DEPARTMENT OF PLANNING

Subject: Request for vacation of the easterly 12 feet of First
Avenue a distance of 267 feet north of Millan Court
At the meetings of December 22, 1975 and January 26, 1976 the City
Planning Commission considered a request submitted by Ken Green for
the vacation of the easterly portion of First Avenue between Millan
Court and the entrance to Hilltop Park.
Section 12.40.010 of the Municipal Code requires both the City
Engineering Department and City Planning Department to conduct
reasonable investigation to ascertain whether or not the public
interest would be served by vacating a specific street.. After
reviewing the investigations and facts cited by both departments,
the Planning Commission determined that it was not in the public
interest to recommend the vacation of this portion of the street
right of way.
It was noted that the existing 80 ft. right of way extends both
north and south of the subject property and any future use of this
right of way for public purposes would be prohibited by the vacation
of a portion of the right of way as requested by the applicant.
The Planning Commission, therefore, unanimously recommended that the
request for vacation be denied.
