ITEM EXPLANATION
On February 11, 1976, Mr. and Mrs. Alfred Schmidt applied for an encroach-
ment permit to construct a retaining wall at 906 Buckaroo Lane, within a
portion of the slope maintenance easement of Open Space District IJo. 3.
The slope maintenance easement lies within the property owned by the
Schmidts. The construction of the retaining wall is incidental to the
construction of a swimming pool in the Schrnidts' rear yard.
Section 12.28.020 of the Chula Vista Municipal Code requires that Council
approve this kind of encroachment.
The construction of the retaining wall, approximately 48 feet long and
one to three feet high, does not constitute a hazard to the existing slope.
Approval of the encroachment permit will provide use of additional rear
yard to the property owner.
The Director of Parks and Recreation has no objection to the construction
of the retaining wall within the slope provided the Schmidts assume finan-
cial responsibility for repairing any damage to the existing irrigation
system on the slope.
A transparency is available for Council viewing.
