ITEM EXPLANATION
The final map of Windsor Views Subdivision has been checked by the
Engineering Division and found to be generally in conformance with the
tentative map approved by the City Council on July 9, 1974, Resolution
No. 7365. Sesame Street and a portion of Telegraph Canyon Road are being
offered for dedication on the map.
The developer has requested that the City Council approve the subdivision
final map even though he has not submitted subdivision bonds and certain
documents normally submitted at this time. The posting of surety instru-
ments within 60 days of approval of the final map is permitted in
accordance with Section 18.16.100 of the City Code.
In addition to the subdivision bonds, there are several items normally
provided at this time which the subdivider now proposes to provide within
60 days. They are:
1. The filing of the condemnation fee and immediate
possession of Paseo Ladera and the portion of
Sesame Street outside the subdivision boundary.
2. Certain required fees.

3. Letters from the Otay Municipal Water District,
San Diego Gas & Electric Company, P~Sission Cable
TV stating that satisfactory financial arrange-
ments have been made to provide services to each
lot.
Provision of the items above to the City appears to be dependent upon
payments by the developer. The developer states that he is unable to
make these payments (and post his bonds) until he receives a loan -
but the loan is dependent upon City Council approval of the final map.
The Subdivision Ordinance also provides that all signatures of City
officials, except the City Attorney and City Clerk, shall be affixed
to the final map at least eight days prior to submittal of the final
map to the City Council for approval.
Because certain security documents and fees have not been submitted at
this time, I have elected to withhold my signature from the final map
and do not intend to sign the final map until all requirements are
fulfilled. Although this is not in accordance with the City Code, it
is in compliance to the State blap Act and is the practice of many cities.
The developer states that the lender will approve his loan after City
Council approval of the final map whether or not I have signed the map.
Apparently the lender views the Council's action as something other than
routine or ministerial in this case.
A transparency of the subdivision, which encompasses 1£i.34 acres and
consists of 58 lots, is available for Council viewing.
