SUMMARY
Based on the provisions of California Vehicle Code (CVC) Section 22357 and 22358 and
pursuant to authority under Chula Vista Municipal Code (CVMC) Section 10.48.020, the City
Engineer has determined that the speed limit on Heritage Road between Telegraph Canyon Road
and Olympic Parkway should be increased from 40 mph to 45 mph.
ENVIRONMENTAL REVIEW
The Director of Development Services has reviewed the proposed project for compliance with
the California Environmental Quality Act (CEQA) and has determined that the project qualifies
for a Class 1 (c) categorical exemption pursuant to Section 1530T [Existing Facilities] of the
State CEQA Guidelines because the proposal involves negligible or no expansion of an existing
City street use. Thus, no further environmental review is necessary.
RECOMMENDATION
Council adopt the Ordinance.
BOARDS/COMMISSION RECOMMENDATION
At the September 7, 2011 meeting of the Safety Commission, a motion was made to accept
staff's recommendation and approve the increase of the existing speed limit on Heritage Road
between Telegraph Canyon Road and Olympic Parkway from 40 mph to 45 mph. The motion
carried by a vote of 6 (in favor) - 0 (opposed) - 1 (absent).

DISCUSSION
Staff has completed an Engineering and Traffic survey for a segment of Heritage Road between
Telegraph Canyon Road and Olympic Parkway in accordance with the California Vehicle Code,
which mandates that a speed survey be completed and updated every seven years for each street
with a posted speed limit within the City. Properly justified speed limits allow the Police
Department the ability to provide speed enforcement. An improperly justified speed limit is
considered a speed trap and is not enforceable.
As described in the California Vehicle Code, the survey shall include:
(1) Prevailing speeds as determined by traffic engineering measurements;
(2) Accident records
(3) Traffic/roadside conditions not readily apparent to the driver.
These roadway characteristics are then used to help determine an appropriate speed limit. In
addition, the Manual on Uniform Traffic Control Devices (MUTCD with Traffic Operations
Policy Directive 09-04) states that the speed limit shall be established at the nearest 5 mph
increment of the 85t'' percentile speed. Also, if the 5 mph reduction is applied, the Engineering
and Traffic Survey shall document in writing the conditions and justification for the lower speed
limit and be approved by a registered Civil or Traffic Engineer.
Speed limits established on this basis conform to the consensus of those who drive the street as
to what speed is reasonable and safe, and are not dependent on the judgment of one or a few
individuals. Speed limits higher than the 85`'' percentile speed are not generally considered
reasonable and safe while speed limits below the 85t~' percentile typically do not facilitate the
orderly movement of traffic. Only when roadside development results in traffic conflicts or
unusual conditions not readily apparent to drivers may speed limits be further reduced. Note that
the prevailing speed data must be collected during the non-peak traffic flow periods so that
unimpeded traffic flow data is used.

The following table describes the existing conditions of different segments along Heritage Road:

A horizontal curve, 2000 ft radius over a distance of 568 ft produces a design
Horizontal Alignment speed of 65 mph.
A sag vertical curve, located north of Olympic Parkway, with a -5.67% to
+1.24% grade change over 540' along the centerline produces a design speed of
Vertical Alignment 45 mph.
A sag vertical curve, located south of Telegraph Canyon Road, with a -0.9% to
+6.00% grade char e over a len h of 500' roduces a desi n s eed of 45 mph.
The accident rate at this segment is 0.22 (accidents per million vehicle miles),
Accident Rate: which is lower than the rate of 1.70 for similar roadways in the State of
Segment /State California (2008).
CONCLUSION
Based on the 85t~' percentile speed of the roadway, as well as other roadway characteristics
outlined in the Engineering/Traffic Survey, staff has determined that speed limit should be
increased from 40 mph to 45 mph along Heritage Road between Telegraph Canyon Road and
Olympic Parkway.
Should the City Council establish the proposed 45 mph speed limit, Schedule X of the register
maintained in the office of the City Engineer would be revised to show the following:

DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found no property Holdings
within 500 feet of the boundaries of the property, which is the subject of this action.
CURRENT YEAR FISCAL IMPACT
The cost to post new speed limit signs to implement the proposed speed limit modification is
estimated to be $4,500 in fiscal year 2011-12. The cost of the new signs to be installed is part of
the City's Pavement Rehabilitation Program that is budgeted in the Capital Improvement
Program for fiscal year 2011-12. Therefore, there is no fiscal impact as a result of approving this
ordinance.

TELEGRAPH CANYON ROAD AND OLYMPIC PARKWAY
FROM 40 MPH TO 45 MPH AND AMENDING SCHEDULE X
OF THE REGISTER MAINTAINED IN THE OFFICE OF THE
CITY ENGINEER TO REFLECT THE ESTABLISHED SPEED
LIMIT
WHEREAS, City staff completed a speed survey along Heritage Road between
Telegraph Canyon Road and Olympic Parkway in accordance with the California Vehicle Code
Section 22357, 22358, 40802 and the Chula Vista Municipal Code Section 10.48.020, which
indicates that the posting of speed limits be determined by an Engineering and Traffic Survey at
least once every seven years; and
WHEREAS, as described in the California Vehicle Code, the speed survey shall include
1) Prevailing speeds as determined by traffic engineering measurements; 2) Accident records;
and 3) Traffic/roadside conditions not readily apparent to the driver; and
WHEREAS, the Manual on .Uniform Traffic Control Devices (MUTCD, Traffic
Operations Policy Directive 09-04) states that the speed limit shall be established at the nearest
Smph increment of the 85th percentile speed. Also, if the Smph reduction is applied, the
Engineering and Traffic Survey shall document in writing the conditions and justification for the
lower speed limit and be approved by a registered Civil or Traffic Engineer; and
WHEREAS, based on the 85th percentile speed of the roadway, as well as other roadway
characteristics outlined in the Engineering/Traffic Survey, staff has determined that the speed
limit on Heritage Road between Telegraph Canyon Road and Olympic Parkway should be 45
mph; and
WHEREAS, on September 7, 2011, the City of Chula Vista Safety Commission
concurred with staff s recommendation that the speed limit on Heritage Road between Telegraph
Canyon Road and Olympic Parkway should be 45 mph; and
WHEREAS, this recommendation and other information in the City Engineer's report has
been fully considered by the City Council.

NOW, THEREFORE, the City Council of the City of Chula Vista does hereby ordain as
follows:
I. ESTABLISH SPEED LIMIT
That the speed limit on Heritage Road between Telegraph Canyon Road and Olympic
Parkway be established at 45 mph and Schedule X of the register maintained in the office of the
City Engineer as revised to show the following:
10.48.020 Schedule X -Established Speed Limits in Certain Zones -Designated

Road Olympic Parkway 45 mph
II. EFFECTIVE DATE
This ordinance shall take effect and be in full force on the thirtieth day from and after its
