HomeMy WebLinkAboutReso 1976-8054RESOLUTION NO® 8054 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ELECTING TO PROCEED UNDER THE PROVISIONS OF THE STREET VACATION ACT OF 1941, DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA TO VACATE A PORTION OF FIRST AVENUE, NORTH OF MILLAN COURT AND FIXING A TIME AND PLACE FOR HEARING THEREON The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Council of the City of Chula Vista has determined that the public interest and convenience of said City re- quire the vacation of the Easterly 12 feet of First Avenue, North of Millan Court. NOW, THEREFORE, BE IT RESOLVED that it is the intention of the City Council to order the vacation of a portion of First Avenue, North of Millan Court more particularly described in Exhibit "A" attached hereto and by this reference made a part hereof, the same as though fully set forth herein. BE TT FURTHER RESOLVED that the Council of the City of Chula Vista hereby elects to proceed in making said vacation under the pro- visions of the Street Vacation Act of 1941, and hereby fixes Tuesday , the 2nd day of March , 1976 , in the Council Chambers in the Civic Center, 276 Fourth Avenue, Chula Vista, California, as the time and place for hearing all persons interestsd in or objecting to the pro- posed vacations BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and ~e is hereby directed to cause a copy of this resol- ution to be published once in the Chula Vista Star News, a newspaper of general circulation published within the City of Chula Vista, and to cause notices of the passage of this resolution to be posted in the manner and form required by law. DATED Clerk of-the City of Chula above is a full, true and that the same has not been City Clerk l~ weiiC (I ,! lfft L .~, "`.` DEPARTMENT OF PLANNING January 27, 1976 The Honorable Mayor and City Council of the City of Chula Vista Civic Center Chula Vista, Calif. ~~ City o~ Clnu.~a vista CALIFORNIA Subject: Request for vacation of the easterly 12 feet of First Avenue a distance of 267 feet north of Millan Court At the meetings of December 22, 1975 and January 26, 1976 the City Planning Commission considered a request submitted by Ken Green for the vacation of the easterly portion of First Avenue between Millan Court and the entrance to Hilltop Park. Section 12.40.010 of the Municipal Code requires both the City Engineering Department and City Planning Department to conduct reasonable investigation to ascertain whether or not the public interest would be served by vacating a specific street.. After reviewing the investigations and facts cited by both departments, the Planning Commission determined that it was not in the public interest to recommend the vacation of this portion of the street right of way. It was noted that the existing 80 ft. right of way extends both north and south of the subject property and any future use of this right of way for public purposes would be prohibited by the vacation of a portion of the right of way as requested by the applicant. The Planning Commission, therefore, unanimously recommended that the request for vacation be denied. D. J.
