HomeMy WebLinkAboutReso 1976-8060Form No'. 3 4 2 Revs 3/74 RESOLUTION NO, 8060 RESOLUTION OF THE CITY COUNCIL OF THE CITY Off` CHULA VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND COUNTY OF SAN DIEGO FOR THE IMPROVEMENT OF MAIN STREET AND AUTHORISING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and COUNTY OF SAN DIEGO, for the improvement of Main Street dated the 17th day of February 19 76 a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approveda BE IT FURTHER RESOLVED that the City Council shall provide the funding for such participation in the 1976-77 budget. DATED Mayor of the City of Chula Vista City Cler AGREEMENT FOR THE IMPROVEMENT OF MAIN STREET, CHULA VISTA AREA THIS AGREEMENT executed this 17th day of February , 1976 by and between the CITY OF CHULA VISTA, a municipal corporation, hereinafter called the City, and the COUNTY OF SAN DIEGO, a political subdivision of the State of California, hereinafter called the County. WITNESSETH: WHEREAS, the City and the County desire to enter into a joint cooperative agreement to construct Main Street from Fresno Avenue easterly to the Interstate 805 Freeway, a total distance of approximately 1.70 miles, NOW THEREFORE In consideration of the recitals and the mutual obligation of the parties as herein expressed, the City and County agree as follows: 1. The City and the County shall cause to be constructed that portion of Main Street from Fresno Avenue easterly to Interstate Route 805. The portions to be constructed are the areas agreed to be within the jurisdictions of the City and County and are more particularly described and depicted on Exhibit A hereto attached and hereby made a part of this agreement. The approximate length of the improvement within the City is 0.44 mile and the County Ts por- tion of the proposed improvement is approximately 1.26 miles. 2. That the distribution of the work and the responsibility therefore are as follows: a. The County will design and prepare plans and specifications for the project. Gd -2- b. The County will provide all inspection and contract management services. c. The County will perform all materials engineering necessary to determine a suitable structural section and provide control testing during the construction for the project as depicted on Exhibit A. d. The County will be responsible for and act as lead agency in the preparation and processing of any necessary environmental documents. e. The County will obtain any necessary permits from the Environ- mental Protection Agency (E.P.A.). f. The County shall coordinate with the City in regards to the pre- cise alignment of Main Street to be used in the design. g. The County will provide the necessary coordination, contractual agreements, administration, and billing for all Federal and State project financial assistance, under the Federal Aid Urban Highways program. h. All costs incurred by the County for preliminary engineering, de- sign, and construction engineering expenses, inspection, and contract management services, shall be shared by the City and County. The City shall reimburse the County for its proportionate share based on 25% of the total cost to the County. i. The City shall reimburse the County for its share of the con- struction costs of the improvement in accordance with Section 6 of this agreement. 3. In the event right-of-way must be purchased or condemned it will be the responsibility of the County to acquire the right-of-way. The City shall reimburse the County for the necessary right-of-way, and acquisition costs related thereto, for parcels that must be purchased or condemned as follows: Gd -3- a. The right-of-way presently within the jurisdiction of the City as shown on Exhibit A, hereto attached, and b. Any right-of-way which is part of a parcel of real property pre- sently within the County jurisdiction as shown on Exhibit A which has been annexed to the City prior to acquisition as evidenced by the recordation of a final order of condemnation, grant deed, or grant of easement for such right-of-way. Notwithstanding (a) and (b) above, the City and County shall share equally the total cost to both City and County for acquiring all right-of-way between Stations 100 + 31.3 and 107 + 09.17. 4. The City shall approve final plans before the project is advertised for bids. 5. After bids for the improvement have been received and opened by the County, and prior to the award of any contract for said improvement by the County, the County shall notify the City of the lowest responsible bid. If the City wishes to reject, for cause, award of the contract in accordance with the lowest responsible bidder, the County will reject all bids and call for new bids based either on the existing contract documents, or on revised plans and specifications. If the contract cannot be awarded, the City will reimburse the County for its share of engineering. The County will furnish the City a mylar reproducible set of right-of-way plans and as-built improvement plans upon completion of the pro- ject. Four sets of plans and specifications shall be furnished to the City upon award of the contract. 6. After approval by the City of the responsible low bidder prior to the award of contract, the City shall deposit with the County for the improvements the City's estimated share of the net local construction costs of said improve- ment. The City's share of the net local construction costs will be computed in accordance with Section 7 of this agreement. GO r . -4- . . 7. The net total construction cost to be shared by the City and County shall be the total of the construction costs, including utility relocation, if such there be, less all State and Federal project financial assistance. The City's share of the net local construction costs shall be computed on the basis of 25% of the difference between the total construction cost and the total of all State and Federal project financial assistance. After the final determina- tion of the net total local construction costs, the County will apply any excess construction cost deposit to the City's share of engineering and contract man- agement costs. If there is a deficiency in the City Ts construction costs de- posit, it will be added to the City's share of engineering to accomplish the sharing of costs hereinabove provided. Final payment is due and payable upon receipt of a bill from the County. 8. Those portions of the roadway to be constructed by the City and the County shall be designed for a sixty-three foot (63t) minimum traveled way or the equivalent. All plans and specifications for the portion of the said improvement to be constructed by the City and the County will be approved by the County Engineer on behalf of the County and by the City Engineer on behalf of the City.
