RESOLUTION OF THE CITY COUNCIL OF THE CIIY OF CHULA VISTA
AUTHORIZING ISSUANCE OF COASTAL DEVELOPMENT PERMIT #029
TO SANTA FE LAND IMPROVEMENT COMPANY FOR THE DEMOLITION
AND REMOVAL OF ONE SMALL SHED FROM THE MIDBAYFRONT
The City Council of the City of Chula Vista does hereby resolve
as follows:
WHEREAS, the Chula Vista Bayfront Local Coastal Program (LCP) was
certified by the California Coastal Commission; and,
WHEREAS, said LCP includes coastal development permitting
procedures determined by the Coastal Commission to be legally adequate for
issuance of Coastal Development Permits; and,
WHEREAS, the City of Chula Vista has assumed permit authority over
the Chula Vista Coastal Zone; and,
WHEREAS, the City Council held a public hearing on April 12, 1988,
in accordance with said permitting procedures; and,
WHEREAS, the City Council of the City of Chula Vista, as approving
authority, has reviewed the proposal for demolition and removal of one shed
from the Midbayfront.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Chula Vista finds, based on the following findings, in accordance with
Section 13311 of the California Adminsitrative Code, that the demolition
of the shed in the Midbayfront and its removal is consistent with the
policies of the Chula Vista Bayfront LCP.
1. The shed is located on the portion of the Midbayfront zoned
for office park use. Removal of the shed is consistent with the
planned use of the site.
2. The demolition of the shed improved the visual quality of the
Midbayfront and thus is consistent with the LCP form and appearance
guideline which states: "Improve the visual quality of the shore-
line by promoting public and private uses which provide proper
restoration, landscaping, and maintenance of shoreline areas".
3. The demolition of the shed also removed a blighting influence
on the area consistent with the form and appearance guideline which
states: "Remove, or mitigate by landscaping, structures or
cpnditions which have a blighting influence on the area".
BE IT FURTHER RESOLVED that the City Council of the City of
Chula Vista hereby issues Coastal Development Permit #029 for the
demolition and removal of one shed from the Midbayfront.
BE IT FURTHER RESOLVED that the City Council of the City of
Chula Vista hereby declares that although development has taken place
prior to submission of this permit application, consideration of the
application by the City Council has been based solely upon the policies
of the certified Chula Vista Local Coastal Program. Approval of the
permit does not consitute a waiver of any legal action with regard
to this violation of the Chula Vista Bayfront Specific Plan that may
have occurred; nor does it consitute admission as to the legality of
any development undertaken on the subject site without a coastal
development permit.
