IN THE AMOUNT OF $238,314 AND AUTHORIZING TH .EXPENDITURE OF ALL AVAILABLE CONTINGENCY F NOT TO EXCEED $24,000 SUBMITTED BY: DIRECTOR OF PUBLIC WORKS ASSISTANT DIRECTOR OF ENG REVIEWED BY: CITY MANAGER -- ASSISTANT CITY ANAGER c7 I 4/STHS VOTE: YES ^ NO SUMMARY On August 31, 2011, the Director of Public Works received eight (8) sealed bids for the Industrial Boulevard Bike Lane and Pedestrian Improvements in the City of Chula Vista, California, CIP No. STL361 project. The proposed resolution, if approved, would award the contract for this project to the low bidder in the amount of $238,314 and authorize the expenditure of all available funds in the project. ENVIRONMENTAL REVIEW The Director of Development Services has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 3 categorical exemption pursuant to Section 15303, New Construction or Conversion of Small Strictures of the State CEQA Guidelines because the proposed project consists of construction of new sidewallc, curb and gutter and expanding a small area of asphalt pavement all within existing street right-of--way. Thus, no further environmental review is necessary. RECOMMENDATION Council adopts the resolution. BOARDS/COMMISSION RECOMMENDATION Not applicable. 6-1 9/27/11, Item Page 2 of 4 DISCUSSION This project is included in the FY2009/2010 Capital Improvement Program budget to constrict bike lanes on both sides of Industrial Boulevard, as well as constntct curb, gutter, and sidewalk and storm drain improvements on the east side of Industrial Boulevard. This project will provide additional pedestrian access between the elementary school and mobile home Park at Naples Street and the commercial area at Palomar Street. The Industrial Boulevard bike lane is one of the priority projects listed in the City's Bikeway Master Plan. Since the area north of Palomar Street is in a SANDAG-designated Smart Growth area, the City applied for, and received, TransNet Smart Growth grant funding for the constriction of the bike and pedestrian improvements between Naples Street and Palomar Street. Immediately north of this project, within Industrial Boulevard is a federally funded project, TF368, which will construct similar improvements between Naples Street and Moss Street. These two projects will be constricted under separate construction contracts at about the same time and will require careful coordination. Staff is actively seeking funding to complete bike and pedestrian improvements from Palomar Street to the north within Industrial Boulevard between "L" Street and Moss Street. Similar improvements are contemplated within Industrial Boulevard between Palomar Street and Main Street, and are included in the Bikeway and Pedestrian Master Plans. Project Design staff prepared contract specifications and advertised the project on August 12, 2011. On August 31, 2011, the Director of Public Worlcs received the following eight (8) sealed bids: CONTRACTOR BID 1 Tri=Group Construction & Development, Inc., San Diego, CA $238,314.00 2 Palm Engineering Construction Co., Inc., San Diego, CA $256,285.16 3 HTA Engineering & Const., Inc., Poway, CA $305,488.00 4 3-D Enterprises, Inc., San Diego, CA $307,726.00 ($307,656.00)* 5 PAL General Engineering Inc., San Diego, CA $317,500.60 6 Heffler Contracting Group, EI Cajon, CA $357,357.00 7 Alvand Construction, Inc., Poway, CA $377,033.00 8 Blair Rasmussen Construction Inc., San Diego, CA $582,821.75 * is the correct total bict amount The low bid submitted by Tri-Group Construction & Development, Inc. is below the Engineer's estimate of $309,263.50.00 by $70,949 (approximately 23% below the Engineer's estimate). This contractor referenced two projects completed in the City in 2007 -- Castle Parlc Sidewalk at Oxford Street and Fourth Avenue, and Arizona Street CMP replacement. In both cases, their work was satisfactory. In addition, staff conducted a detailed check of references for other 6-2 9/27/11, Item Page 3 of 4 agencies and determined that the contractor has performed their worl~ satisfactorily for those agencies. Staff has reviewed the contractor's bid package and recommends awarding the contract to Tri-Group Construction & Development, Inc., San Diego, CA in the amount of $238,314. Tri-Group Construction & Development, Inc. is a licensed General Engineering and General Building Contractor and their License No. 792159 is current and active. The proposed resolution would also authorize the Director of Public Works to approve change orders over and above existing policy limits. Under City Council Policy No. 574-01, if an individual change order causes the cumulative increase in change orders to exceed the Director's authority ("Maximum Aggregate Increase in Change Orders"), then City Council approval is required. The corresponding maximum aggregate contract increase that may be approved by the Director of Public Worlcs under Policy No. 574-01 is $19,682. Approval of tonight's resoluion would increase the Director of Public Worlcs' authority to approve change orders, as necessary, ttp to the contingency amount of $24,000, an increase of $4,318 over Policy No. 574-01. Increasing the contingency funds will allow staff to continue the project without delay should unforeseen circumstances resulting in increased project costs arise during the course of construction, as well as make adjustments to bid item quantities. Unforeseen conditions include such items as utility conflicts, hazardous materials, unexpected underground conflicts, etc. If the contingency funds are not used, then they will be returned to the project fiend balance. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the properties, which are the subject of this action. CURRENT YEAR FISCAL IMPACT Approval of the resolution will award $238,314 to Tri-Group Construction and Development for constntction costs and- authorize the Director of Public Works to spend up to $24,000 in contingencies to cover unforeseen costs. The costs for this project are budgeted in the Capital Improvement Program for fiscal year 2011-12. Therefore, there is no fiscal impact as a result of approving this resolution. The fiscal year 2011-12 costs for this project are estimated to be $429,200 and is summarized on the following table. FUNDS REQUIRED A. Contract Amount $ 238,314 B. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does award the contract for the "Industrial Boulevard Bike Lane and Pedestrian Improvements in the City of Chula Vista, California, CIP No. STL361" project to Tri-Group Construction & Development, Inc., in the amount of $238,314. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista does hereby waive Council Policy 574-01 and authorize the Director of Public Works to approve change orders, as necessary, up to the contingency amount of $24,000, and expend all available funds in the project.
