SUBMITTED BY~ Director of Public Works/City Engineer ITEM EXPLANATION Joseph V. Busch has submitted a request and paid the required fee for the vacation of portions of Toyon Lane east of Corte Maria Avenue. The existing right of way of Toyon Lane is 80 feet and was dedicated through the recordation of Map of Chula Vista, Map No. 505, as a portion of "E" Street. However, when "E" Street was extended, this portion of the street was named Toyon Lane and is classified as a residential street serving 8 properties. The Planning Commission, at their meeting of January 26, 1976, unanimously recommended that the request for vacation be approved. The Streets and Highways Code requires that before the vacation of any street is ordered, the City Council shall adopt a resolution declaring its intention to do so. The resolution must fix a time and place for a public hearing. The vacation will be published and the area to be vacated will be posted. Form A-113 (Rev. 5 - 75) Date: February 10, 1976 ~~~~rr t To: The Honorable Mayor and City Council Via: Director of Public Works ~~I From: Director of Planning Subject: Vacation of portions of Toyon Lane right of way At the meeting of February 9, 1976 the City Planning Commission considered a request submitted by Mr, Joseph V. Busch for the vacation of portions of Toyon Lane right of way. The request was determined by the Environmental Review Coordinator to be categorically exempt (Class 12) from environmental review. The Planning Commission found that the 80 ft. right of way formerly dedicated for "E" Street is not required for the residential street of Toyon Lane which, under City standards, requires a 52 ft. right of way. The Commission, therefore, recommends that portions of the right of way, as shown on Exhibit A, be vacated subject to the condition that easements on Parcels "C" and "D" shall be reserved for San Diego Gas and Electric Company, Pacific Telephone Company and Mission Cable T.V., Inc. - c~~~ L_~ D.
