HomeMy WebLinkAboutAgenda Statement 1976/03/09 Item 13CITY OF CNULA VISTA • COUNCIL AGENDA STATEMENT ITEM NO 13 FOR MEETING OF: 3/9/76 ITEM TIT LE: Resolution #8086 - Approving Agreement between City and Grace Baptist Temple for Participation in the Storm Dra'n at 345 Fifth Avenue SUBMITTED BY~Director of Public Works/City Engineer C~ ITEM EXPLANATION The Planning Commissa.on on June 7,,1971 granted a conditional use permit (PCC 71-12) for the construction of a nursery school and foyer to the chapel of the Grace Baptist Temple at 345 Fifth Avenue. One of the conditions of the C.U.P. was for the church to provide additional parking spaces to ac- commodate the additional facilities. An underground storm drain must be constructed on the church property to satisfy the parking requirements. Presently there is an open drainage channel. The Grace Baptist Temple retained a private engineer to prepare plans for the construction of the storm drain through their property. These plans have been approved by the City Engineer. Mr. Kenneth Johnson, Pastor, and Mr. Charles T".I. Clark of the Grace Baptist Temple have executed an agreement with the City for joint participation in the construction of the storm drain within the church property, and the right of way of Fifth Avenue. The church has executed this agreement for the reason of economy in that it is the engineering staff's opinion that lower bid prices can be obtained if the church's storm drain is constructed in conjunction with the City's project. The City's and church's estimated cost for constructing the ix' portions of the storm drain system is $37,000 and $50,000 respectively, fox a total project cost of approximately $87,000. Form A-113 (Rev 5-75) Supplemental Page Two Abenda.Item-No. 13 1. The City will prepare the contract documents, advertise for competitive bids, award and administer the contract. 2. The City's participation is limited to the acceptance of its expenses for engineering inspection and contract administration at no direct cost to the church. The City designed the portion of project within the street right of way. 3. The Church designed the portion o~ the storm drain within their property. 4. The City will not proceed with the awaxd of the contract for the church's portion of the storm drain until deposits amounting to 100 of -the lowest responsible bid plus loo contingencies are made by the church with the Department of Finance within 30 days of receipt of bids. Upon completion of the contract, any surplus money on deposit by the church will be refunded by the City. The church also agrees to deposit additional moneys if the original deposit is less than the church's actual final share of the cost. The Engineering staff will prepare the bid proposal so that the City's project will be bid as a separate alternative and the combined project for the construction of the church's and City's portion of the storm drain will be bid as a second alternate.
