RESOLUTION N0. 8091
RESOLUTION OF THE CITY COUNCIL OF THE CITY Or CHULA
VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND ADOLPH A. BIGGE AS PERSONNEL CONSULTANT
TO DIRECT THE PERSONNEL ACTIVITIES OF THE CITY OF
CHULA VISTA
AND AUTHORISING THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that that certain agreement
between THE CITY OF CHULA VISTA, a municipal corporation, and
ADOLPH A. BIGGE as personnel consultant to direct the personnel
activities of the City of Chula Vista
dated the 23rd day of March , 19~_, a copy of
which is attached hereto and incorporated herein, the same as though
fully set forth herein be, and the same is hereby approved

INDEPENDENT CONTRACTOR AGREEMENT FOR PERSONNEL
CONSULTANT TO DIRECT THE PERSONNEL ACTIVITIES
OF THE CITY OF CHULA VISTA
THIS AGREEMENT, made and entered into in the City of
Chula Vista, California, this 23rd day of March , 1976,
by and between the CITY OF CHULA VISTA, a municipa corporation,
hereinafter referred to as "City", and ADOLPH A. $IGGE, 1224
Catalina Boulevard, San Diego, California 92107, hereinafter re-
ferred to as "Personnel Consultant";

WHEREAS, the City of Chula Vista has heretofore adver-
tised and distributed announcements for qualified persons to apply
for the position of Director of Personnel for the City of Chula
Vista, and
WHEREAS, after reviewing a substantial number of appli-
cations, the City has determined that the person best qualified
to fulfill the functions of the position of the Director of
Personnel is Adolph A. Bigge, the ex-Personnel Director of the
City of San Diego, who is highly qualified by training and experi-
ence, and
WHEREAS, Mr. Bigge may have a physical disability that
could possibly expose the City to liabilities if he were employed
in the Unclassified service of the city, and
WHEREAS, the City for that reason wishes to retain Mr.
Bigge on a contractual basis as Personnel Consultant to fulfill
the duties and functions of the position of Director of Personnel.
NOW, THEREFORE, in consideration of the mutual promises
and upon the terms and conditions contained herein, the City and
Adolph A. Bigge, Personnel Consultant, agree as follows:
1. SCOPE OF SERVICE.
The Personnel Consultant agrees to provide the following
specific professional services in addition to all those general
duties and responsibilities defined by City Charter or Municipal
Code as well as any and all duties that may hereafter be assigned
by the City Manager or City Council as an independent contractor
retained by the City:
1.1 Personnel Program.
Consultant shall direct and coordinate a comprehensive
personnel program for the full-time and part-time bud-
geted employees, and the full-time CETA employees subject
to the general administrative direction of the City
Manager and/or Assistant City Manager.
1.2 Studies and Recommendations to the City Manager,
Civil Service Commission and City Council.
Consultant agrees to make or direct the preparation
of studies on a variety of personnel matters and make
recommendations to the City Manager, Civil Service
Commission and City Council.

Consultant shall supervise the staff of the Personnel
Department and coordinate the City's safety and in-
service training programs.
1.4 Employer-Employee Relations.
Consultant agrees to assume the major responsibility
for on-going employer-employee relations and develop
policies to forward such relations, and he may, with
the supervision of the Manager's office, be chief
negotiator for the City in all matters of collective
bargaining, and he shall further advise the City Mana-
ger and the City Council regarding all aspects of
unit representation and relationships with registered
or recognized collective bargaining units.
1.5 Schedule of Work.
The Personnel Consultant agrees to devote such time
as is necessary to fulfill completely said duties
subject to the direction and supervision of the City
Manager or the Assistant City r2anager and further
agrees that he shall not engage in any other employ-
ment or contractual activity during the term of this
contract.
2. TERM OF CONTRACT.
The term of this contract shall be for a period of one
(1) year commencing April 1, 1976 through P4arch 31, 1977.
3. COMPENSATION.
Consultant shall receive as full and complete compen-
sation for his performance as an independent contract the sum of
TWO THOUSAND ONE HUNDRED SEVENTY-FIVE DOLLARS AND no/100s ($2175)
per month commencing in April of 1976. Further, the Consultant
may, upon the authorization of the City Manager, receive the sum
of TWO THOUSAND THREE HUNDRED DOLLARS AND no/1005 ($2300) per
month from and after October 1, 1976. In addition to such com-
pensation, the Consultant shall receive the same benefits as any
other department head except for the following specifically ex-
cluded benefits:
A. D2edical - fully paid health plan for employee
and dependents.
B. Life Insurance - $300.00 per year toward indi-
vidual life insurance coverage.
C. Retirement - Member of Public Employees Retire-
ment System.
D. Long Term Disability - fully paid plan.
4. AUTHORITY AND RIGHTS OF CONSULTANT.
Consultant shall have the same authority in dealing with
other departments of the City and the City Council as would a reg-
ularly employed Director of Personnel in order to facilitate the
expeditious carrying out of his obligations under this contract.
Further, he shall receive the same legal protection and insurance
for any liabilities arising out of the performance of his duties
as would such a Director of Personnel.

5. CANCELLATION.
This agreement may be cancelled by either party upon
thirty (30) days written notice as forwarded by the City Manager
by mail to the Consultant's address as shown hereinabove or by
personal delivery at the direction of the City Manager, or by
delivery to the City Manager of such a notice of cancellation
either by mail or in person by the Consultant.

forth.
