ITEM TITLE Resolution #8070: Authorizing Acquisition of Certain Land
Owned by Tex A. and Monique P. Richie for Public Street
Purposes

ITEM EXPLANATION
The City Council, following their decision to realign Edgemere Avenue
between "C" Street and I-54, directed City staff to proceed with the
necessary acquisition of right-of-way for this purpose.
The City Attorney's Office filed a complaint in condemnation against
Tex A. and Monique P. Richie to acquire the necessary parcel of land.
Following negotiations, in lieu of a trial on the merits of the action,
the City Council authorized the City Attorney's Office to offer $11,000
for the property, plus that amount required to pay the taxes owed on
that portion of the land which the City is taking. This offer has been
accepted by Tex A. and Monique P. Richie.
The attached Resolution authorizes the Mayor to sign a Stipulated Judg-
ment in Condemnation, the effect of which is to transfer the property
involved to the City of Chula Vista. Additionally, the resolution author-
izes the Director of Finance to prepare a warrant, payable to Tex A.
and Monique P. Richie in the amount of $11,033.36.
Funds are available for this acquisition in Account No. 28-6100-GT-14.
