF HILLTOP AND MAIN STREET
AND AUTHORIZING THE MAYOR TO EXECUTE SAID GRANT OF
EASEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
That the City of Chula Vista does hereby grant certain
easement to HILLTOP-MAIN, owners of the property at the
northeast corner of Hilltop and Main Street
for a retaining wall
a copy of which is attached hereto and by this reference made
a part hereof, the same as though fully set forth herein.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized to execute same
for and on behalf of the City of Chula Vista.
