HomeMy WebLinkAboutReso 1976-8086RESOLUTION NO . 8086 RESOLUTION OF THE CITY COUNCIL OF ~iE"'CI'TY OF CHULA VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND GRACE BAPTIST TEMPLE FOR PARTICIPATION IN STORM DRAIN SYSTEM INSTALLATION at 345 FIFTH AVENUE IN THE CITY OF CHULA VISTA AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and Grace Baptist Temple for participation in storm drain system in- stallation at 345 Fifth Avenue in the City of Chula Vista dated the 9th day of March 1976 a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. DATED City Clerk AGREEMENT FOR PARTICIPATION IN STORM DRAIN SYSTEM INSTALLATION AT 345 FIFTH AVENUE IN THE CITY OF CHULA VISTA TiiIS AGREEMENT, made and entered into this 9th day of March , 1976, by and between THE CITY OF CHULA VISTA, a municipal corporation, hereinafter called "City", and THE GRACE BAPTIST TEMPLE, hereinafter called "Church"; ~-1 I T N E S S E T H WHEREAS, Grace Baptist Temple, owner of property located at 345 Fifth Avenue in the City of Chula Vista desires to install a storm drain consisting of a reinforced box culvert, 10' x 4.5', including a headwall at the inlet and an 8' stub of 18" corrugated steel pipe for future tie of a lateral drain pipe, as a require- ment of building a new structure on the church site, and agrees to participate in the cost of constructing the storm drain system, and WHEREAS, the City has plans to construct a box culvert across Fifth Avenue at City's expense and agrees that joint construc- tion of said storm drain system would be to the best interest of the City and Church. NO6J, THEREFORE, IT IS MUTUALLY AGREED by and between the City and Church as follows: 1. City agrees to prepare the contract documents and advertise for competitive bids to construct said storm drain system and appurtenant work in accordance with plans and specifications as approved by ttie City Engineer. City will award the contract and administer said contract to accomplish the vaork set forth herein- above. 2. It is understood that the Engineer's cost estimate for the ~~aork on the Church's property is FIFTY THOUSAND DOLLARS AND NO CENTS ($50,000.00) as shown on Exhibit "A", attached hereto and incorporated herein by reference as if set forth in full. It is further understood that City will not proceed with the award of contract until deposits amounting to 100% of the lowest responsible bid plus 10~ contingencies are made with the Department of Finance. Deposit by Church is to be made within thirty (30) days from receipt of bids, then the City will award a contract for constructing those drainage facilities lying within the public right of way. Contin- gency funds deposited may be utilized by the City to defray unfore- seen construction expenses as may arise during the progress of the work. 3. The City's participation is limited to the acceptance of its expenses for all construction, engineering and inspection, contract documents, advertisement for bids, award of contract and contract administration at no direct cost to the Church. 4. Upon the completion and acceptance of the work, the City will prepare the actual and final cost of the construction. - 1 - SQL 5. Church agrees to deposit with the Director of Finance, following receipt of bids, but prior to award of contract by the City, cash money in an amount equal to the unit prices bid for the drainage facilities to be constructed across their property plus 10% contin- gencies. Any surplus money on deposit by the Church on its share will be refunded by the City. Church further agrees to deposit additional monies if the original deposit is less than the Church share of the actual and final cost. IN WITNESS LJHEREOF, this agreement is executed by the City of Chula Vista acting by and through its Mayor and pursuant to Resolution adopted by the City Council of the City of Chula Vista, authorizing such agreement, and by the Grace Baptist Temple as first hereinabove written.
