This subdivision is located at the south- east corner of Second Avenue and Palomar Street. There is an existing 69 and 12 KVA overhead power line adjacent to the subdivision on Second Ave. and an existing 12 KVA on Palomar Street adjacent to the subdivision. Chapter 15.32 of the Chula Vista Municipal Code requires that subdividers underground existing overhead distribution facilities which are adjacent to the property and located within the public. right of way on that one- half of the public right of way contiguous to the boundary of the sub- division whenever the lineal footage of the electric distribution facil- ities to be converted within the subdivision and public right of way adjacent to the subdivision equals or exceeds 600 feet. The underground- ing of power transmission lines of 60,000 volts or more are exempt. On August 26, 1975 Mr. Frank Phillips, Civil Engineer, on behalf of his client, Mr. Muraoka, submitted an application for deferral of underground- ing the existing overhead facilities in accordance with Section 15.32.040 of the Chula Vista Municipal Code. The San Diego Gas and Electric Company has estimated the cost of under- grounding the 12 KVA line in Second Avenue and Palomar Street to be $65,496. Form A-113 (Rw. 5 - 75) Item No. 9 Supplemental Page 2 makes the total cost of undergrounding the 12 F:VA lines $101,300. If this cost is distributed equally amongst the proposed 24 units within the subdivision this would add an additional cost of $4,220 per unit. The cost of only undergrounding the 12 KVA line in Palomar Street is $30,000, or $1250 per unit. It is now appropriate in accordance with Section 15.32.040 of the Chula Vista Municipal Code for the City Council to set a public hearing to determine from evidence presented at the hearing that all the following facts exist: 1. That extraordinary conditions exist to the extent that under- grounding of existing utilities would result in unnecessary hardship to the subdivider or to the utility company. 2. That the deferral of the requirement to underground existing overhead utilities will not under the circumstances of the particular case by detrimental to the health, safety or general welfare of the neighborhood.
